For purposes of these Terms of Service (the “Terms”), “we,” “us,” and “our” refer to WhatsGoodApps, LLC. We operate the odnoklassniki ai mobile application (the “App”) and any related products, features, websites, support channels, or communities that we may make available. The App and all related products and services are collectively referred to as the “Services.”
These Terms constitute a binding agreement between you and WhatsGoodApps, LLC. “You,” “User,” and “Users” refer to each person who accesses or uses the Services. Please review these Terms and our Privacy Policy before using the Services. By downloading, accessing, purchasing through, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
“Content” includes any text, prompts, companion names, companion descriptions, appearances, personalities, backstories, relationship settings, bond information, scenarios, chat messages, photographs, images, feedback, or other information or material that you submit to, create through, receive from, save in, or otherwise use with the Services. Content includes both User-provided material and AI-generated or AI-assisted output.
Consent
By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you use the Services on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.
Age Requirement
The Services may be used only by individuals who are at least eighteen (18) years old or the age of majority in the jurisdiction where they reside or access the Services, whichever is greater. The Services are not directed to children or minors.
The Services may include mature, romantic, flirtatious, suggestive, fictional relationship, or AI-companion content. The Services are intended to avoid nudity, sexually explicit material, exploitative content, sexualized minors, illegal sexual content, and non-consensual sexual content. You may not use or attempt to use the Services to request, create, obtain, save, or distribute such content.
By using the Services, you represent and warrant that you meet the age requirement, possess the legal capacity to enter into these Terms, and will not permit a person who does not meet the age requirement to use the Services through your device or access.
AI Nature of the Services
The Services use artificial intelligence to simulate conversations, personalities, relationships, and other interactions with fictional AI girlfriends and AI boyfriends. All companions are fictional. They are not real people and do not possess consciousness, emotions, desires, intent, affection, memory, loyalty, independent judgment, or awareness.
The App may include premade or custom companions, different companion personalities or backgrounds, and related labels, categories, and features. They are provided for entertainment and organizational purposes and may be changed, combined, renamed, limited, or discontinued at any time.
Companion Selection and Custom Companion Creation
The Services allow you to select premade fictional Russian AI girlfriends and boyfriends and may allow you to create custom fictional AI girlfriends and boyfriends. Depending on the feature and plan, you may be able to choose or describe a companion’s name, gender, appearance, personality, backstory, relationship dynamic, interests, quirks, conversation style, or other characteristics.
You are solely responsible for the companion information, photographs, and prompts you submit and for ensuring they comply with these Terms and applicable law. You may not create a companion who is or appears to be a minor, is based on a real person without appropriate authorization, or infringes another person’s intellectual property, privacy, publicity, or other rights.
We do not guarantee that a companion will consistently follow selected traits, remember prior details, maintain the same personality, produce a particular type of response, or behave as you expect. Companion behavior may vary because of system design, context limits, moderation, model changes, technical limitations, and User input.
English and Russian Conversations
The Services are designed to support conversations in English and Russian. A companion is generally intended to respond in English to a message written in English and in Russian to a message written in Russian. You may switch between the supported languages during a conversation.
We do not guarantee that the Services will always identify the language of a message correctly, respond entirely in the same language, translate or interpret language accurately, or use grammatically correct, idiomatic, culturally appropriate, or contextually accurate language. Mixed-language messages, slang, transliteration, spelling, short messages, and technical limitations may affect the language or quality of a response.
Russian Language and Cultural Characteristics
Companions may use Russian names, language, expressions, cultural references, backgrounds, locations, or fictional life experiences. These elements are provided for entertainment and may be AI-generated, simplified, fictionalized, inaccurate, incomplete, stereotyped, or inconsistent. Companions are fictional and are not authoritative representations of Russian people, culture, nationality, ethnicity, political views, social norms, or individual experiences.
You may not use cultural, national, ethnic, racial, religious, or language-related features to demean, harass, exploit, stereotype, or promote hatred toward any person or group. We may remove or refuse companions or outputs that create safety, legal, reputational, or platform-compliance concerns.
Bond and Relationship Progression
The App may assign or display a simulated bond, relationship level, affinity level, progression level, or similar indicator for each companion. The more you chat with a particular companion, the companion’s bond may deepen or progress. Bond progression is tracked separately for each companion and may be based on message activity, conversation history, frequency of interaction, or other App-defined criteria.
Bond and relationship progression are fictional entertainment mechanics. They do not reflect actual emotions, attachment, affection, consciousness, consent, commitment, or a real relationship. A companion’s bond level is designed not to decrease or reset through ordinary use. It may, however, be permanently deleted or lost if you delete the applicable companion or chat, delete or reinstall the App, clear App data, lose or reset your device, experience data corruption or software failure, or otherwise lose locally stored data.
We do not guarantee that any particular message or interaction will increase a bond level, that progression will occur at a particular rate, or that any bond level will produce a particular conversation, behavior, personality change, interaction, emotional experience, or feature.
No Professional, Medical, Mental Health, or Relationship Advice
The Services are provided for entertainment only. They are not a substitute for medical, psychological, psychiatric, legal, financial, relationship, crisis, or other professional advice or services. You agree not to rely on a companion or AI-generated output for diagnosis, treatment, emotional support, real-life decision-making, relationship guidance, safety planning, or any other important personal decision.
If you are experiencing distress, believe you may harm yourself or someone else, or need professional assistance, seek help from a qualified professional or appropriate emergency service rather than relying on the Services.
AI Output Disclaimer
AI-generated responses and other outputs may be inaccurate, misleading, inappropriate, incomplete, inconsistent, repetitive, offensive, unexpected, or factually incorrect. Companions may contradict themselves, forget prior information, invent information, fail to follow a prompt, or respond in ways that do not reflect selected traits.
We do not guarantee the accuracy, reliability, suitability, quality, consistency, safety, legality, or appropriateness of any AI-generated output. You are responsible for reviewing and deciding whether to use or rely on any output. All use of AI-generated Content is at your own risk.
Simulated Relationship Disclaimer
Any romantic, emotional, supportive, intimate, antagonistic, or other relationship experienced through the Services is simulated and fictional. Personalized messages, bond levels, relationship status, and progression indicators do not constitute genuine affection, companionship, loyalty, approval, consent, commitment, or a real-world relationship.
A companion may appear attentive, affectionate, jealous, caring, flirtatious, protective, emotionally invested, or otherwise responsive because of automated generation. Such behavior does not reflect actual feelings or intentions. The Services are not a replacement for human relationships, professional counseling, or real-world support.
Private Use and No User-to-User Features
The App is designed as a private experience between you and fictional AI companions. The App does not require a User account and is not intended to provide public profiles, public companion pages, public posts, direct messaging between Users, or User-to-User social features.
Your locally saved conversations, uploaded photographs, and custom companions are not published to other Users through the App. However, messages, prompts, photographs, and other information are transmitted to third-party AI or technology providers as necessary to generate responses, analyze photographs, moderate requests, process purchases, maintain the Services, or provide other functionality, as described in our Privacy Policy.
Free Access
The App provides ten (10) free User chat messages in total. These free messages are a lifetime allowance and may be used across premade and custom companions, subject to feature availability and these Terms. Each free User message is intended to produce one AI-generated chat reply. The corresponding AI-generated reply does not consume a second free message.
A free User may create one (1) custom AI companion, which may be an AI girlfriend or AI boyfriend. This is a lifetime creation allowance, not a limit on the number of custom companions simultaneously stored. The allowance is consumed when the custom companion is created and does not renew or reset if that companion is later deleted, unavailable, corrupted, or lost. A free User may continue to use available premade companions, subject to the free message limit and other applicable restrictions.
