Terms of Service

This Agreement is entered into by WhatsGoodApps LLC (“WhatsGoodApps,” “We,” “Us,” or “Our”), the developer and provider of the Argument Wars – Fast Feud mobile application (the “App,” “Service,” or “Services”), and the person who accesses or uses the Services (“You” or “Your”). This Agreement governs Your access to and use of the Services.

This Agreement becomes effective when You are presented with it and create an account, access, or use the Services. If You do not agree to this Agreement, do not create an account or access or use the Services.

We may update this Agreement from time to time. Updated terms may be posted within the App, on Our website, or otherwise presented to You. To the extent permitted by applicable law, Your continued use of the Services after updated terms become effective constitutes Your acceptance of those updated terms.

Description of the Services
Argument Wars – Fast Feud is an entertainment and informal community-voting application that allows registered users to propose disputes or disagreements as cases, invite another registered user to participate, present opposing written statements, submit supporting pictures, identify what is at stake, select a voting period, allow eligible users to vote, and participate in public or link-accessible comments and replies.

A user who starts a case may identify money, an apology, a task, an item, bragging rights, or another lawful matter as being at stake and may select an available case duration, which may include one day, one week, or one month. The invited user must accept participation before the case becomes active. Each party may submit a written statement and up to two supporting pictures, subject to this Agreement and any limits shown in the App.

The App may display public cases in areas such as Home, Featured, Popular, or other feeds. The App may also permit a case to be designated private and accessed through a shareable link. The App may include voting, total-vote displays, hidden vote allocations during active cases, final voting results, comments, replies, notifications, search, sorting, ranking, moderation, and related features.

We may add, remove, rename, revise, restrict, or discontinue case formats, durations, feeds, visibility options, voting rules, comment features, purchase options, eligibility requirements, placement methods, and other App features at any time, subject to applicable law and app-store rules.

Age Requirements
By creating an account or accessing or using the Services, You represent and warrant that You are at least 18 years old and have reached the minimum age of digital consent in Your country. The Services are intended only for adults. You may not access or use the Services if You are under 18 years old.

If You are a parent or legal guardian and believe that a minor has accessed or used the Services, please contact Us so that We may take appropriate action.

Accounts, Usernames, and Account Security
An account is required to use the Services. The App may permit account creation or sign-in using an email address, Google, Sign in with Apple, or another method We make available. Your use of a third-party sign-in method may also be governed by the terms and privacy practices of the applicable third party.

You must provide accurate information, create and maintain only one account, select a username that complies with this Agreement, and keep Your login credentials secure. Usernames may be publicly displayed with cases, statements, votes, comments, replies, and other activity. You may not share, sell, transfer, or permit another person to use Your account, and You may not create or use an account for another person without authorization.

You are responsible for activity occurring through Your account to the extent permitted by law. You must promptly notify Us if You believe Your account has been accessed without authorization. We may require verification of account ownership before providing access, changing account information, or responding to an account-related request.

We may reject, change, reclaim, or require You to change a username that is misleading, unlawful, infringing, impersonating, offensive, confusingly similar to another user or brand, or otherwise inconsistent with this Agreement.

Account Deletion and Continuing Content
You may initiate deletion of Your account through the account-deletion method made available in the App. Account deletion terminates Your ability to access the account and may be irreversible. We may require reasonable verification before completing deletion.

Deleting Your account does not automatically delete or withdraw cases, case statements, supporting pictures, votes, comments, replies, voting results, or other content previously submitted through the account. Subject to applicable law and Our Privacy Policy, that content may remain available as part of the permanent case and discussion record, may continue to be shown in the visibility setting applicable to the case, and may be attributed to the prior username, a generic deleted-user label, or another de-identified designation selected by Us.

We may delete or de-identify account-registration information and other personal data as described in Our Privacy Policy and as required by applicable law or platform rules while retaining content and records that We are permitted or required to retain for service operation, safety, fraud prevention, legal compliance, dispute handling, recordkeeping, or protection of rights.

Deleting the App from Your device does not delete Your account, remove Your content, cancel a completed purchase, or initiate an account-deletion request.

Privacy
Please review Our Privacy Policy for information about how We collect, use, store, disclose, retain, and delete information in connection with the Services.

