Terms of Service

These Terms of Service (the “Terms”) are a legal agreement between WhatsGoodApps LLC (“WhatsGoodApps,” “we,” “us,” or “our”), the developer and provider of the MEDvi mobile application, and the person using MEDvi (“you” or “your”). These Terms govern your access to and use of the MEDvi application and any content, features, and services made available through it (collectively, the “App” or “Service”).

By downloading, accessing, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

1. Definitions
For purposes of these Terms:

“Offer” means any third-party telehealth, medical, wellness, medication, supplement, device, product, program, consultation, or other offer displayed, described, compared, or linked through the App.
“Provider” means an independent healthcare professional, medical practice, telehealth platform, pharmacy, manufacturer, merchant, seller, laboratory, fulfillment provider, or other third party associated with an Offer.
“MEDvi Content” means the App’s interface, offer summaries, comparisons, categories, questionnaires, matching results, educational materials, pricing information, descriptions, graphics, and other information made available through the App.
2. Eligibility and Age Requirement
You must be at least 18 years old and legally capable of entering into a binding agreement to use the App. The App is intended only for adults. You may not access or use the App if you are under 18.

If you are a parent or legal guardian and believe that a minor has used the App, please contact us at the email address listed below.

3. What MEDvi Provides
MEDvi is an informational health and wellness offer-discovery and comparison platform. It allows users to browse Offers, review selected details, save Offers as favorites, access general educational content, and answer preference-based questions that may be used to surface Offers that appear to align with the user’s stated preferences.

The App may display Offers relating to areas such as weight management, sexual wellness, hair and scalp care, hormone and longevity services, cognitive wellness, dietary supplements, medical or wellness devices, and other health-related products or services.

MEDvi does not necessarily display every available provider, treatment, product, program, or option in any category. The availability of an Offer in the App does not mean that the Offer is available to every user or in every location.

4. Free Use of MEDvi; No Payments Processed by Us
MEDvi is currently free to use. The App has no paywall, MEDvi subscription, or in-app purchase, and WhatsGoodApps does not charge users to browse or access Offers through the App.

Providers may charge for their own products, medications, consultations, laboratory testing, treatment programs, memberships, subscriptions, shipping, or other services. All such transactions occur entirely outside MEDvi and directly between you and the applicable Provider or other third party. WhatsGoodApps does not process, receive, store, or control payment-card information or payments for third-party Offers.

A purchase, subscription, membership, or payment made through a Provider is not a MEDvi purchase or subscription. Deleting MEDvi does not cancel a Provider’s subscription, membership, recurring order, or treatment plan. You are responsible for reviewing and managing any third-party billing or renewal arrangement directly with the applicable Provider.

5. Affiliate Relationships and Compensation
Some or all links in MEDvi are affiliate links. WhatsGoodApps may receive compensation when you click a link, submit information, complete a consultation, enroll in a program, purchase a product or service, start a subscription, or take another qualifying action with a Provider. Unless otherwise stated by the Provider, using an affiliate link generally does not increase the price you pay.

Affiliate compensation and commercial relationships may influence which Offers are included in the App, featured, made available, or displayed. Questionnaire answers and selected preferences are used to identify Offers that may align with what you selected. If more than one Offer may match your answers, the order or prominence of those Offers may be determined by additional factors, including Offer features, pricing information, geographic availability, content completeness, user experience, commercial relationships, and compensation.

MEDvi may not include every available Offer and is not a comprehensive or neutral marketplace. Affiliate compensation does not establish that an Offer is medically appropriate, safe, effective, superior, or suitable for you.

The App will provide affiliate disclosures in locations intended to be reasonably noticeable in connection with Offer links. You should review those disclosures before continuing to a Provider.

6. Preference Questionnaire and Offer Matching
The App may ask questions about your preferences, interests, budget, desired product or treatment format, insurance preferences, location, delivery preferences, or other non-diagnostic considerations. Your answers are used only to help organize or surface potentially relevant Offers.

