Terms of Service

This Agreement is entered into by WhatsGoodApps LLC (“WhatsGoodApps,” “We,” “Us,” or “Our”), the developer of the Hantavirus Maps app service (the “App”, “Service” or “Services”), and the entity or person agreeing to these terms (the “Customer,” “You” or “Your”), and governs the Customer’s access to and use of the Services.

For purposes of this Agreement, “Assets” means any content, materials, outbreak overviews, case summaries, maps, map markers, country-level information, ship or maritime case information, newsfeed items, article summaries, links, health-related informational content, graphics, visuals, reports, data, software components, or other information generated, displayed, provided, or made available through the Services, whether created by Us, aggregated by Us, generated by automated systems, or supplied by third parties.

This Agreement is effective when the Customer is presented with this Agreement and proceeds to use the Services (the “Effective Date”) or to receive or distribute Assets. These terms may be updated and presented again to the Customer from time to time. Continued use of the Services constitutes acceptance of the updated terms. If You do not agree to this Agreement, please stop using the Services.

Service Availability and Quality

We are constantly improving the Services to make them better. The Services are subject to modification and change. No guarantees are made with respect to the Services’ quality, stability, uptime, reliability, accuracy, completeness, timeliness, or continued availability. Please do not create any dependencies on any attributes of the Services. We will not be liable to You or Your downstream customers for any harm caused by Your dependency on the Service.

Age Requirements

By accessing the Services, You confirm that You are at least 18 years old and meet the minimum age of digital consent in Your country. The Services are intended only for adults. You may not use the Services if You are under 18 years old.

If You are a parent or legal guardian and You believe that a minor has accessed or used the Services, please contact Us so that We may take appropriate action.

Your Information

By using the Services, You may provide Us with personal information like Your email address, user name, billing information, app usage information, location-related settings or preferences, and other information that You enter or submit. Please see Our Privacy Policy.

Prohibited Uses

We reserve the right to suspend or ban Your access to the Services at any time, and for any reason.

You may not:

Use the Services for competitive research or to build a competing product or service;
Scrape, copy, harvest, extract, download, redistribute, republish, sell, license, or commercially exploit any data, maps, case information, newsfeed content, or other Assets except as expressly permitted by the Services;
Misrepresent the Services, Assets, maps, outbreak information, case summaries, or newsfeed content as official government, medical, public health, or emergency guidance;
Use the Services as the sole basis for medical, travel, safety, public health, emergency, occupational, legal, financial, or other important decisions;
Use the Services to create panic, spread misinformation, harass others, or make false or misleading claims about disease activity, outbreaks, cases, locations, countries, vessels, or public health risks;
Reverse engineer, decompile, or attempt to extract the underlying algorithms, models, data feeds, or systems used in the Services;
Use automated tools, bots, or scripts to access, interact with, monitor, scrape, or extract data from the Services;
Share Your account or allow multiple users to access the Services through a single account;
Violate these Terms of Service or any other policies applicable to the Services;
Violate the privacy, publicity, intellectual property, contractual, or other rights of any third party;
Upload, submit, transmit, or distribute content that is unlawful, harmful, abusive, harassing, defamatory, obscene, misleading, infringing, or otherwise objectionable;
Interfere with, disrupt, or attempt to gain unauthorized access to the Services, servers, data feeds, APIs, or networks connected to the Services;
Access or obtain any materials or information through any means not intentionally made available by the Services;
Use the Services for fully automated decision-making that could adversely impact an individual’s legal rights or create binding obligations;
Use the Services in any way that violates any applicable national, federal, state, local, or international law or regulation; or
Attempt to do any of the foregoing.
We reserve the right to investigate complaints or reported violations of Our Terms of Service and to take any action We deem appropriate including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to user profiles, e-mail addresses, usage history, posted materials, IP addresses and traffic information.

Informational Use and No Medical Advice Disclaimer

The App provides informational tools relating to hantavirus activity, including outbreak overviews, interactive maps, country-level information, ship or maritime case information, and newsfeed content. The App and all Assets are provided for general informational and educational purposes only.

The App does not provide medical advice, diagnosis, treatment, prevention guidance, public health directives, emergency guidance, or any other professional advice. The App is not a substitute for advice from a qualified physician, public health authority, government agency, emergency service, travel professional, occupational safety professional, or other qualified professional.

If You have questions about symptoms, exposure, diagnosis, treatment, travel, public health requirements, or personal safety, You should consult a qualified healthcare professional, official public health authority, or other appropriate professional source.

No Public Health Authority or Official Source

WhatsGoodApps is not a public health authority, government agency, medical provider, research institution, emergency service, or official disease reporting agency. The App is not affiliated with, endorsed by, sponsored by, or officially connected to the World Health Organization, the Centers for Disease Control and Prevention, any government agency, any public health authority, any news publisher, any ship operator, or any other third-party organization unless expressly stated.

The Services should not be treated as an official source of case counts, outbreak status, travel advisories, safety warnings, public health instructions, or emergency information.