Limited License
Subject to Your compliance with this Agreement, WhatsGoodApps grants You a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the App on devices that You own or control, solely for Your personal, non-commercial entertainment use and subject to applicable app-store terms.

The App is licensed, not sold. Except for the limited license expressly granted above, no right, title, or interest in the App or Services is transferred to You.

App Content and Intellectual Property
The App, software, source code, object code, designs, interfaces, graphics, icons, sounds, text, branding, databases, compilations, algorithms, voting systems, feed-placement systems, Featured and Popular placement methods, moderation systems, purchase systems, and all other App content and materials other than User Content are owned by WhatsGoodApps or Our licensors and are protected by applicable intellectual-property and other laws.

You may not reproduce, republish, scrape, extract, download in bulk, distribute, sell, license, sublicense, publicly display, create derivative works from, reverse engineer, or commercially exploit any App content or technology except as expressly permitted by Us in writing or as applicable law expressly permits.

User Content
“User Content” means any content submitted, posted, uploaded, transmitted, displayed, or otherwise made available by a user through the Services, including usernames, case descriptions, allegations, statements, responses, supporting pictures, stated stakes, comments, replies, reports, feedback, and related information.

You retain any ownership rights You have in Your User Content. You represent and warrant that You own or have all rights, permissions, licenses, and consents necessary to submit Your User Content and to grant the license below, and that Your User Content and Our permitted use of it will not violate applicable law, this Agreement, or any third-party right.

You grant WhatsGoodApps and Our affiliates and service providers a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, cache, reproduce, transmit, format, resize, crop, create thumbnails from, display, distribute, moderate, review, and otherwise use Your User Content as reasonably necessary to operate, provide, secure, support, maintain, improve, and promote the Services within the App and App-related service surfaces. This license includes the right to continue displaying User Content after a case ends or Your account is deleted, subject to this Agreement, Our Privacy Policy, and applicable law.

We will not use identifiable case content in unrelated external advertising without additional permission, except where the content is de-identified, aggregated, already publicly shared by You outside the App, or otherwise lawfully usable without additional permission.

If You voluntarily provide suggestions, ideas, or feedback about the Services, You grant Us the right to use that feedback without restriction or compensation to You.

Public and Private Cases
When creating a case, the initiating user may select an available public or private visibility option. A public case may be discoverable, searchable, displayed in feeds, shared, and viewed by other users. A private case is generally accessible through a case-specific link and is not intended to appear in ordinary public discovery surfaces.

A private case is link-accessible, not confidential. Anyone who receives or obtains the link may be able to open the case, view its content, vote, comment, reply, purchase a Sneak Peek, and share the link with other people. We cannot control link forwarding, screenshots, recordings, copying, or further distribution by users. Do not submit information to a private case that You require to remain confidential or that You are not authorized to disclose.

Private cases are not eligible for Featured placement or a Popular-feed boost unless the App expressly permits the case to be made public before the purchase. Public and private cases may remain available indefinitely in their applicable visibility setting, subject to moderation, legal requirements, technical limitations, and changes to the Services.

Creating, Accepting, and Participating in Cases
A case may be initiated only against another registered user. A proposed case does not become an active case unless the invited user affirmatively accepts participation and completes any required response steps. An invited user may decline or ignore an invitation. The initiating user may withdraw a proposed case before acceptance. After acceptance and activation, neither party may unilaterally withdraw, cancel, edit, or delete the case, statements, or supporting pictures unless We expressly permit it or take action under this Agreement.

Acceptance means agreement to participate in the App’s case and voting process. Acceptance does not necessarily constitute an admission that the initiating user’s factual statements are true, an agreement that the stated stakes are legally enforceable, or a waiver of any right outside the App.

Each party is solely responsible for its own written statement and may submit up to two supporting pictures, subject to any technical limits shown in the App. Once the case becomes active, the parties may not edit or replace their statements or pictures. We do not guarantee that both sides will be equally persuasive, equally detailed, or supported by comparable evidence.

You may not create a case against, about, or primarily involving a person who has not accepted the invitation as the opposing party. Incidental references to other people must not accuse them of misconduct, disclose their private information, expose them to harassment, or otherwise violate their rights. You may not upload a picture that identifies another person unless You have the right and any legally required consent to do so.