Questionnaire results are not medical advice, medical screening, a diagnosis, a clinical recommendation, a prescription decision, or a determination of eligibility. A statement that an Offer “matches,” “may match,” or is “recommended” based on your answers means only that the Offer may align with one or more preferences you selected. It does not mean that a medication, supplement, device, treatment, Provider, or program is medically appropriate for you.

The matching process may not consider your complete medical history, current medications, allergies, contraindications, laboratory results, symptoms, pregnancy status, underlying conditions, or other information required for a medical decision. Only a qualified healthcare professional with appropriate information can determine whether a medical treatment is appropriate.

Questionnaire responses and Favorites are stored locally on your device and are not transmitted to WhatsGoodApps. We do not place sensitive questionnaire answers into affiliate-link URLs. Local information may be lost if you delete the App, clear its data, replace or lose your device, or experience data loss or corruption.

7. No Medical Advice or Healthcare Relationship
MEDvi does not provide medical advice, diagnosis, treatment, prescriptions, pharmacy services, medical monitoring, emergency services, or professional healthcare services.

MEDvi is not a medical practice, healthcare provider, telehealth provider, pharmacy, laboratory, manufacturer, or insurer. Using the App does not create a physician-patient, clinician-patient, pharmacist-patient, therapist-patient, fiduciary, or other professional relationship between you and WhatsGoodApps.

MEDvi Content is provided for general informational and offer-comparison purposes only. It is not a substitute for advice from a physician, pharmacist, registered dietitian, therapist, or other qualified healthcare professional who can evaluate your individual circumstances.

You should consult an appropriately qualified healthcare professional before starting, stopping, changing, combining, or using any medication, supplement, treatment, device, diet, wellness program, or health-related product. Do not disregard or delay professional medical advice because of information displayed or omitted by the App.

8. Medical Emergencies and Concerning Symptoms
MEDvi is not an emergency service and does not monitor users for emergencies. If you believe you are experiencing a medical emergency, call emergency services immediately. If you experience severe, persistent, worsening, or concerning symptoms, promptly contact a qualified healthcare professional. Do not delay seeking medical attention because of anything displayed, suggested, or omitted by the App.

9. Independent Providers
All Providers are independent third parties. WhatsGoodApps does not employ, supervise, direct, or control Providers and is not responsible for their professional judgment, business practices, conduct, staffing, qualifications, licensing, prescribing, dispensing, manufacturing, fulfillment, billing, customer service, privacy practices, or compliance with law.

Providers are solely responsible for matters associated with their Offers, including:

medical evaluations, diagnoses, treatment decisions, prescribing, dosage, monitoring, and follow-up care;
professional licensing, credentialing, and authority to provide services in a user’s location;
pharmacy selection, medication compounding, dispensing, labeling, storage, and fulfillment;
product formulation, manufacturing, quality, safety, labeling, warnings, and instructions;
eligibility requirements, geographic availability, insurance participation, and patient acceptance;
prices, fees, taxes, laboratory costs, shipping charges, billing, renewals, cancellations, refunds, warranties, and guarantees;
shipping, delivery, delays, loss, damage, returns, exchanges, and customer support; and
their websites, applications, terms, privacy practices, advertising claims, and regulatory obligations.
WhatsGoodApps does not guarantee that any Provider is licensed or authorized in your jurisdiction, that any particular pharmacy or fulfillment source will be used, or that an Offer complies with every applicable legal or regulatory requirement. You are responsible for reviewing the Provider’s credentials and terms and asking questions before proceeding.

10. External Links and Third-Party Transactions
When you select an Offer or tap a button such as “Continue to Provider,” you may leave MEDvi and enter a website, application, checkout flow, questionnaire, or service controlled by a third party. Third-party sites and services are governed by their own terms, privacy policies, consent forms, medical notices, billing terms, and other rules.

WhatsGoodApps is not a party to any agreement or transaction between you and a Provider. We do not control and are not responsible for any third-party website, content, form, product, service, payment, charge, renewal, cancellation, refund, guarantee, delivery, security practice, or privacy practice.

Affiliate links may contain ordinary referral or campaign identifiers used to attribute clicks or transactions. Once you leave the App, a Provider or affiliate network may collect information under its own policies. You should review the third party’s terms and privacy policy before submitting personal, medical, financial, or payment information.