Data Accuracy, Timeliness and Completeness Disclaimer

The App may display outbreak information, case summaries, geographic markers, country-level details, ship-related information, and newsfeed items based on third-party data, public sources, news sources, automated processes, manual review, or other sources. Such information may be delayed, incomplete, inaccurate, outdated, duplicated, misclassified, or otherwise unreliable.

We make no representation or warranty that any case count, outbreak overview, location, country detail, ship detail, news item, date, map marker, trend, summary, or other Asset is accurate, complete, current, verified, or suitable for any particular purpose.

Hantavirus reporting, confirmation, classification, and public availability of data may vary by jurisdiction, source, language, publication timing, testing availability, and reporting practices. Absence of a marker, country listing, case summary, news item, or other Asset should not be interpreted to mean that no cases, risk, outbreak, or relevant activity exists in that location.

Third-Party Data Sources and Newsfeed Disclaimer

The App may include or link to third-party data, public records, government or public health statements, news articles, publisher content, maritime information, maps, APIs, or other third-party materials. We do not control, guarantee, verify, or endorse any third-party data or content.

Newsfeed items, article headlines, summaries, snippets, links, and publisher materials are provided for convenience and awareness only. We are not responsible for the accuracy, completeness, opinions, editorial positions, availability, legality, or reliability of any third-party news content or website.

When You access third-party websites, services, articles, maps, or resources, You do so at Your own risk and subject to the terms and privacy policies of those third parties.

Map, Geographic and Visualization Disclaimer

Maps, markers, boundaries, geographic groupings, hotspot indicators, ship markers, and other visualizations in the App are approximate, illustrative, and informational only. They may not reflect exact locations, official boundaries, complete case distributions, current risk levels, or confirmed transmission areas.

Map markers may be based on approximate locations, reported regions, countries, ports, ship routes, publication locations, or other available information. Markers may be generalized, estimated, shifted, or displayed at a higher-level geographic area rather than a precise case location.

Visual intensity, color, clustering, or placement should not be interpreted as a definitive statement of risk, severity, spread, transmission, or official public health status.

Country-Level and Maritime Information Disclaimer

Country-level pages and details are provided for informational convenience and may not include all cases, historical events, current reports, local advisories, regional variations, official classifications, or source limitations.

Ship, vessel, cruise, cargo, maritime, or port-related information may be delayed, estimated, incomplete, or based on limited reporting. Not all vessels, cases, suspected cases, ports, routes, exposures, or relevant maritime events may be captured or displayed in the App.

No Reliance for Medical, Travel, Safety or Emergency Decisions

You agree that You are not relying on the App as Your primary or sole source of medical information, public health information, travel guidance, safety guidance, emergency information, workplace safety guidance, or professional advice. Any decision to use, interpret, share, or act upon the App’s outputs is made solely by You.

You should independently verify information through qualified healthcare professionals, official public health agencies, government sources, transportation providers, employers, travel advisors, or other appropriate professional sources before making any health, travel, safety, workplace, financial, legal, or emergency-related decision.

User Responsibility and Use at Your Own Risk

You are solely responsible for how You interpret, use, rely on, share, or act upon any outbreak overview, map, marker, case summary, country-level information, ship-related information, newsfeed item, article link, notification, or other Asset provided by the App. WhatsGoodApps is not responsible for any decision, delay, loss, harm, exposure, missed warning, misunderstanding, travel disruption, health outcome, cost, or other consequence arising from Your use of or reliance on the Services or Assets.

No Monitoring Obligation

WhatsGoodApps does not monitor, verify, validate, or confirm all third-party data, public reports, news articles, outbreak information, case summaries, map markers, country-level details, ship-related information, or other Assets and has no obligation to do so.

Changes to Data, Sources and Features

We may add, remove, update, modify, suspend, replace, or discontinue any data source, news source, map feature, country page, ship marker, outbreak overview, alert, notification, or other feature at any time without notice. Data feeds and third-party services may become unavailable, delayed, restricted, changed, or discontinued.

Intellectual Property and Third-Party Rights

The Services, including the App design, layout, organization, graphics, software, user interface, curated presentations, map layers created by Us, summaries, and other proprietary elements, are owned by WhatsGoodApps or its licensors and are protected by intellectual property and other laws. Underlying third-party data, maps, APIs, news articles, trademarks, and other materials may be owned by their respective third-party providers, sources, publishers, or rights holders.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, sell, sublicense, or otherwise exploit the Services or Assets except as expressly permitted by Us or applicable law.