The free allowances do not renew or reset periodically. Deleting or reinstalling the App, clearing App data, changing device settings, or taking other steps to obtain additional free messages or another free custom companion is not permitted. Technical limitations may affect how a lifetime allowance is recognized or restored, and we do not guarantee that an unused allowance or a created companion will transfer to another device or remain available after App deletion, device loss, device reset, or data loss.
Paid Access Plans and Message Limits
The Services offer Monthly and Yearly auto-renewable subscriptions. The purchase screen in the App controls the current price, billing period, and included benefits, subject to the definitions and limitations in these Terms. Prices may vary by country, currency, taxes, App Store pricing, and promotional availability.
Plan Current Core Access
Free Ten (10) lifetime User messages and one (1) lifetime custom-companion creation.
Monthly A monthly auto-renewable subscription providing up to 500 User messages during each weekly usage period and unlimited custom companion creation, as “unlimited” is defined below.
Yearly An annual auto-renewable subscription providing up to 2,000 User messages during each weekly usage period, unlimited custom companion creation, as “unlimited” is defined below, and the ability to upload photographs in supported AI chats.
Unless the App expressly states otherwise, a “message” for purposes of a usage limit means a chat message or generation request submitted by you. Corresponding AI replies are not separately deducted as additional User messages. The usage meter and entitlement information displayed in the App are controlling if there is a discrepancy regarding messages used or remaining.
Weekly message allowances are use-it-or-lose-it. They reset at the beginning of each applicable weekly usage period as determined by the App or Apple purchase entitlement. Unused messages expire at the end of the period and do not accumulate, carry forward, roll over, convert into credits, or increase any later allowance. Message limits apply across all premade and custom companions combined and are not a separate allowance for each companion. The Monthly subscription is billed monthly and the Yearly subscription is billed annually even though their message allowances are measured and reset weekly.
For purposes of the purchase screen, marketing, and these Terms, “unlimited custom companions,” “unlimited characters,” “unlimited custom companion creation,” and similar language mean that the applicable paid plan does not impose a fixed numerical cap on ordinary personal custom-companion creation. “Unlimited” does not mean unrestricted, infinite, guaranteed, or exempt from these Terms. Reasonable technical, storage, safety, moderation, rate, concurrency, anti-fraud, anti-abuse, and practical limits may apply. We may restrict automated, excessive, abusive, fraudulent, unsafe, or technically disruptive creation or use.
Subscriptions and Automatic Renewal
Monthly and Yearly are auto-renewable subscriptions unless the App purchase screen expressly states otherwise. A subscription automatically renews at the disclosed price and billing period unless cancelled before the end of the then-current subscription period, subject to Apple’s rules and your App Store settings.
Subscription purchase, billing, renewal, cancellation, refunds, taxes, and payment processing are handled through Apple and the App Store. You are responsible for reviewing the purchase screen, billing period, renewal price, trial or introductory terms, and cancellation instructions before purchasing. Deleting the App does not cancel a subscription. You must manage or cancel the subscription through the applicable Apple account or App Store subscription settings.
If a free trial, discounted introductory offer, promotional price, or other offer is provided, the subscription may automatically convert to a paid subscription at the disclosed price unless cancelled before the offer ends. We do not control Apple’s billing systems and cannot guarantee a refund, reversal, cancellation, or billing adjustment except as required by applicable law or Apple’s rules.
Subscription features and entitlements apply only while the subscription is active and in good standing. If a subscription expires, is cancelled, is refunded, is revoked, or cannot be verified, paid access may end or be reduced. Locally stored chats, uploaded photographs, custom companions, and bond information may remain on your device, but continued access to them or to paid functionality is not guaranteed.
Photo Uploads
Yearly subscribers may upload photographs in supported AI chats. An uploaded photograph is added to and remains in the applicable chat on the device unless you delete the photograph, chat, or related local data, or the data is otherwise lost. The photograph is transmitted through OpenRouter and analyzed by an AI model so the companion can respond to or discuss it. Uploaded photographs are User Content and are subject to these Terms and our Privacy Policy.
You represent and warrant that you own each uploaded photograph or have all rights, permissions, and consents necessary to submit and process it. You may not upload illegal material, child sexual abuse material, sexualized images of minors, non-consensual intimate images, deceptive or abusive images, photographs that infringe privacy or publicity rights, or material you do not have authority to provide.
Photo analysis may be inaccurate, incomplete, inconsistent, inappropriate, or unexpected. The AI may fail to identify or may incorrectly describe people, objects, locations, text, activities, or other details. Do not rely on photo analysis for identity verification, medical, legal, safety, financial, emergency, or other important determinations. We do not guarantee that every photograph will be accepted, analyzed, retained, or produce a response.
Paid Digital Services, Delivery, and Refunds
Subscriptions and paid features are digital services. They have no cash value, are non-transferable, may not be resold, and are provided for personal, non-commercial use within the Services unless we expressly agree otherwise in writing.
Delivery and generation may fail, be delayed, time out, be filtered, or become unavailable because of moderation, technical problems, third-party provider limitations, payment issues, device conditions, network conditions, or other factors. We may provide a retry, replacement, credit, or other remedy in our discretion, but are not required to do so unless required by applicable law or Apple’s rules.
All purchases are subject to Apple’s payment, cancellation, and refund rules. Except where required by applicable law or Apple’s rules, digital purchases are final and non-refundable once requested, activated, consumed, delivered, or otherwise made available.
Generation Availability, Moderation, and Refusal Rights
AI features may depend on automated systems, moderation tools, OpenRouter, third-party AI models, device functionality, network availability, Apple services, payment status, and other factors outside our control. We do not guarantee that a requested response, companion, bond progression event, photograph analysis, or other output will be generated, delivered, saved, or remain available.
We may refuse, block, filter, modify, remove, regenerate, substitute, or decline any prompt, request, output, companion, photograph, interaction, or other Content that we believe may violate these Terms, applicable law, Apple’s rules, a third-party provider’s policies, safety standards, or our business or operational requirements.
We may restrict or terminate access if we believe a User is attempting to bypass moderation, generate prohibited content, automate usage, exploit free or paid limits, circumvent weekly message allowances or custom-companion limits, interfere with the Services, or create risk for us, Apple, a provider, another person, or the public.
No Unauthorized Third-Party Characters or Intellectual Property
You may not use the Services to request, create, upload, generate, distribute, or attempt to generate any companion, name, photograph, image, likeness, outfit, visual design, personality, backstory, dialogue, or other Content that copies, imitates, recreates, or is confusingly similar to a protected third-party character, game, film, television program, comic, book, franchise, studio, publisher, brand, trademark, copyrighted work, or other intellectual property without authorization.
General genres, archetypes, themes, and original companions are permitted, but you are responsible for ensuring that your prompts, companions, photographs, and uses of outputs do not infringe third-party rights. We may block or remove Content that appears to infringe or create a material risk of infringement, even when described as parody, tribute, fan art, homage, or style imitation.
No Real Person Impersonation or Deepfake Use
You may not use the Services to create or attempt to create a companion, description, statement, photograph, likeness, or other Content that depicts, imitates, impersonates, recreates, sexualizes, falsely portrays, or is intended to resemble a real person, celebrity, public figure, influencer, private individual, or identifiable likeness without appropriate authorization. You may not upload another person’s photograph for any such purpose without appropriate authorization.