Permanent Availability and No User-Initiated Deletion
Cases, statements, supporting pictures, comments, replies, votes, and final results are intended to form a continuing record. Users cannot ordinarily edit or delete that content after submission. Completed public cases may remain publicly available indefinitely, and completed private cases may remain available indefinitely to people with the link.

You should not submit content that You may later regret, that has become embarrassing or outdated, or that You expect to be removed at Your request. We may remove, restrict, correct, de-identify, or preserve content in Our discretion as permitted by this Agreement, but We do not promise to remove content merely because a user later changes their mind.

Entertainment and Informal Community Voting Only
ARGUMENT WARS – FAST FEUD IS PROVIDED FOR ENTERTAINMENT AND INFORMAL, VOLUNTARY COMMUNITY VOTING ONLY. THE APP IS NOT A COURT, TRIBUNAL, ARBITRATION SERVICE, MEDIATION SERVICE, LAW FIRM, COLLECTION AGENCY, ESCROW SERVICE, OR GOVERNMENTAL AUTHORITY, AND WHATSGOODAPPS DOES NOT PROVIDE LEGAL ADVICE OR LEGAL REPRESENTATION.

Cases, statements, pictures, comments, votes, results, and any use of words such as “case,” “verdict,” “winner,” or “right” are informal App features and are not legal proceedings, arbitration awards, court judgments, official findings, or legally binding determinations. The Services do not determine any person’s legal rights, duties, liability, guilt, innocence, ownership, entitlement, or obligations.

The App itself does not create, adjudicate, guarantee, or enforce an agreement to pay money, transfer property, provide services, apologize, perform a task, or satisfy any other stated stake. Any separate agreement or obligation between users exists solely between those users and may have consequences independent of the App. Users should obtain their own legal or professional advice regarding any real-world rights or obligations.

No Verification, Investigation, or Endorsement
WhatsGoodApps does not investigate cases, verify identities beyond the account processes We make available, authenticate pictures, determine whether statements are complete or truthful, evaluate the legality of alleged conduct, or endorse either party. User Content may be inaccurate, incomplete, misleading, fabricated, manipulated, offensive, biased, or disputed.

A voting result reflects only the votes accepted through the App under the applicable rules. It does not establish objective truth, prove that an allegation is accurate, or show that voters were informed, impartial, independent, representative, or qualified to evaluate the matter.

Voting Rules and Results
An eligible account may cast one vote per case. A submitted vote is final and cannot be changed, transferred, withdrawn, or recast. Users may vote in as many different cases as the App permits. The parties to a case are permitted to vote in their own case.

While a case is active, the App may display the total number of accepted votes without publicly displaying how many votes have been cast for each side. Except through an available Sneak Peek, the vote allocation is revealed when the case ends. Individual voting choices are not publicly identified, although We may retain voting records for service operation, security, fraud prevention, moderation, and legal compliance.

Voting closes according to the App’s systems and server time. Network delays, processing delays, clock differences, outages, fraud checks, and other technical or operational conditions may affect whether or when a vote is accepted. If the final accepted vote count is tied, the App may display a tie and no party will be treated as the voting winner.

We may reject, invalidate, remove, or recalculate votes reasonably believed to result from bots, scripts, automation, duplicate or coordinated accounts, vote buying, fraud, manipulation, technical errors, security incidents, prohibited conduct, or other violations. Vote totals and results may therefore change, including after an earlier display or Sneak Peek snapshot.

Comments and Replies
Users with access to a case may be able to post comments and replies. Comments and replies are User Content, may be visible to other users with access to the case, and are subject to the same ownership, license, permanence, conduct, moderation, and liability provisions that apply to other User Content.

Users cannot ordinarily edit or delete comments or replies after submission. We may remove or restrict comments or replies, lock or close a discussion, limit participation, or disable comments for a case or account when We believe it is appropriate for safety, compliance, security, moderation, or operation of the Services.

Sneak Peek In-App Purchase
The App may offer a consumable in-app purchase called “Sneak Peek.” A Sneak Peek reveals a snapshot of the vote allocation between the two sides of a selected ongoing case at the time the snapshot is generated. It does not provide continuous access to updated vote allocations, and the allocation may change immediately after the snapshot as additional votes are cast, removed, invalidated, or processed.

