For purposes of these Terms of Service (the “Terms”), “we,” “us,” and “our” refer to WhatsGoodApps, LLC. We operate the Ploybuzz AI mobile application (the “App”) and any related products, features, websites, support channels, or communities that we may make available. The App and all related products and services are collectively referred to as the “Services.”
These Terms constitute a binding agreement between you and WhatsGoodApps, LLC. “You,” “User,” and “Users” refer to each person who accesses or uses the Services. Please review these Terms and our Privacy Policy before using the Services. By downloading, accessing, purchasing through, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
“Content” includes any text, prompts, character names, character descriptions, appearances, personalities, backstories, relationship settings, scenarios, chat messages, images, audio, feedback, or other information or material that you submit to, create through, receive from, save in, or otherwise use with the Services. Content includes both User-provided material and AI-generated or AI-assisted output.
Consent
By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you use the Services on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.
Age Requirement
The Services may be used only by individuals who are at least eighteen (18) years old or the age of majority in the jurisdiction where they reside or access the Services, whichever is greater. The Services are not directed to children or minors.
The Services may include mature, romantic, flirtatious, suggestive, anime-inspired, fantasy, supernatural, or fictional roleplay content. The Services are intended to avoid nudity, sexually explicit material, exploitative content, sexualized minors, illegal sexual content, and non-consensual sexual content. You may not use or attempt to use the Services to request, create, obtain, save, or distribute such content.
By using the Services, you represent and warrant that you meet the age requirement, possess the legal capacity to enter into these Terms, and will not permit a person who does not meet the age requirement to use the Services through your device or access.
AI Nature of the Services
The Services use artificial intelligence to simulate conversations, relationships, roleplay, stories, personalities, images, voices, and other interactions. All characters are fictional. They are not real people and do not possess consciousness, emotions, desires, intent, affection, memory, loyalty, independent judgment, or awareness.
The App may include multiple character experiences or modes, including virtual girlfriend, virtual boyfriend, anime- or waifu-inspired companion, and fantasy or general roleplay experiences. Modes, labels, characters, categories, and features are provided for entertainment and organizational purposes and may be changed, combined, renamed, limited, or discontinued at any time.
Character Selection and Custom Character Creation
The Services may allow you to select premade fictional characters or create custom fictional characters. Depending on the feature and plan, you may be able to choose or describe a character’s name, gender, appearance, personality, backstory, relationship dynamic, interests, quirks, conversation style, setting, role, species, powers, or other characteristics.
Custom characters may include original romantic companions, anime-inspired characters, fantasy beings, heroes, villains, rivals, supernatural characters, nonhuman characters, or other fictional creations. You are solely responsible for the character information and prompts you submit and for ensuring that they comply with these Terms and applicable law.
We do not guarantee that a character will consistently follow the selected traits, remember prior details, maintain the same personality, produce a particular type of response, or behave as you expect. Character behavior may vary because of system design, context limits, moderation, model changes, technical limitations, and User input.
Fictional, Anime-Inspired, and Fantasy Content
Characters, personas, dialogue, relationships, stories, settings, images, voices, and other outputs are fictional and may be stylized, anime-inspired, fantasy-based, AI-generated, or AI-assisted. Any resemblance to an actual person, living or dead, is unintended and coincidental.
Unless we expressly state otherwise in writing, Ploybuzz AI is not affiliated with, endorsed by, sponsored by, approved by, or connected to any anime studio, manga publisher, game developer, film or television studio, author, franchise owner, rights holder, celebrity, influencer, or brand. References to genres, archetypes, themes, tropes, or general styles do not imply any affiliation with a third-party property.
No Professional, Medical, Mental Health, or Relationship Advice
The Services are provided for entertainment only. They are not a substitute for medical, psychological, psychiatric, legal, financial, relationship, crisis, or other professional advice or services. You agree not to rely on a character or AI-generated output for diagnosis, treatment, emotional support, real-life decision-making, relationship guidance, safety planning, or any other important personal decision.