You may not create deceptive deepfakes, non-consensual synthetic media, false endorsements, fake statements, or Content intended to make others believe that a real person said, did, appeared in, approved, or endorsed something that person did not.
Romantic and Suggestive Content Limitations
The Services may permit romantic, flirtatious, or suggestive fictional conversations. You may not request, generate, encourage, save, or distribute nudity, pornographic or sexually explicit content, sexual violence, bestiality, incestuous sexual content, exploitative sexual content, non-consensual sexual content, or illegal sexual content.
You may not sexualize any companion who is, appears to be, is described as, or is presented as under eighteen (18), a minor, a child, a student presented as a minor, age-ambiguous and childlike, “loli,” “shota,” or otherwise underage. This prohibition applies regardless of whether the companion is fictional, illustrated, generated, or described as being older despite appearing underage.
Third-Party AI Providers and Technology
Chat messages, prompts, uploaded photographs, and related Content are transmitted through OpenRouter for processing by available third-party AI models and related services. Some features may also rely on third-party hosting providers, moderation systems, analytics tools, Apple services, or other external technology. The availability, speed, quality, functionality, and cost of features may depend on these providers.
We are not responsible for outages, restrictions, content filters, model changes, policy changes, provider pricing, processing limitations, output variations, failed generations, or other issues caused by or related to third-party providers. We may add, replace, remove, or limit a provider, model, companion engine, or related technology at any time.
Pricing, Feature Changes, and Usage Limits
We may change prices, plans, purchase options, message limits, reset periods, custom-companion functionality, photo-upload access, language features, bond progression, premade companion availability, generation options, and other features at any time. Changes to an existing auto-renewable subscription are subject to applicable law and Apple’s rules.
We may impose or modify reasonable limits on messages, generations, retries, companion creation, saves, photo uploads, simultaneous requests, or other usage. We may restrict unusually high, automated, abusive, fraudulent, unsafe, or technically disruptive use even if a plan is described as providing a high or unlimited allowance for a particular feature.
No Account and Device-Based Access
The App does not require a User account. Your conversations, custom companions, companion histories, uploaded photographs, bond and relationship progression, preferences, and related data are generally associated with the App installation and device rather than a cross-device account.
Because there is no account, the Services may not provide cloud sync, cross-device history, account-based backup, or account recovery. Subscription and purchase verification may rely on Apple, StoreKit, App Store receipts, or locally stored entitlement information.
Local Storage, Deletion, and Loss of Data
Conversations, created companions, companion settings, memories, uploaded photographs in chats, bond and relationship progression, saved outputs, preferences, and other App data may be stored locally on your device. You may be able to delete individual chats, individual companions, and all chat history through available App controls.
Deleting a chat or companion may permanently delete its uploaded photographs, bond level, relationship progression, memories, and related data. Deleting the App is intended to remove locally stored App data from the device. Deleting the App, clearing data, resetting or losing the device, changing devices, restoring from an incomplete backup, or experiencing storage or software failure may permanently delete some or all local data. We may be unable to retrieve, restore, or recreate it.
Deleting local data or deleting the App does not cancel an active subscription. You must cancel an auto-renewable subscription through Apple. Reinstalling the App or using Restore Purchases may restore qualifying purchase entitlements, but may not restore chats, custom companions, bond levels, relationship progression, uploaded photographs, companion memories, or other locally stored Content. Restoration of a purchase does not restore a free creation allowance that has already been used.
You are responsible for saving or exporting Content you wish to keep, to the extent the App provides such functionality. We do not guarantee permanent storage or availability of any Content.
User Content and Limited Processing License
You retain any rights you may have in original Content that you submit, such as original companion descriptions, prompts, messages, and photographs. You represent and warrant that you have the right to submit that Content and that doing so does not violate these Terms, applicable law, or another person’s rights.
You grant us and our service providers a limited, non-exclusive, worldwide license to host, transmit, reproduce, process, analyze, moderate, adapt, and use your submitted Content, including photographs and information contained in or derived from them, solely as reasonably necessary to operate, provide, secure, troubleshoot, and improve the Services; generate requested outputs; analyze submitted photographs; enforce these Terms; and comply with law and our Privacy Policy. This license ends when the Content is no longer reasonably needed for those purposes, subject to legal, security, backup, and technical requirements.
Because the App is private and does not offer public User publishing, you do not grant other Users a license to your private chats, photographs, or locally created companions through the App.
Prohibited Content
You may not submit, request, generate, save, share, or otherwise use the Services in connection with Content that:
is illegal or promotes, facilitates, or instructs others to commit illegal activity;
involves child sexual abuse material, sexualized minors, grooming, exploitation of minors, or any sexual content involving a person or companion under eighteen (18);
involves non-consensual intimate photographs or other content, sexual violence, bestiality, human trafficking, or exploitation;
uses a photograph of a minor for sexual, romantic, exploitative, or otherwise inappropriate purposes;
depicts or encourages suicide, self-harm, or serious violence in a manner prohibited by law or applicable platform rules;
contains threats, harassment, bullying, stalking, doxing, blackmail, extortion, or disclosure of private information;
promotes hatred, discrimination, dehumanization, terrorism, or violent extremism;
infringes or misappropriates intellectual property, privacy, publicity, contractual, or other rights;
impersonates or sexualizes a real person, creates deceptive synthetic media, deepfakes, false endorsements, or misleading representations, or uses another person’s photograph without appropriate authorization;
contains malware, harmful code, credential theft, unauthorized access instructions, or attempts to compromise systems or data;
circumvents or provides instructions for bypassing moderation, safety controls, payment controls, weekly message allowances, lifetime free-use limits, free custom-companion limits, subscription restrictions, photo-upload restrictions, or security features;
is fraudulent, deceptive, spammy, abusive, or intended to manipulate, exploit, or harm another person; or
otherwise violates these Terms, applicable law, Apple’s rules, or applicable third-party provider policies.
Acceptable Use
You agree not to:
copy, reverse engineer, decompile, disassemble, scrape, extract, or attempt to discover source code, models, prompts, system instructions, datasets, or non-public components of the Services, except to the limited extent such restriction is prohibited by law;
use bots, scripts, automated agents, emulators, farms, or other automated means to generate messages, exploit purchases, obtain free use, create companions, collect data, or access the Services;
interfere with, overload, disrupt, damage, or gain unauthorized access to the Services, servers, networks, Apple purchase systems, moderation systems, or another person’s device or data;
resell, sublicense, rent, lease, distribute, or commercially exploit access to the Services or a purchase entitlement;
use the Services or outputs to train, benchmark, develop, or improve a competing artificial intelligence model or service without our written permission;
misrepresent your affiliation with us or suggest that we endorse Content, products, services, or statements that we have not endorsed; or
use the Services in any manner that creates legal, security, safety, reputational, operational, or platform-compliance risk.
Feedback
If you provide ideas, suggestions, reviews, or other feedback about the Services, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use, reproduce, modify, distribute, and otherwise exploit that feedback for any lawful purpose without compensation or obligation to you. Do not provide feedback that you consider confidential or proprietary.
Access Restriction and Termination
Although the App does not require a User account, we may restrict, suspend, disable, or terminate access to the Services, particular features, generation systems, purchases, or device-based entitlements if we believe you violated these Terms, attempted to circumvent limits or moderation, engaged in fraud or abuse, created potential liability, or posed a security or safety risk.