Limitation of Liability

To the fullest extent permitted by law, WhatsGoodApps LLC and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages (including but not limited to loss of profits or any other financial losses) arising from:

Your use of or reliance on any outbreak overview, map, map marker, case summary, country-level detail, ship-related information, newsfeed item, article link, alert, notification, or other Asset generated, displayed, or made available by the App.
Any inaccuracy, incompleteness, delay, duplication, omission, misclassification, outdated information, data feed failure, or error in the Services or Assets.
Any incorrect, incomplete, delayed, or misleading information caused by third-party sources, news publishers, public reports, government sources, map providers, API providers, data providers, automated systems, or manual processing.
Any missed outbreak, missed case, missed news item, missed alert, incorrect risk assessment, or absence of information in the App.
Any medical, health, travel, safety, emergency, workplace, legal, financial, or other decision or action taken by You or any third party based on the Services or Assets.
Any illness, exposure, injury, death, health outcome, treatment delay, travel disruption, quarantine issue, evacuation issue, business interruption, or other consequence arising from use of or reliance on the Services or Assets.
Any issue arising from map visualization, geographic approximation, boundary depiction, marker placement, country classification, regional grouping, ship marker, port information, or maritime data.
Any loss, deletion, corruption, unavailability, interruption, suspension, or discontinuation of Services, data feeds, newsfeeds, maps, notifications, alerts, saved information, or other content.
Your use of or interaction with any Third-Party Services, third-party websites, third-party articles, third-party maps, or third-party data sources.
Both the Services and the Assets are provided to Customer on an “AS IS” BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or implied, including, without limitation, any warranties or conditions of TITLE, NON-INFRINGEMENT, MERCHANTABILITY, or FITNESS FOR A PARTICULAR PURPOSE. You are solely responsible for determining the appropriateness of using the Service and assume any risks associated with use of the Services.

The Service is not intended to provide medical, public health, emergency, travel, safety, financial, legal, or other professional advice.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT NEITHER WHATSGOODAPPS NOR ITS OFFICERS, EMPLOYEES, DIRECTORS, SHAREHOLDERS, LICENSORS, SERVICE PROVIDERS, AFFILIATES AND AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY DAMAGES, OR DAMAGES FOR LOSS OF PROFITS INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WHATSGOODAPPS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, RESULTING FROM: (A) THE USE OR THE INABILITY TO USE THE SERVICES OR ANY RELATED INFORMATION; (B) UNAUTHORIZED ACCESS TO THE SERVICES; (C) CONDUCT OF ANY THIRD PARTY (INCLUDING OTHER USERS) OF THE SERVICES; OR (D) ANY OTHER MATTER RELATING TO THE SERVICES. IN NO EVENT WILL WHATSGOODAPPS’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES OR CAUSES OF ACTION EXCEED THE GREATER OF (I) ONE HUNDRED DOLLARS ($100) OR (II) THE PRICE YOU PAID FOR THE SERVICE IN THE LAST TWELVE (12) MONTHS. IF YOU ARE MERELY DISSATISFIED WITH ANY PORTION OF THE SERVICES OR WITH THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE SERVICES.

Indemnification

You will indemnify, defend and hold harmless WhatsGoodApps and its affiliates, shareholders, officers, directors, employees, agents and representatives from and against any and all claims, including all damages, judgments, costs and expenses (including, reasonable attorneys’ fees) (“Claims”), arising out of and relating to (a) any Claims concerning information input, submitted, shared, or distributed by You, (b) Your use of the Services, including Your access to, use of, sharing of, reliance on, republication of, or misuse of the Services or Assets, (c) any decision or action taken by You or any third party based on the Services or Assets, or (d) Your violation of these Terms of Service (including use of the Services in violation of these Terms of Service).

Dispute Resolution and Governing Law

ALL LEGAL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT (INCLUDING ANY DISPUTE REGARDING THE INTERPRETATION OR PERFORMANCE OF THE AGREEMENT) (“Dispute”) WILL BE GOVERNED BY THE LAWS OF THE STATE OF NEW YORK, USA, EXCLUDING NEW YORK’S CONFLICTS OF LAWS RULES.

The parties will try in good faith to settle any Dispute within 30 days after the Dispute arises. If the Dispute is not resolved within 30 days, it shall be resolved by arbitration by the American Arbitration Association in accordance with its Expedited Commercial Rules in force as of the date of this Agreement (“Rules”). The parties will mutually select one arbitrator. The arbitration will be conducted in English in New York County, New York, USA.

Either party may apply to any competent court for injunctive relief necessary to protect its rights pending resolution of the arbitration. The arbitrator may order equitable or injunctive relief consistent with the remedies and limitations in the Agreement.

The arbitral award will be final and binding on the parties, and its execution may be presented in any competent court, including any court with jurisdiction over either party or any of its property. Each party will bear its own lawyers’ and experts’ fees and expenses, regardless of the arbitrator’s final decision regarding the Dispute.

Force Majeure

Neither party will be liable for failure or delay in performance to the extent caused by circumstances beyond its reasonable control, including acts of God, natural disasters, terrorism, riots, pandemics, epidemics, outbreaks, war, data provider interruptions, internet outages, API failures, government actions, or third-party service failures.

Waiver and Severability

If You do not comply with a portion of these Terms and We do not take action right away, this does not mean We are giving up any of Our rights under these Terms. If any part of these Terms is determined to be invalid or unenforceable by a court of competent jurisdiction or arbitrator, the remainder of the Terms shall be enforced to the maximum extent permitted by law.