Links may become unavailable, expire, redirect, change destinations, or lead to content that differs from the information previously displayed in MEDvi. We may remove or disable a link at any time but have no obligation to continuously monitor every external destination.

11. Offer Information, Pricing, and Availability
We may summarize information obtained from Provider websites, affiliate networks, public sources, or materials supplied by third parties. Although we may make reasonable efforts to present useful information, MEDvi Content may be incomplete, inaccurate, delayed, outdated, or affected by changes made by a Provider without notice.

Offer details that may change include starting prices, introductory prices, package quantities, medication or product inclusion, consultation fees, laboratory fees, shipping costs, insurance eligibility, ingredients, formulations, dosages, treatment methods, subscriptions, renewal periods, minimum commitments, cancellation procedures, guarantees, return policies, state availability, provider networks, and pharmacy participation.

A displayed “starting” or “from” price may apply only to a particular introductory period, dose, quantity, package, treatment, payment schedule, membership, subscription, insurance arrangement, or promotional offer. It may not include all medications, laboratory tests, consultations, shipping, taxes, processing charges, or other costs. You must verify the current total price and all material terms directly with the Provider before enrolling or purchasing.

Availability may vary by state, country, age, sex, medical history, diagnosis, provider licensing, pharmacy coverage, inventory, shipping destination, and other factors. An Offer displayed in the App may not be available to you. A Provider may reject an application, require additional information, change a proposed treatment, or determine that a treatment is not appropriate.

12. No Endorsement or Guarantee of Providers and Offers
Unless expressly stated, displaying an Offer does not mean that WhatsGoodApps has independently tested, approved, certified, recommended, or endorsed the Provider, medication, supplement, device, product, treatment, program, pharmacy, laboratory, or claim.

WhatsGoodApps does not guarantee:

the accuracy or completeness of Provider claims or MEDvi Content;
the qualifications, licensing, conduct, availability, or quality of any Provider;
the safety, effectiveness, quality, legality, authenticity, or suitability of any Offer;
that any product or service has a particular regulatory status;
that you will qualify for, receive, tolerate, or benefit from any treatment or product;
that a prescription will be issued or that a Provider will accept you as a patient;
that insurance will cover or reimburse any cost;
that any stated price, delivery estimate, cancellation policy, warranty, or guarantee will remain available; or
that any particular result or health outcome will occur.
13. Prescription and Telehealth Offers
Prescription medications and clinical services require evaluation and authorization by an appropriately licensed healthcare professional. MEDvi does not determine eligibility, issue prescriptions, choose medications or dosages, provide informed consent, monitor treatment, or make clinical decisions.

A prescription is never guaranteed. If you continue to a Provider, you are responsible for supplying complete, current, and accurate information and for reviewing risks, benefits, contraindications, interactions, side effects, warnings, directions, and alternatives with the prescribing professional or pharmacist.

Do not use MEDvi to decide whether to start, stop, increase, decrease, combine, delay, or otherwise change a medication or treatment. Follow the instructions of your healthcare professional, medication label, pharmacist, and applicable product materials.

14. Compounded Medications
Some Offers may involve compounded medications. Compounded medications are not approved by the U.S. Food and Drug Administration (“FDA”), and the FDA does not review them before marketing for safety, effectiveness, or quality.

MEDvi does not determine whether a compounded medication is appropriate for you and does not represent that a compounded medication is the same as, generic to, interchangeable with, or therapeutically equivalent to an FDA-approved product. Questions about the source, formulation, ingredients, concentration, sterility, storage, labeling, risks, or suitability of a compounded medication should be directed to the prescribing Provider and dispensing pharmacy.

15. Dietary Supplements and Nonprescription Wellness Products
Some Offers may involve dietary supplements or other nonprescription wellness products. Dietary supplements are not medications and are not approved by the FDA before marketing in the same manner as prescription drugs. Unless lawfully authorized and expressly stated, supplements are not intended to diagnose, treat, cure, or prevent disease.