To the fullest extent permitted by law, no refund is required when access is restricted or terminated because of a violation of these Terms. Termination does not affect provisions that by their nature should survive, including intellectual property, payment obligations, disclaimers, limitations of liability, indemnity, dispute resolution, and governing law.
Responsible Use
You are responsible for using the Services in a balanced and appropriate manner. Excessive or prolonged use may affect sleep, productivity, relationships, finances, or well-being. You are responsible for maintaining healthy boundaries with simulated companions and for taking breaks when appropriate.
License to Use the App
Subject to these Terms, we grant you a limited, personal, non-commercial, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the App on Apple-branded devices that you own or control, as permitted by Apple’s usage rules.
The Services, including software, interfaces, designs, trademarks, logos, companions supplied by us, graphics, text, and other materials, are owned by or licensed to us and are protected by intellectual property laws. Except for the limited license expressly granted in these Terms, no right, title, or interest is transferred to you.
Ownership and License for Created and Supplied Companions
Creating or accessing a companion does not transfer ownership of the App, its underlying models, software, templates, artwork, systems, trademarks, or other intellectual property. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use supplied companions and generated Content within the Services for personal, non-commercial entertainment.
Companions and outputs may not be unique. The same or similar names, personalities, appearances, traits, stories, dialogue, or concepts may be made available to or generated for other Users. We do not guarantee exclusivity or that any output qualifies for copyright or other intellectual property protection.
Commercial Use
The Services and AI-generated Content are licensed for personal, non-commercial entertainment use unless we expressly grant written permission otherwise. You may not sell, resell, license, sublicense, distribute commercially, use in advertising, create merchandise from, mint as an NFT, include in a commercial game or app, use as training data, or otherwise commercially exploit generated companions, messages, dialogue, backstories, or other outputs.
If the App permits you to export, download, copy, or share generated Content, you are solely responsible for that use and for complying with law, third-party rights, and platform rules. We do not guarantee that any generated output is non-infringing, unique, eligible for copyright protection, or suitable for commercial use.
Privacy Policy
Our Privacy Policy is incorporated into these Terms by reference. It describes how information may be collected, transmitted, processed, stored, and used in connection with the Services. By using the Services, you agree to the practices described in the Privacy Policy.
Apple App Store Terms
The App is initially made available through the Apple App Store. Your use of the App is also subject to applicable Apple Media Services Terms and Conditions, App Store usage rules, and other Apple terms. These Terms are between you and WhatsGoodApps, LLC, not Apple. Apple is not responsible for the App or its content, maintenance, support, warranties, claims, or legal compliance except to the extent required by Apple’s applicable terms.
Apple and its subsidiaries are intended third-party beneficiaries of the provisions of these Terms that relate to the Apple-distributed App and may enforce those provisions against you to the extent permitted by applicable law. Nothing in these Terms limits rights you may have under Apple’s standard terms or applicable consumer law.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, QUALITY, SECURITY, AND QUIET ENJOYMENT.
We do not warrant that the Services will be uninterrupted, timely, secure, error-free, compatible with every device, or free from harmful components; that messages, companions, bond progression, photograph analysis, or other outputs will be accurate, satisfactory, available, or preserved; or that defects will be corrected. We are not responsible for interruptions, failed generations, lost Content, provider changes, network problems, App Store issues, device failures, or unauthorized access outside our reasonable control.
No Warranty Regarding Emotional Outcomes
We do not warrant that the Services will provide companionship, emotional satisfaction, romantic fulfillment, entertainment value, social improvement, mental health benefits, or any particular emotional or psychological outcome. Any apparent affection, intimacy, attention, encouragement, attraction, or emotional response is simulated.
We do not warrant that increasing a bond level, relationship level, affinity indicator, or similar progression will result in any particular conversation, behavior, personality change, interaction, emotional experience, or feature.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHATSGOODAPPS, LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, EMOTIONAL DISTRESS, SUBSTITUTE SERVICES, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the lesser of (a) the amount you paid through the App during the six (6) months immediately before the event giving rise to the claim or (b) fifty U.S. dollars (US $50). Some jurisdictions do not allow certain exclusions or limitations, so some of the foregoing may not apply to you.
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless WhatsGoodApps, LLC and its affiliates, officers, directors, employees, agents, licensors, suppliers, and service providers from claims, liabilities, damages, judgments, losses, costs, expenses, and reasonable attorneys’ fees arising out of or relating to your Content, your use or misuse of the Services, your violation of these Terms, your violation of law, or your infringement of another person’s rights.
We may assume exclusive control of the defense of a matter subject to indemnification, in which case you agree to cooperate with our defense.
Governing Law, Arbitration, Jury Waiver, and Class-Action Waiver
To the fullest extent permitted by applicable law, these Terms and any dispute, claim, or controversy arising out of or relating to the Services, your use of the Services, any purchase or subscription, AI-generated Content, companion interaction, or these Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
To the fullest extent permitted by applicable law, you and we agree that any dispute, claim, or controversy arising out of or relating to the Services or these Terms will be resolved through binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court if the claim qualifies and remains in that court. Arbitration will be conducted only on an individual basis and not as a class, collective, consolidated, private-attorney-general, or representative action.
Any arbitration, mediation, court proceeding permitted under this section, or other dispute-resolution process arising out of or relating to these Terms or the Services will be conducted exclusively in New York County, New York, and you consent to the jurisdiction and venue of proceedings in New York County, New York, except where applicable law requires otherwise.
YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, CONSOLIDATED ACTION, PRIVATE-ATTORNEY-GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING TO THE FULLEST EXTENT PERMITTED BY LAW.
The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim. If any part of this arbitration or class-action waiver is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction to protect intellectual property, confidential information, security, platform integrity, or other rights that may be irreparably harmed.
Advertisements and Third-Party Links
The Services may display advertisements or links to third-party apps, websites, products, or services. Your interactions with third parties are solely between you and the third party. We do not control or endorse third-party offerings and are not responsible for their content, privacy practices, security, availability, products, services, or transactions.
Copyright Policy
We respect intellectual property rights. If you believe Content available through the Services infringes your copyright, send a written notice to support@whatsgoodapps.com containing:
your physical or electronic signature;
identification of the copyrighted work claimed to have been infringed;
identification of the allegedly infringing material and information reasonably sufficient to locate it;
your address, telephone number, and email address;
We may request additional information reasonably necessary to evaluate or process a copyright notice. Knowingly submitting a materially false notice may create legal liability.
Changes to the Services
We may modify, suspend, replace, or discontinue all or part of the Services at any time. We are not liable for a modification, suspension, or discontinuation except as required by applicable law or Apple’s rules.
Changes to These Terms
We may update these Terms from time to time. The revised Terms become effective when posted in or with the Services, unless a later date is stated. Where required by law, we will provide additional notice of material changes. Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms.
Severability
If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and severed to the minimum extent necessary. The remaining provisions will remain in full force and effect.
Waiver
Our failure to enforce a provision of these Terms is not a waiver of that provision or any other provision. A waiver is effective only if made in writing by an authorized representative of WhatsGoodApps, LLC.
Assignment
You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or by operation of law.
Entire Agreement
These Terms, together with our Privacy Policy and any purchase terms or disclosures presented in the App, constitute the entire agreement between you and us concerning the Services and supersede prior or contemporaneous agreements concerning the same subject matter. If a purchase screen conflicts with these Terms regarding the specific price, billing period, or included benefits of a purchase, the purchase screen controls for that transaction. The definitions and reasonable limitations in these Terms, including the definition of “unlimited,” continue to apply unless the purchase screen expressly states that a particular limitation does not apply.