Any eligible user with access to a case may purchase a Sneak Peek, including a user who is not a party to the case. A user may purchase additional Sneak Peeks for the same ongoing case to obtain later snapshots. Each purchase applies only to the selected case and snapshot and does not provide an additional vote, influence the result, grant control over the case, or guarantee any outcome.

A Sneak Peek has no cash value, is not transferable, and cannot be applied to another case. If the case ends, is removed, becomes unavailable, or changes before the snapshot is delivered, the purchase may be unavailable or may provide only the information technically available at that time, subject to applicable law and platform policies.

Feature a Case In-App Purchase
The App may offer a consumable in-app purchase called “Feature a Case” for an eligible public case. A Featured purchase is scheduled to provide the selected case with placement in the App’s Featured area for 24 hours, a Featured badge, and a boost toward the top of the Popular area or another promotional placement determined by Us.

Any eligible user may purchase Featured placement for an eligible public case, including a user who is not a party to the case. The parties do not have a right to prevent another eligible user from featuring a public case. Purchasing Featured placement does not transfer ownership or control of the case, permit editing, imply endorsement by WhatsGoodApps, provide votes, or influence the voting result.

A Featured purchase does not guarantee any particular feed position, ranking, number of views, number of votes, comments, engagement, or outcome. Popular placement may depend on time, engagement, relevance, moderation, technical factors, and methods selected by Us.

A case may be featured even if less than 24 hours remain in its voting period. Featured placement ends when the purchased 24-hour period ends, when the case ends, or when the case is removed, suspended, made ineligible, or becomes unavailable, whichever occurs first. Any unused time is forfeited. A case may be featured again only after the then-current Featured period has ended, provided the case remains active, public, and eligible.

In-App Purchases
The App is free to use and does not offer a subscription. The App may offer consumable in-app purchases, including Sneak Peek and Feature a Case. These purchases may be made multiple times as permitted by the App.

Current prices, taxes, currencies, purchase descriptions, and availability are presented through the applicable app store at the time of purchase and may vary by country, platform, currency, tax, or future pricing changes. Prices stated in advertisements or other materials may change and do not override the price displayed by the applicable app store when You confirm a purchase.

Purchases are currently offered through Apple in-app purchase. We may add distribution through Google Play in the future. Purchases, billing, payment authorization, transaction records, cancellations, chargebacks, and refunds are processed and governed by the terms and policies of the platform through which the purchase was made.

Consumable purchases may not be restorable or transferable in the same manner as permanent entitlements. Unless applicable law or the applicable platform requires otherwise, purchases have no cash value, are not redeemable for money, cannot be resold or transferred, and are nonrefundable. Refund requests must ordinarily be directed to the platform that processed the transaction.

We may reverse, suspend, or remove a purchased benefit if the transaction is cancelled, reversed, refunded, charged back, fraudulent, unauthorized, or otherwise invalid, or if the selected case or account violates this Agreement. A purchase does not exempt any case, content, or account from moderation or enforcement.

Stakes; No Escrow, Collection, Gambling, or Enforcement
The initiating user may identify money or another lawful item, promise, action, or consequence as being at stake. The amount or description is supplied by the user, is not an in-App balance, has no cash value within the Services, and is not held, transferred, processed, collected, insured, or guaranteed by WhatsGoodApps.

The App does not provide escrow, payment processing between parties, debt collection, prize distribution, enforcement, or collection services. In-app purchases are payments to WhatsGoodApps for App functionality and are not payments toward a case’s stated stakes.

Users may not use the Services for illegal gambling, unlawful wagering, unlicensed contests, extortion, blackmail, coercion, unlawful debt collection, illegal goods or services, or any transaction prohibited by law. WhatsGoodApps is not responsible for whether any user voluntarily performs or refuses to perform a stated stake.