Supplement formulas, serving directions, ingredients, and amounts may change. Review the current product label and Supplement Facts panel before use. Supplements can cause side effects and may interact with medications, medical conditions, surgery, pregnancy, breastfeeding, or other supplements. Consult a qualified healthcare professional before use when appropriate.

MEDvi does not guarantee that a supplement is safe, effective, free from contaminants, accurately labeled, suitable for you, or supported by a particular level of scientific evidence. Individual experiences and results vary.

16. Medical and Wellness Devices
Some Offers may involve medical or wellness devices. Terms such as “FDA approved,” “FDA cleared,” “FDA authorized,” “FDA registered,” and “FDA listed” have different meanings and are not interchangeable. MEDvi may summarize a device’s stated regulatory status based on information available at the time, but we do not guarantee that the status is complete or remains current.

You are responsible for reviewing and following the manufacturer’s instructions, intended-use limitations, contraindications, warnings, precautions, maintenance requirements, and safety information. Consult a qualified healthcare professional regarding unexplained symptoms, sudden changes, or whether a device is appropriate for you.

17. Educational Content
The App may contain general educational information about health, wellness, treatments, products, medications, supplements, devices, costs, or questions to consider when evaluating an Offer. Educational content is not tailored to your medical circumstances and is not medical, legal, financial, insurance, or other professional advice.

Health information, product availability, regulatory requirements, and scientific understanding may change. We do not guarantee that educational content is complete, current, or applicable to your circumstances.

18. Local Storage, Favorites, and Data Loss
MEDvi does not require an account or login. Questionnaire responses, Favorites, and related preferences are stored locally on your device. WhatsGoodApps does not guarantee permanent storage, backup, synchronization, transfer, or recovery of locally stored information.

If the App is deleted, your device is lost, replaced, damaged, reset, or restored, or App data is cleared or corrupted, locally stored information may be permanently lost. You are responsible for maintaining any information you wish to keep.

Depending on your Apple device settings, Apple may provide WhatsGoodApps with limited diagnostics or analytics information. Our handling of information is described in the Privacy Policy.

19. License to Use the App
Subject to your compliance with these Terms, WhatsGoodApps grants you a limited, personal, revocable, nonexclusive, nontransferable, and nonsublicensable license to access and use the App for your own noncommercial purposes on a device that you own or control and as permitted by applicable platform usage rules.

The App is licensed, not sold. WhatsGoodApps and its licensors reserve all rights not expressly granted to you.

20. Intellectual Property and Third-Party Marks
The App, its software, design, organization, original text, graphics, interfaces, features, compilations, and MEDvi Content are owned by or licensed to WhatsGoodApps and are protected by intellectual-property and other laws.

Provider names, product names, logos, trademarks, service marks, images, and other third-party materials belong to their respective owners. Their display in MEDvi does not transfer ownership to WhatsGoodApps and does not necessarily imply sponsorship, endorsement, partnership, or approval beyond any disclosed affiliate or commercial relationship.

You may not copy, reproduce, modify, distribute, sell, license, publish, scrape, frame, mirror, create derivative works from, or commercially exploit the App or MEDvi Content except as expressly permitted by us in writing or by applicable law.

21. Prohibited Uses
You may not:

use the App if you are under 18 years old;
use MEDvi as a substitute for medical advice, diagnosis, treatment, prescribing, pharmacy services, or emergency care;
misrepresent MEDvi Content or matching results as a clinical recommendation, guarantee, scientific conclusion, or determination of medical suitability;
use the App to make medication, treatment, supplement, or device decisions without appropriate professional guidance;
provide false, fraudulent, or misleading information to a Provider;
use the App or MEDvi Content for competitive research, commercial solicitation, resale, lead harvesting, or development of a competing product or offer database;
use bots, crawlers, scrapers, automated scripts, data-mining tools, or similar methods to access, extract, monitor, or copy the App or MEDvi Content;
reverse engineer, decompile, disassemble, modify, or attempt to derive the source code, underlying logic, algorithms, or nonpublic data of the App, except where a restriction is prohibited by law;
interfere with the App’s operation, security, servers, networks, links, tracking, or technical measures;
attempt to gain unauthorized access to the App, systems, data, or another person’s device or information;
introduce viruses, malware, harmful code, or disruptive content;
violate the intellectual-property, privacy, publicity, contractual, or other rights of WhatsGoodApps or any third party;
use the App for unlawful, deceptive, abusive, harassing, harmful, or fraudulent purposes;
violate these Terms, a Provider’s terms, platform rules, or applicable law; or
attempt, assist, encourage, or permit another person to do any of the foregoing.
22. Service Availability, Changes, and Termination
We may add, remove, modify, suspend, restrict, or discontinue any Offer, category, questionnaire, feature, link, content, or portion of the App at any time. We do not guarantee that the App or any Offer will be continuously available, error-free, secure, compatible with every device, or maintained for any particular period.