For purposes of these Terms of Service (the “Terms”), “we,” “us,” and “our” refer to WhatsGoodApps, LLC. We operate the odnoklassniki ai mobile application (the “App”) and any related products, features, websites, support channels, or communities that we may make available. The App and all related products and services are collectively referred to as the “Services.”
These Terms constitute a binding agreement between you and WhatsGoodApps, LLC. “You,” “User,” and “Users” refer to each person who accesses or uses the Services. Please review these Terms and our Privacy Policy before using the Services. By downloading, accessing, purchasing through, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
“Content” includes any text, prompts, companion names, companion descriptions, appearances, personalities, backstories, relationship settings, bond information, scenarios, chat messages, photographs, images, feedback, or other information or material that you submit to, create through, receive from, save in, or otherwise use with the Services. Content includes both User-provided material and AI-generated or AI-assisted output.
Consent
By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you use the Services on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.
Age Requirement
The Services may be used only by individuals who are at least eighteen (18) years old or the age of majority in the jurisdiction where they reside or access the Services, whichever is greater. The Services are not directed to children or minors.
The Services may include mature, romantic, flirtatious, suggestive, fictional relationship, or AI-companion content. The Services are intended to avoid nudity, sexually explicit material, exploitative content, sexualized minors, illegal sexual content, and non-consensual sexual content. You may not use or attempt to use the Services to request, create, obtain, save, or distribute such content.
By using the Services, you represent and warrant that you meet the age requirement, possess the legal capacity to enter into these Terms, and will not permit a person who does not meet the age requirement to use the Services through your device or access.
AI Nature of the Services
The Services use artificial intelligence to simulate conversations, personalities, relationships, and other interactions with fictional AI girlfriends and AI boyfriends. All companions are fictional. They are not real people and do not possess consciousness, emotions, desires, intent, affection, memory, loyalty, independent judgment, or awareness.
The App may include premade or custom companions, different companion personalities or backgrounds, and related labels, categories, and features. They are provided for entertainment and organizational purposes and may be changed, combined, renamed, limited, or discontinued at any time.
Companion Selection and Custom Companion Creation
The Services allow you to select premade fictional Russian AI girlfriends and boyfriends and may allow you to create custom fictional AI girlfriends and boyfriends. Depending on the feature and plan, you may be able to choose or describe a companion’s name, gender, appearance, personality, backstory, relationship dynamic, interests, quirks, conversation style, or other characteristics.
You are solely responsible for the companion information, photographs, and prompts you submit and for ensuring they comply with these Terms and applicable law. You may not create a companion who is or appears to be a minor, is based on a real person without appropriate authorization, or infringes another person’s intellectual property, privacy, publicity, or other rights.
We do not guarantee that a companion will consistently follow selected traits, remember prior details, maintain the same personality, produce a particular type of response, or behave as you expect. Companion behavior may vary because of system design, context limits, moderation, model changes, technical limitations, and User input.
English and Russian Conversations
The Services are designed to support conversations in English and Russian. A companion is generally intended to respond in English to a message written in English and in Russian to a message written in Russian. You may switch between the supported languages during a conversation.
We do not guarantee that the Services will always identify the language of a message correctly, respond entirely in the same language, translate or interpret language accurately, or use grammatically correct, idiomatic, culturally appropriate, or contextually accurate language. Mixed-language messages, slang, transliteration, spelling, short messages, and technical limitations may affect the language or quality of a response.
Russian Language and Cultural Characteristics
Companions may use Russian names, language, expressions, cultural references, backgrounds, locations, or fictional life experiences. These elements are provided for entertainment and may be AI-generated, simplified, fictionalized, inaccurate, incomplete, stereotyped, or inconsistent. Companions are fictional and are not authoritative representations of Russian people, culture, nationality, ethnicity, political views, social norms, or individual experiences.
You may not use cultural, national, ethnic, racial, religious, or language-related features to demean, harass, exploit, stereotype, or promote hatred toward any person or group. We may remove or refuse companions or outputs that create safety, legal, reputational, or platform-compliance concerns.
Bond and Relationship Progression
The App may assign or display a simulated bond, relationship level, affinity level, progression level, or similar indicator for each companion. The more you chat with a particular companion, the companion’s bond may deepen or progress. Bond progression is tracked separately for each companion and may be based on message activity, conversation history, frequency of interaction, or other App-defined criteria.
Bond and relationship progression are fictional entertainment mechanics. They do not reflect actual emotions, attachment, affection, consciousness, consent, commitment, or a real relationship. A companion’s bond level is designed not to decrease or reset through ordinary use. It may, however, be permanently deleted or lost if you delete the applicable companion or chat, delete or reinstall the App, clear App data, lose or reset your device, experience data corruption or software failure, or otherwise lose locally stored data.
We do not guarantee that any particular message or interaction will increase a bond level, that progression will occur at a particular rate, or that any bond level will produce a particular conversation, behavior, personality change, interaction, emotional experience, or feature.
No Professional, Medical, Mental Health, or Relationship Advice
The Services are provided for entertainment only. They are not a substitute for medical, psychological, psychiatric, legal, financial, relationship, crisis, or other professional advice or services. You agree not to rely on a companion or AI-generated output for diagnosis, treatment, emotional support, real-life decision-making, relationship guidance, safety planning, or any other important personal decision.
If you are experiencing distress, believe you may harm yourself or someone else, or need professional assistance, seek help from a qualified professional or appropriate emergency service rather than relying on the Services.
AI Output Disclaimer
AI-generated responses and other outputs may be inaccurate, misleading, inappropriate, incomplete, inconsistent, repetitive, offensive, unexpected, or factually incorrect. Companions may contradict themselves, forget prior information, invent information, fail to follow a prompt, or respond in ways that do not reflect selected traits.
We do not guarantee the accuracy, reliability, suitability, quality, consistency, safety, legality, or appropriateness of any AI-generated output. You are responsible for reviewing and deciding whether to use or rely on any output. All use of AI-generated Content is at your own risk.
Simulated Relationship Disclaimer
Any romantic, emotional, supportive, intimate, antagonistic, or other relationship experienced through the Services is simulated and fictional. Personalized messages, bond levels, relationship status, and progression indicators do not constitute genuine affection, companionship, loyalty, approval, consent, commitment, or a real-world relationship.
A companion may appear attentive, affectionate, jealous, caring, flirtatious, protective, emotionally invested, or otherwise responsive because of automated generation. Such behavior does not reflect actual feelings or intentions. The Services are not a replacement for human relationships, professional counseling, or real-world support.
Private Use and No User-to-User Features
The App is designed as a private experience between you and fictional AI companions. The App does not require a User account and is not intended to provide public profiles, public companion pages, public posts, direct messaging between Users, or User-to-User social features.
Your locally saved conversations, uploaded photographs, and custom companions are not published to other Users through the App. However, messages, prompts, photographs, and other information are transmitted to third-party AI or technology providers as necessary to generate responses, analyze photographs, moderate requests, process purchases, maintain the Services, or provide other functionality, as described in our Privacy Policy.
Free Access
The App provides ten (10) free User chat messages in total. These free messages are a lifetime allowance and may be used across premade and custom companions, subject to feature availability and these Terms. Each free User message is intended to produce one AI-generated chat reply. The corresponding AI-generated reply does not consume a second free message.
A free User may create one (1) custom AI companion, which may be an AI girlfriend or AI boyfriend. This is a lifetime creation allowance, not a limit on the number of custom companions simultaneously stored. The allowance is consumed when the custom companion is created and does not renew or reset if that companion is later deleted, unavailable, corrupted, or lost. A free User may continue to use available premade companions, subject to the free message limit and other applicable restrictions.