Prohibited Content and Conduct
You may not use the Services to create, submit, display, share, encourage, facilitate, or engage in:

Any violation of applicable law, regulation, court order, contractual duty, or third-party right;
Knowingly false, fabricated, materially misleading, or defamatory factual allegations;
Harassment, bullying, intimidation, stalking, humiliation, threats, incitement, or coordinated attacks;
Doxxing or disclosure of private or sensitive information, including home addresses, personal phone numbers, private email addresses, financial information, account credentials, government identifiers, medical information, or confidential records;
Hate speech, discriminatory abuse, or content attacking a person or group based on a protected characteristic;
Pornography, sexually explicit content, sexual solicitation, nonconsensual intimate imagery, or sexual exploitation;
Any content that sexualizes, exploits, endangers, identifies inappropriately, or depicts abuse of a minor;
Graphic violence, credible threats of violence, promotion of self-harm, or encouragement of harm to another person;
Extortion, blackmail, coercion, unlawful debt collection, fraud, impersonation, or deceptive conduct;
Copyright, trademark, privacy, publicity, confidentiality, or other rights infringement;
Pictures or recordings obtained, created, edited, or shared unlawfully or without required permission;
Fabricated, altered, misleadingly cropped, AI-generated, or manipulated evidence presented as authentic without clear disclosure;
Cases designed primarily to shame, objectify, ridicule, mobilize harassment against, or expose a real person to danger;
Encouraging users to contact, confront, threaten, punish, review-bomb, or harass a party outside the App;
Spam, unauthorized advertising, solicitation, referral schemes, or repetitive promotional content;
Vote buying, vote trading, coordinated brigading, collusion, coercion of voters, or offering anything of value for a vote;
Using multiple accounts, another person’s account, bots, scripts, macros, automation, emulators, or modified software to vote, comment, purchase, create activity, or manipulate placement;
Attempting to discover another user’s voting choice through unauthorized means;
Manipulating or attempting to manipulate votes, total counts, results, Popular placement, Featured placement, account status, purchases, or eligibility;
Exploiting bugs, vulnerabilities, unintended behavior, or technical limitations;
Reverse engineering, decompiling, disassembling, decoding, or attempting to discover source code, algorithms, voting logic, placement methods, moderation systems, or underlying technology, except where applicable law expressly permits it;
Scraping, harvesting, extracting, copying, republishing, compiling, or commercially exploiting cases, pictures, comments, user information, vote data, or App content;
Introducing malware, harmful code, or material intended to disrupt or damage a device, server, system, network, or the Services;
Interfering with, overloading, disrupting, damaging, or gaining unauthorized access to the Services or connected systems;
Evading a restriction, suspension, termination, moderation decision, purchase rule, visibility control, or security measure; or
Attempting, encouraging, assisting, or enabling another person to do any of the foregoing.
Content Moderation and Enforcement
We may, but are not obligated to, use automated systems, technical filters, human review, user complaints, or other methods to review, screen, restrict, label, de-rank, reject, preserve, or remove User Content or activity. No moderation method is perfect, and We do not guarantee that prohibited content will be detected, prevented, or removed immediately or at all.

We may refuse to activate a proposed case; remove or restrict a case, statement, picture, comment, or reply; close or lock a case or discussion; remove Featured or Popular placement; invalidate votes; limit account functions; preserve evidence; or warn, restrict, suspend, or terminate an account when We reasonably believe action is appropriate for safety, legal compliance, rights protection, fraud prevention, security, service integrity, operational reasons, or enforcement of this Agreement.

Moderation decisions may be based on context, severity, risk, repeated behavior, available information, legal requests, and Our judgment. We are not required to provide advance notice, a detailed explanation, an appeal, compensation, or restoration unless applicable law requires it.

Concerns about a case, picture, comment, reply, account, or other content may be sent to support@whatsgoodapps.com. Include enough information for Us to identify the content and understand the concern. Misuse of the complaint process, including knowingly false or abusive reports, may result in enforcement action.

Copyright and Rights Complaints
If You believe content in the Services infringes Your copyright or another legal right, You may send a notice to support@whatsgoodapps.com with a clear identification of the protected work or right, identification and location of the challenged content, Your contact information, a description of Your authority or ownership, a good-faith statement explaining the claimed violation, and any other information reasonably necessary to evaluate the request.

We may remove or restrict challenged content, request additional information, notify the user who submitted it, restore content where appropriate, or take other action. Knowingly submitting a materially false infringement notice may expose the sender to liability.