We may restrict or terminate your access if we reasonably believe you have violated these Terms, misused the App, created legal or security risk, or interfered with the rights or experience of others.

You may stop using the App at any time by deleting it. Deleting the App does not cancel any agreement, purchase, subscription, treatment plan, or recurring order you have with a Provider.

23. Apple App Store Terms
If you obtain the App through Apple’s App Store, your license to the App is also subject to Apple’s applicable App Store terms and Licensed Application End User License Agreement. These Terms are between you and WhatsGoodApps, not Apple. WhatsGoodApps, not Apple, is responsible for the App and its content, maintenance, support, and any claims relating to the App to the extent provided by applicable law.

Apple has no obligation to provide maintenance or support for the App. Apple and its subsidiaries are intended third-party beneficiaries of the provisions of these Terms that relate to your use of the App through the App Store and may enforce those provisions as third-party beneficiaries.

You represent that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country and that you are not listed on any U.S. government list of prohibited or restricted parties. You must comply with applicable third-party terms when using the App.

If the App is later made available through another distribution platform, additional platform terms may apply.

24. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE APP, MEDVI CONTENT, MATCHING RESULTS, OFFERS, LINKS, AND ALL RELATED INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

WHATSGOODAPPS DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NONINFRINGEMENT, ACCURACY, COMPLETENESS, AVAILABILITY, SECURITY, RELIABILITY, QUIET ENJOYMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the App will meet your needs; that information will be accurate, current, or complete; that Offers will remain available; that links will function or lead to an expected destination; that defects will be corrected; that the App will be uninterrupted or free from harmful components; or that a Provider, product, medication, supplement, treatment, device, pharmacy, or service will be safe, effective, lawful, suitable, affordable, or satisfactory.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

25. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WHATSGOODAPPS AND ITS AFFILIATES, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, SAVINGS, DATA, GOODWILL, USE, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE APP, MEDVI CONTENT, AN OFFER, A PROVIDER, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Without limiting the foregoing, WhatsGoodApps will not be liable for claims or losses arising from or relating to:

your use of, inability to use, or reliance on the App, MEDvi Content, matching results, or educational information;
inaccurate, incomplete, outdated, delayed, or misleading Offer information;
a Provider’s conduct, negligence, professional judgment, licensing, prescribing, treatment, product, medication, supplement, device, pharmacy, laboratory, or service;
denial of treatment, failure to qualify, failure to receive a prescription, or a change in a Provider’s proposed treatment;
side effects, adverse reactions, interactions, injury, illness, delayed care, dissatisfaction, or any health outcome;
the safety, effectiveness, quality, labeling, authenticity, legality, or regulatory status of a product or service;
prices, fees, insurance coverage, billing, recurring charges, renewals, cancellations, refunds, warranties, guarantees, shipping, delivery, loss, or damage;
third-party websites, applications, privacy practices, security incidents, content, transactions, or customer support;
expired, broken, unavailable, redirected, or modified links or Offers;
loss, deletion, corruption, or unavailability of Favorites, questionnaire responses, preferences, or other locally stored information; or
unauthorized access, device failure, network failure, Apple services, or events beyond our reasonable control.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WHATSGOODAPPS’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). IF YOU ARE DISSATISFIED WITH THE APP, YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP USING AND DELETE IT.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some limitations may not apply to you. Nothing in these Terms excludes liability that cannot lawfully be excluded.

26. Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless WhatsGoodApps and its affiliates, owners, officers, directors, employees, agents, contractors, licensors, and service providers from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

your unlawful or unauthorized use of the App or MEDvi Content;
your violation of these Terms, applicable law, platform rules, or a third party’s rights;
fraudulent, false, or misleading information you provide to a Provider;
your scraping, copying, interference with, or commercial exploitation of the App; or
your conduct in connection with a Provider or third-party transaction, except to the extent caused by WhatsGoodApps’s own unlawful conduct.
27. Governing Law and Informal Dispute Resolution
These Terms and any dispute arising out of or relating to them or the App will be governed by the laws of the State of New York, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement below.

Before starting arbitration or litigation, the party raising a dispute must send the other party a written notice describing the dispute and requested relief. Notices to WhatsGoodApps must be sent to support@whatsgoodapps.com. The parties will attempt in good faith to resolve the dispute informally for at least 30 days after receipt of the notice.

28. Binding Individual Arbitration
Except for disputes eligible for small claims court and requests for temporary or preliminary injunctive relief to protect intellectual-property or security rights, any dispute, claim, or controversy arising out of or relating to these Terms, the App, MEDvi Content, or the relationship between you and WhatsGoodApps will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules and Mediation Procedures then in effect.

Arbitration may be conducted through written submissions, by telephone or videoconference, or at an in-person location permitted by the AAA Consumer Arbitration Rules and applicable law. Fees will be allocated as required by the AAA Consumer Arbitration Rules and applicable law. The arbitrator may award any individual relief available in court, subject to the limitations in these Terms, and the award may be entered in any court of competent jurisdiction.

YOU AND WHATSGOODAPPS AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS. NEITHER PARTY MAY BRING OR PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE, COORDINATED, OR PRIVATE-ATTORNEY-GENERAL ACTION OR ARBITRATION TO THE EXTENT SUCH WAIVER IS PERMITTED BY LAW. THE ARBITRATOR MAY AWARD RELIEF ONLY TO THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO RESOLVE THAT PARTY’S INDIVIDUAL CLAIM.

YOU AND WHATSGOODAPPS WAIVE THE RIGHT TO A JURY TRIAL FOR DISPUTES SUBJECT TO ARBITRATION.

If the AAA is unavailable or declines to administer a dispute, the parties will attempt in good faith to select another nationally recognized arbitration provider. If they cannot agree, a court of competent jurisdiction may appoint an arbitrator consistent with this section.

29. Small Claims and Court Proceedings
Either party may bring an individual claim in a court of competent small-claims jurisdiction if the claim qualifies and remains on an individual, nonrepresentative basis.

For any dispute not subject to arbitration or small claims, you and WhatsGoodApps consent to the exclusive jurisdiction of the state and federal courts located in New York County, New York, except where applicable law does not permit that venue requirement.

30. Force Majeure
WhatsGoodApps will not be liable for failure or delay caused by circumstances beyond its reasonable control, including natural disasters, severe weather, fire, war, terrorism, civil unrest, public-health emergencies, governmental action, labor disputes, utility failures, telecommunications or internet outages, cybersecurity events, app-store outages, hosting failures, Provider failures, affiliate-network failures, or transportation disruptions.

31. Changes to These Terms
We may update these Terms from time to time. The updated version will state a revised “Last updated” date and may be presented in the App or otherwise made available to you. To the extent required by law, we will provide additional notice of material changes. Your continued use of the App after updated Terms become effective constitutes acceptance of the updated Terms. If you do not agree to an update, stop using the App.

32. Waiver, Severability, and Assignment
A failure to enforce any provision of these Terms is not a waiver of that provision or any other right. If any provision is found invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, corporate restructuring, or by operation of law.

33. Entire Agreement
These Terms, together with the Privacy Policy and any notices expressly incorporated into them, constitute the entire agreement between you and WhatsGoodApps regarding the App and supersede prior or contemporaneous understandings relating to the App.