The free allowances do not renew or reset periodically. Deleting or reinstalling the App, clearing App data, changing device settings, or taking other steps to obtain additional free messages or another free custom companion is not permitted. Technical limitations may affect how a lifetime allowance is recognized or restored, and we do not guarantee that an unused allowance or a created companion will transfer to another device or remain available after App deletion, device loss, device reset, or data loss.
Paid Access Plans and Message Limits
The Services offer Monthly and Yearly auto-renewable subscriptions. The purchase screen in the App controls the current price, billing period, and included benefits, subject to the definitions and limitations in these Terms. Prices may vary by country, currency, taxes, App Store pricing, and promotional availability.
Plan Current Core Access
Free Ten (10) lifetime User messages and one (1) lifetime custom-companion creation.
Monthly A monthly auto-renewable subscription providing up to 500 User messages during each weekly usage period and unlimited custom companion creation, as “unlimited” is defined below.
Yearly An annual auto-renewable subscription providing up to 2,000 User messages during each weekly usage period, unlimited custom companion creation, as “unlimited” is defined below, and the ability to upload photographs in supported AI chats.
Unless the App expressly states otherwise, a “message” for purposes of a usage limit means a chat message or generation request submitted by you. Corresponding AI replies are not separately deducted as additional User messages. The usage meter and entitlement information displayed in the App are controlling if there is a discrepancy regarding messages used or remaining.
Weekly message allowances are use-it-or-lose-it. They reset at the beginning of each applicable weekly usage period as determined by the App or Apple purchase entitlement. Unused messages expire at the end of the period and do not accumulate, carry forward, roll over, convert into credits, or increase any later allowance. Message limits apply across all premade and custom companions combined and are not a separate allowance for each companion. The Monthly subscription is billed monthly and the Yearly subscription is billed annually even though their message allowances are measured and reset weekly.
For purposes of the purchase screen, marketing, and these Terms, “unlimited custom companions,” “unlimited characters,” “unlimited custom companion creation,” and similar language mean that the applicable paid plan does not impose a fixed numerical cap on ordinary personal custom-companion creation. “Unlimited” does not mean unrestricted, infinite, guaranteed, or exempt from these Terms. Reasonable technical, storage, safety, moderation, rate, concurrency, anti-fraud, anti-abuse, and practical limits may apply. We may restrict automated, excessive, abusive, fraudulent, unsafe, or technically disruptive creation or use.
Subscriptions and Automatic Renewal
Monthly and Yearly are auto-renewable subscriptions unless the App purchase screen expressly states otherwise. A subscription automatically renews at the disclosed price and billing period unless cancelled before the end of the then-current subscription period, subject to Apple’s rules and your App Store settings.
Subscription purchase, billing, renewal, cancellation, refunds, taxes, and payment processing are handled through Apple and the App Store. You are responsible for reviewing the purchase screen, billing period, renewal price, trial or introductory terms, and cancellation instructions before purchasing. Deleting the App does not cancel a subscription. You must manage or cancel the subscription through the applicable Apple account or App Store subscription settings.
If a free trial, discounted introductory offer, promotional price, or other offer is provided, the subscription may automatically convert to a paid subscription at the disclosed price unless cancelled before the offer ends. We do not control Apple’s billing systems and cannot guarantee a refund, reversal, cancellation, or billing adjustment except as required by applicable law or Apple’s rules.
Subscription features and entitlements apply only while the subscription is active and in good standing. If a subscription expires, is cancelled, is refunded, is revoked, or cannot be verified, paid access may end or be reduced. Locally stored chats, uploaded photographs, custom companions, and bond information may remain on your device, but continued access to them or to paid functionality is not guaranteed.
Photo Uploads
Yearly subscribers may upload photographs in supported AI chats. An uploaded photograph is added to and remains in the applicable chat on the device unless you delete the photograph, chat, or related local data, or the data is otherwise lost. The photograph is transmitted through OpenRouter and analyzed by an AI model so the companion can respond to or discuss it. Uploaded photographs are User Content and are subject to these Terms and our Privacy Policy.
You represent and warrant that you own each uploaded photograph or have all rights, permissions, and consents necessary to submit and process it. You may not upload illegal material, child sexual abuse material, sexualized images of minors, non-consensual intimate images, deceptive or abusive images, photographs that infringe privacy or publicity rights, or material you do not have authority to provide.
Photo analysis may be inaccurate, incomplete, inconsistent, inappropriate, or unexpected. The AI may fail to identify or may incorrectly describe people, objects, locations, text, activities, or other details. Do not rely on photo analysis for identity verification, medical, legal, safety, financial, emergency, or other important determinations. We do not guarantee that every photograph will be accepted, analyzed, retained, or produce a response.
Paid Digital Services, Delivery, and Refunds
Subscriptions and paid features are digital services. They have no cash value, are non-transferable, may not be resold, and are provided for personal, non-commercial use within the Services unless we expressly agree otherwise in writing.
Delivery and generation may fail, be delayed, time out, be filtered, or become unavailable because of moderation, technical problems, third-party provider limitations, payment issues, device conditions, network conditions, or other factors. We may provide a retry, replacement, credit, or other remedy in our discretion, but are not required to do so unless required by applicable law or Apple’s rules.
All purchases are subject to Apple’s payment, cancellation, and refund rules. Except where required by applicable law or Apple’s rules, digital purchases are final and non-refundable once requested, activated, consumed, delivered, or otherwise made available.
Generation Availability, Moderation, and Refusal Rights
AI features may depend on automated systems, moderation tools, OpenRouter, third-party AI models, device functionality, network availability, Apple services, payment status, and other factors outside our control. We do not guarantee that a requested response, companion, bond progression event, photograph analysis, or other output will be generated, delivered, saved, or remain available.
We may refuse, block, filter, modify, remove, regenerate, substitute, or decline any prompt, request, output, companion, photograph, interaction, or other Content that we believe may violate these Terms, applicable law, Apple’s rules, a third-party provider’s policies, safety standards, or our business or operational requirements.
We may restrict or terminate access if we believe a User is attempting to bypass moderation, generate prohibited content, automate usage, exploit free or paid limits, circumvent weekly message allowances or custom-companion limits, interfere with the Services, or create risk for us, Apple, a provider, another person, or the public.
No Unauthorized Third-Party Characters or Intellectual Property
You may not use the Services to request, create, upload, generate, distribute, or attempt to generate any companion, name, photograph, image, likeness, outfit, visual design, personality, backstory, dialogue, or other Content that copies, imitates, recreates, or is confusingly similar to a protected third-party character, game, film, television program, comic, book, franchise, studio, publisher, brand, trademark, copyrighted work, or other intellectual property without authorization.
General genres, archetypes, themes, and original companions are permitted, but you are responsible for ensuring that your prompts, companions, photographs, and uses of outputs do not infringe third-party rights. We may block or remove Content that appears to infringe or create a material risk of infringement, even when described as parody, tribute, fan art, homage, or style imitation.
No Real Person Impersonation or Deepfake Use
You may not use the Services to create or attempt to create a companion, description, statement, photograph, likeness, or other Content that depicts, imitates, impersonates, recreates, sexualizes, falsely portrays, or is intended to resemble a real person, celebrity, public figure, influencer, private individual, or identifiable likeness without appropriate authorization. You may not upload another person’s photograph for any such purpose without appropriate authorization.