User Interactions and Real-World Conduct
You are solely responsible for Your interactions, communications, agreements, disputes, and conduct involving other users. WhatsGoodApps is not a party to user disputes or arrangements and is not responsible for payments, promises, property transfers, apologies, services, retaliation, harassment, offline meetings, or other real-world conduct.

Use appropriate caution when communicating with people You know only through the App. Do not use the Services to arrange an unsafe confrontation or disclose information that could expose You or another person to harm. We do not conduct criminal-background checks or guarantee any user’s identity, intentions, or conduct.

Third-Party Services and Platforms
The Services may rely on third parties, including Apple, Google, future app-distribution platforms, authentication providers, hosting providers, storage providers, analytics providers, notification providers, moderation providers, and other technical service providers. Third-party services may be unavailable, interrupted, changed, discontinued, or governed by separate terms and privacy policies.

Your use of the App must comply with applicable third-party terms, including the terms of the platform from which You obtained the App or made a purchase. WhatsGoodApps is not responsible for third-party services, systems, content, acts, omissions, availability, security, or policies.

This Agreement is between You and WhatsGoodApps, not Apple. To the extent applicable, Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce this Agreement against You. WhatsGoodApps, not Apple, is responsible for the App, its maintenance and support, and claims relating to the App, subject to this Agreement and applicable law.

Service Availability, Updates, and Changes
We do not guarantee that the Services, accounts, cases, links, voting, comments, purchases, Featured placement, Popular placement, notifications, content, or any feature will be uninterrupted, error-free, secure, accurate, compatible with every device or operating-system version, or available at all times.

Maintenance, technical problems, provider outages, network conditions, moderation, legal requests, security events, updates, device limitations, and circumstances outside Our control may affect availability, timing, placement, vote processing, content display, and performance.

We may update, modify, correct, improve, suspend, restrict, or discontinue any part of the Services. Updates may be required for continued use. We do not guarantee support for older App or operating-system versions.

Suspension and Termination
We may restrict, suspend, or terminate Your account or access to all or part of the Services if We reasonably believe that You have violated this Agreement, engaged in prohibited content or conduct, manipulated votes or purchases, used multiple accounts or automation, created a legal, safety, security, reputational, or operational risk, infringed another person’s rights, or used the Services unlawfully.

Suspension or termination may prevent access to Your account and may result in loss of access to pending invitations, active cases, private links, purchases, and other features. Your existing User Content may remain available as described in this Agreement.

You may stop using the Services at any time. Sections that by their nature should survive termination will survive, including provisions concerning User Content licenses, permanent content, intellectual property, purchases, disclaimers, limitations of liability, indemnification, dispute resolution, and accrued rights and obligations.

Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND SYSTEM INTEGRATION.

We do not warrant that accounts, identities, cases, statements, pictures, comments, replies, links, vote totals, voting results, Sneak Peek snapshots, Featured placement, Popular placement, notifications, purchases, moderation, or other content or features will be accurate, complete, current, authentic, reliable, fair, representative, uninterrupted, error-free, secure, or suitable for Your intended purpose.

We do not warrant that User Content is true, lawful, noninfringing, or harmless; that a private link will remain private; that a case will receive any minimum number of votes; that a result will be accepted or honored by a party; that stated stakes will be performed; or that moderation will identify or prevent all violations. You assume the risks arising from Your use of the Services and interactions with users.

Limitation of Liability
To the fullest extent permitted by law, WhatsGoodApps and its affiliates, shareholders, officers, directors, employees, contractors, agents, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, use, opportunity, data, content, reputation, privacy, purchases, or other intangible losses, arising out of or relating to:

Your access to, use of, inability to use, or reliance on the Services;
Any User Content, allegation, statement, picture, comment, reply, vote, result, or conduct of another user;
Defamation, privacy invasion, harassment, intellectual-property infringement, false statements, threats, or other wrongful conduct by a user;
Any agreement, payment, promise, item, service, apology, task, or other stated stake between users;
Any decision, action, confrontation, reliance, or real-world consequence based on a case or voting result;
Any inaccurate, delayed, rejected, invalidated, manipulated, or recalculated vote, total, result, or Sneak Peek snapshot;
Any failure to receive a desired number of views, votes, comments, engagement, feed position, or outcome from Featured or Popular placement;
Any case removal, moderation action, account restriction, suspension, termination, content retention, de-identification, or refusal to remove content;
Any sharing, forwarding, copying, screenshotting, recording, or disclosure of a public or private case or link;
Any interruption, outage, delay, provider failure, software error, device problem, security incident, unauthorized access, or data loss;
Any in-app purchase, transaction failure, refund decision, chargeback, lost consumable benefit, or platform action; or
Your use of or interaction with any third-party service or platform.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF WHATSGOODAPPS AND ITS AFFILIATES, SHAREHOLDERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THIS AGREEMENT WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU PAID FOR THE SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of certain damages. In those jurisdictions, the exclusions and limitations above apply only to the maximum extent permitted by law.

Indemnification
To the extent permitted by law, You agree to indemnify, defend, and hold harmless WhatsGoodApps and its affiliates, shareholders, officers, directors, employees, contractors, agents, licensors, service providers, and representatives from and against claims, demands, investigations, damages, judgments, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

Your access to, use of, or misuse of the Services;
Your account, username, cases, statements, allegations, pictures, stated stakes, comments, replies, votes, reports, or other User Content;
Your interactions, agreements, disputes, or conduct involving another person;
Your violation of this Agreement, applicable law, or a platform rule;
Your infringement or violation of any third-party intellectual-property, privacy, publicity, confidentiality, contractual, or other right;
Your fraud, impersonation, harassment, manipulation, automation, multiple-account use, or other unauthorized activity; or
Any claim that Your User Content is false, defamatory, unlawful, harmful, infringing, or submitted without required authorization or consent.
Dispute Resolution and Governing Law
ALL LEGAL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICES, INCLUDING ANY DISPUTE REGARDING THE INTERPRETATION, VALIDITY, ENFORCEABILITY, OR PERFORMANCE OF THIS AGREEMENT (A “DISPUTE”), WILL BE GOVERNED BY THE LAWS OF THE STATE OF NEW YORK, USA, EXCLUDING NEW YORK’S CONFLICT-OF-LAWS RULES, EXCEPT TO THE EXTENT THAT APPLICABLE LAW REQUIRES OTHERWISE.

The parties will first attempt in good faith to resolve a Dispute informally for thirty (30) days after written notice of the Dispute is provided. If the Dispute is not resolved within that period, it will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under the AAA Consumer Arbitration Rules and Mediation Procedures in effect when the arbitration is filed, together with any applicable Consumer Due Process Protocol or supplementary rules.

The parties will mutually select one arbitrator. If they do not agree, the arbitrator will be appointed in accordance with the applicable AAA rules. The arbitration will be conducted in English in New York County, New York, USA, unless the applicable AAA rules, the arbitrator, or applicable law requires or permits a different location, remote proceeding, documents-only proceeding, or other procedure.

Either party may apply to a court of competent jurisdiction for temporary or preliminary injunctive relief necessary to protect its rights pending completion of arbitration. The arbitrator may award any relief available under applicable law that is consistent with the limitations in this Agreement.

The arbitration award will be final and binding and may be entered and enforced in any court of competent jurisdiction. Arbitration fees and costs will be allocated in accordance with the applicable AAA rules and applicable law. Each party will otherwise bear its own attorneys’ and experts’ fees unless the arbitrator or applicable law provides otherwise.

Force Majeure
Neither party will be liable for failure or delay in performance to the extent caused by circumstances beyond its reasonable control, including natural disasters, acts of God, war, terrorism, civil unrest, labor disputes, epidemics, pandemics, government actions, internet or telecommunications failures, power failures, app-store outages, third-party provider failures, or cyberattacks.

Waiver and Severability
If We do not enforce a provision of this Agreement immediately, that does not waive Our right to enforce it later. If any provision is held invalid, illegal, or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

Assignment
You may not assign or transfer this Agreement or any rights under it without Our prior written consent. We may assign this Agreement in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law.

Entire Agreement
This Agreement, together with the Privacy Policy and any purchase terms presented through the applicable app store, constitutes the entire agreement between You and WhatsGoodApps concerning the Services and supersedes prior or contemporaneous communications concerning the same subject matter.