You may not create deceptive deepfakes, non-consensual synthetic media, false endorsements, fake statements, or Content intended to make others believe that a real person said, did, appeared in, approved, or endorsed something that person did not.
Romantic and Suggestive Content Limitations
The Services may permit romantic, flirtatious, or suggestive fictional conversations. You may not request, generate, encourage, save, or distribute nudity, pornographic or sexually explicit content, sexual violence, bestiality, incestuous sexual content, exploitative sexual content, non-consensual sexual content, or illegal sexual content.
You may not sexualize any companion who is, appears to be, is described as, or is presented as under eighteen (18), a minor, a child, a student presented as a minor, age-ambiguous and childlike, “loli,” “shota,” or otherwise underage. This prohibition applies regardless of whether the companion is fictional, illustrated, generated, or described as being older despite appearing underage.
Third-Party AI Providers and Technology
Chat messages, prompts, uploaded photographs, and related Content are transmitted through OpenRouter for processing by available third-party AI models and related services. Some features may also rely on third-party hosting providers, moderation systems, analytics tools, Apple services, or other external technology. The availability, speed, quality, functionality, and cost of features may depend on these providers.
We are not responsible for outages, restrictions, content filters, model changes, policy changes, provider pricing, processing limitations, output variations, failed generations, or other issues caused by or related to third-party providers. We may add, replace, remove, or limit a provider, model, companion engine, or related technology at any time.
Pricing, Feature Changes, and Usage Limits
We may change prices, plans, purchase options, message limits, reset periods, custom-companion functionality, photo-upload access, language features, bond progression, premade companion availability, generation options, and other features at any time. Changes to an existing auto-renewable subscription are subject to applicable law and Apple’s rules.
We may impose or modify reasonable limits on messages, generations, retries, companion creation, saves, photo uploads, simultaneous requests, or other usage. We may restrict unusually high, automated, abusive, fraudulent, unsafe, or technically disruptive use even if a plan is described as providing a high or unlimited allowance for a particular feature.
No Account and Device-Based Access
The App does not require a User account. Your conversations, custom companions, companion histories, uploaded photographs, bond and relationship progression, preferences, and related data are generally associated with the App installation and device rather than a cross-device account.
Because there is no account, the Services may not provide cloud sync, cross-device history, account-based backup, or account recovery. Subscription and purchase verification may rely on Apple, StoreKit, App Store receipts, or locally stored entitlement information.
Local Storage, Deletion, and Loss of Data
Conversations, created companions, companion settings, memories, uploaded photographs in chats, bond and relationship progression, saved outputs, preferences, and other App data may be stored locally on your device. You may be able to delete individual chats, individual companions, and all chat history through available App controls.
Deleting a chat or companion may permanently delete its uploaded photographs, bond level, relationship progression, memories, and related data. Deleting the App is intended to remove locally stored App data from the device. Deleting the App, clearing data, resetting or losing the device, changing devices, restoring from an incomplete backup, or experiencing storage or software failure may permanently delete some or all local data. We may be unable to retrieve, restore, or recreate it.
Deleting local data or deleting the App does not cancel an active subscription. You must cancel an auto-renewable subscription through Apple. Reinstalling the App or using Restore Purchases may restore qualifying purchase entitlements, but may not restore chats, custom companions, bond levels, relationship progression, uploaded photographs, companion memories, or other locally stored Content. Restoration of a purchase does not restore a free creation allowance that has already been used.
You are responsible for saving or exporting Content you wish to keep, to the extent the App provides such functionality. We do not guarantee permanent storage or availability of any Content.
User Content and Limited Processing License
You retain any rights you may have in original Content that you submit, such as original companion descriptions, prompts, messages, and photographs. You represent and warrant that you have the right to submit that Content and that doing so does not violate these Terms, applicable law, or another person’s rights.
You grant us and our service providers a limited, non-exclusive, worldwide license to host, transmit, reproduce, process, analyze, moderate, adapt, and use your submitted Content, including photographs and information contained in or derived from them, solely as reasonably necessary to operate, provide, secure, troubleshoot, and improve the Services; generate requested outputs; analyze submitted photographs; enforce these Terms; and comply with law and our Privacy Policy. This license ends when the Content is no longer reasonably needed for those purposes, subject to legal, security, backup, and technical requirements.
Because the App is private and does not offer public User publishing, you do not grant other Users a license to your private chats, photographs, or locally created companions through the App.
Prohibited Content
You may not submit, request, generate, save, share, or otherwise use the Services in connection with Content that:
is illegal or promotes, facilitates, or instructs others to commit illegal activity;
involves child sexual abuse material, sexualized minors, grooming, exploitation of minors, or any sexual content involving a person or companion under eighteen (18);
involves non-consensual intimate photographs or other content, sexual violence, bestiality, human trafficking, or exploitation;
uses a photograph of a minor for sexual, romantic, exploitative, or otherwise inappropriate purposes;
depicts or encourages suicide, self-harm, or serious violence in a manner prohibited by law or applicable platform rules;
contains threats, harassment, bullying, stalking, doxing, blackmail, extortion, or disclosure of private information;
promotes hatred, discrimination, dehumanization, terrorism, or violent extremism;
infringes or misappropriates intellectual property, privacy, publicity, contractual, or other rights;
impersonates or sexualizes a real person, creates deceptive synthetic media, deepfakes, false endorsements, or misleading representations, or uses another person’s photograph without appropriate authorization;
contains malware, harmful code, credential theft, unauthorized access instructions, or attempts to compromise systems or data;
circumvents or provides instructions for bypassing moderation, safety controls, payment controls, weekly message allowances, lifetime free-use limits, free custom-companion limits, subscription restrictions, photo-upload restrictions, or security features;
is fraudulent, deceptive, spammy, abusive, or intended to manipulate, exploit, or harm another person; or
otherwise violates these Terms, applicable law, Apple’s rules, or applicable third-party provider policies.
Acceptable Use
You agree not to:
copy, reverse engineer, decompile, disassemble, scrape, extract, or attempt to discover source code, models, prompts, system instructions, datasets, or non-public components of the Services, except to the limited extent such restriction is prohibited by law;
use bots, scripts, automated agents, emulators, farms, or other automated means to generate messages, exploit purchases, obtain free use, create companions, collect data, or access the Services;
interfere with, overload, disrupt, damage, or gain unauthorized access to the Services, servers, networks, Apple purchase systems, moderation systems, or another person’s device or data;
resell, sublicense, rent, lease, distribute, or commercially exploit access to the Services or a purchase entitlement;
use the Services or outputs to train, benchmark, develop, or improve a competing artificial intelligence model or service without our written permission;
misrepresent your affiliation with us or suggest that we endorse Content, products, services, or statements that we have not endorsed; or
use the Services in any manner that creates legal, security, safety, reputational, operational, or platform-compliance risk.
Feedback
If you provide ideas, suggestions, reviews, or other feedback about the Services, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use, reproduce, modify, distribute, and otherwise exploit that feedback for any lawful purpose without compensation or obligation to you. Do not provide feedback that you consider confidential or proprietary.
Access Restriction and Termination
Although the App does not require a User account, we may restrict, suspend, disable, or terminate access to the Services, particular features, generation systems, purchases, or device-based entitlements if we believe you violated these Terms, attempted to circumvent limits or moderation, engaged in fraud or abuse, created potential liability, or posed a security or safety risk.
To the fullest extent permitted by law, no refund is required when access is restricted or terminated because of a violation of these Terms. Termination does not affect provisions that by their nature should survive, including intellectual property, payment obligations, disclaimers, limitations of liability, indemnity, dispute resolution, and governing law.
Responsible Use
You are responsible for using the Services in a balanced and appropriate manner. Excessive or prolonged use may affect sleep, productivity, relationships, finances, or well-being. You are responsible for maintaining healthy boundaries with simulated companions and for taking breaks when appropriate.
License to Use the App
Subject to these Terms, we grant you a limited, personal, non-commercial, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the App on Apple-branded devices that you own or control, as permitted by Apple’s usage rules.
The Services, including software, interfaces, designs, trademarks, logos, companions supplied by us, graphics, text, and other materials, are owned by or licensed to us and are protected by intellectual property laws. Except for the limited license expressly granted in these Terms, no right, title, or interest is transferred to you.
Ownership and License for Created and Supplied Companions
Creating or accessing a companion does not transfer ownership of the App, its underlying models, software, templates, artwork, systems, trademarks, or other intellectual property. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use supplied companions and generated Content within the Services for personal, non-commercial entertainment.
Companions and outputs may not be unique. The same or similar names, personalities, appearances, traits, stories, dialogue, or concepts may be made available to or generated for other Users. We do not guarantee exclusivity or that any output qualifies for copyright or other intellectual property protection.
Commercial Use
The Services and AI-generated Content are licensed for personal, non-commercial entertainment use unless we expressly grant written permission otherwise. You may not sell, resell, license, sublicense, distribute commercially, use in advertising, create merchandise from, mint as an NFT, include in a commercial game or app, use as training data, or otherwise commercially exploit generated companions, messages, dialogue, backstories, or other outputs.
If the App permits you to export, download, copy, or share generated Content, you are solely responsible for that use and for complying with law, third-party rights, and platform rules. We do not guarantee that any generated output is non-infringing, unique, eligible for copyright protection, or suitable for commercial use.
Privacy Policy
Our Privacy Policy is incorporated into these Terms by reference. It describes how information may be collected, transmitted, processed, stored, and used in connection with the Services. By using the Services, you agree to the practices described in the Privacy Policy.
Apple App Store Terms
The App is initially made available through the Apple App Store. Your use of the App is also subject to applicable Apple Media Services Terms and Conditions, App Store usage rules, and other Apple terms. These Terms are between you and WhatsGoodApps, LLC, not Apple. Apple is not responsible for the App or its content, maintenance, support, warranties, claims, or legal compliance except to the extent required by Apple’s applicable terms.
Apple and its subsidiaries are intended third-party beneficiaries of the provisions of these Terms that relate to the Apple-distributed App and may enforce those provisions against you to the extent permitted by applicable law. Nothing in these Terms limits rights you may have under Apple’s standard terms or applicable consumer law.
Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, QUALITY, SECURITY, AND QUIET ENJOYMENT.
We do not warrant that the Services will be uninterrupted, timely, secure, error-free, compatible with every device, or free from harmful components; that messages, companions, bond progression, photograph analysis, or other outputs will be accurate, satisfactory, available, or preserved; or that defects will be corrected. We are not responsible for interruptions, failed generations, lost Content, provider changes, network problems, App Store issues, device failures, or unauthorized access outside our reasonable control.
No Warranty Regarding Emotional Outcomes
We do not warrant that the Services will provide companionship, emotional satisfaction, romantic fulfillment, entertainment value, social improvement, mental health benefits, or any particular emotional or psychological outcome. Any apparent affection, intimacy, attention, encouragement, attraction, or emotional response is simulated.
We do not warrant that increasing a bond level, relationship level, affinity indicator, or similar progression will result in any particular conversation, behavior, personality change, interaction, emotional experience, or feature.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHATSGOODAPPS, LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, EMOTIONAL DISTRESS, SUBSTITUTE SERVICES, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the lesser of (a) the amount you paid through the App during the six (6) months immediately before the event giving rise to the claim or (b) fifty U.S. dollars (US $50). Some jurisdictions do not allow certain exclusions or limitations, so some of the foregoing may not apply to you.
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless WhatsGoodApps, LLC and its affiliates, officers, directors, employees, agents, licensors, suppliers, and service providers from claims, liabilities, damages, judgments, losses, costs, expenses, and reasonable attorneys’ fees arising out of or relating to your Content, your use or misuse of the Services, your violation of these Terms, your violation of law, or your infringement of another person’s rights.
We may assume exclusive control of the defense of a matter subject to indemnification, in which case you agree to cooperate with our defense.
Governing Law, Arbitration, Jury Waiver, and Class-Action Waiver
To the fullest extent permitted by applicable law, these Terms and any dispute, claim, or controversy arising out of or relating to the Services, your use of the Services, any purchase or subscription, AI-generated Content, companion interaction, or these Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
To the fullest extent permitted by applicable law, you and we agree that any dispute, claim, or controversy arising out of or relating to the Services or these Terms will be resolved through binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court if the claim qualifies and remains in that court. Arbitration will be conducted only on an individual basis and not as a class, collective, consolidated, private-attorney-general, or representative action.
Any arbitration, mediation, court proceeding permitted under this section, or other dispute-resolution process arising out of or relating to these Terms or the Services will be conducted exclusively in New York County, New York, and you consent to the jurisdiction and venue of proceedings in New York County, New York, except where applicable law requires otherwise.
YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, CONSOLIDATED ACTION, PRIVATE-ATTORNEY-GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING TO THE FULLEST EXTENT PERMITTED BY LAW.
The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim. If any part of this arbitration or class-action waiver is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction to protect intellectual property, confidential information, security, platform integrity, or other rights that may be irreparably harmed.
Advertisements and Third-Party Links
The Services may display advertisements or links to third-party apps, websites, products, or services. Your interactions with third parties are solely between you and the third party. We do not control or endorse third-party offerings and are not responsible for their content, privacy practices, security, availability, products, services, or transactions.
Copyright Policy
We respect intellectual property rights. If you believe Content available through the Services infringes your copyright, send a written notice to support@whatsgoodapps.com containing:
your physical or electronic signature;
identification of the copyrighted work claimed to have been infringed;
identification of the allegedly infringing material and information reasonably sufficient to locate it;
your address, telephone number, and email address;
We may request additional information reasonably necessary to evaluate or process a copyright notice. Knowingly submitting a materially false notice may create legal liability.
Changes to the Services
We may modify, suspend, replace, or discontinue all or part of the Services at any time. We are not liable for a modification, suspension, or discontinuation except as required by applicable law or Apple’s rules.
Changes to These Terms
We may update these Terms from time to time. The revised Terms become effective when posted in or with the Services, unless a later date is stated. Where required by law, we will provide additional notice of material changes. Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms.
Severability
If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and severed to the minimum extent necessary. The remaining provisions will remain in full force and effect.
Waiver
Our failure to enforce a provision of these Terms is not a waiver of that provision or any other provision. A waiver is effective only if made in writing by an authorized representative of WhatsGoodApps, LLC.
Assignment
You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or by operation of law.
Entire Agreement
These Terms, together with our Privacy Policy and any purchase terms or disclosures presented in the App, constitute the entire agreement between you and us concerning the Services and supersede prior or contemporaneous agreements concerning the same subject matter. If a purchase screen conflicts with these Terms regarding the specific price, billing period, or included benefits of a purchase, the purchase screen controls for that transaction. The definitions and reasonable limitations in these Terms, including the definition of “unlimited,” continue to apply unless the purchase screen expressly states that a particular limitation does not apply.