If you are experiencing distress, believe you may harm yourself or someone else, or need professional assistance, seek help from a qualified professional or appropriate emergency service rather than relying on the Services.
AI Output Disclaimer
AI-generated responses and other outputs may be inaccurate, misleading, inappropriate, incomplete, inconsistent, repetitive, offensive, unexpected, or factually incorrect. Characters may contradict themselves, forget prior information, invent information, fail to follow a prompt, or respond in ways that do not reflect the traits you selected.
We do not guarantee the accuracy, reliability, suitability, quality, consistency, safety, legality, or appropriateness of any AI-generated output. You are responsible for reviewing and deciding whether to use or rely on any output. All use of AI-generated Content is at your own risk.
Simulated Relationship Disclaimer
Any romantic, emotional, supportive, intimate, antagonistic, or other relationship experienced through the Services is simulated and fictional. Personalized messages do not constitute genuine affection, companionship, loyalty, approval, consent, commitment, or a real-world relationship.
A character may appear attentive, affectionate, jealous, caring, flirtatious, protective, emotionally invested, or otherwise responsive because of automated generation. Such behavior does not reflect actual feelings or intentions. The Services are not a replacement for human relationships, professional counseling, or real-world support.
Private Use and No User-to-User Features
The App is designed as a private experience between you and fictional AI characters. The App does not require a User account and is not intended to provide public profiles, public character pages, public posts, direct messaging between Users, or User-to-User social features.
Your locally saved conversations and custom characters are not published to other Users through the App. However, messages, prompts, and other information may be transmitted to third-party AI or technology providers as necessary to generate responses, moderate requests, process purchases, maintain the Services, or provide other functionality, as described in our Privacy Policy.
Free Messages
The App provides ten (10) free chat messages in total. These free messages are a lifetime allowance and may be used across multiple characters and any available mode, subject to feature availability and these Terms. Each free chat message sent by you is intended to produce one AI-generated chat reply. The AI-generated reply does not consume a second free message.
The free allowance does not renew or reset periodically. Deleting or reinstalling the App, clearing App data, changing device settings, or taking other steps to obtain additional free messages is not permitted. Technical limitations may affect how a lifetime allowance is recognized or restored, and we do not guarantee that unused free messages will transfer to another device or remain available after App deletion, device loss, device reset, or data loss.
Paid Access Plans and Message Limits
The Services may offer one-time access passes and auto-renewable subscription plans. The purchase screen in the App controls the current price, billing period, features, and limits. Prices may vary by country, currency, taxes, App Store pricing, and promotional availability.
Plan Current Core Access
12-Hour Pass A one-time, non-subscription unlock providing access for up to twelve (12) hours, subject to a total limit of 200 messages. It includes chat access across the available girlfriend, boyfriend, waifu/anime companion, and roleplay modes. Access ends when the 12-hour period expires or the message limit is reached, whichever occurs first.
Premium A monthly auto-renewable subscription providing up to 500 messages per week, the ability to maintain up to 10 custom characters, and chat access across all four modes.
Ultimate A monthly auto-renewable subscription providing up to 1,500 messages per week, unlimited custom characters subject to reasonable and practical limits, chat access across all four modes, and priority or faster reply processing when available.
Yearly An annual auto-renewable subscription providing up to 2,000 messages per week, unlimited custom characters subject to reasonable and practical limits, and chat access across all four modes. If photo-message functionality is offered, the Yearly plan may be the only plan that includes or permits that functionality, as stated in the App.
Unless the App expressly states otherwise, a “message” for purposes of a usage limit means a chat message or generation request submitted by you. Corresponding AI replies are not separately deducted as additional User messages. The usage meter and entitlement information displayed in the App are controlling if there is a discrepancy.
Weekly message allowances reset according to the weekly period determined by the App or Apple purchase entitlement. Unused weekly messages expire and do not roll over. Message limits apply across characters and modes rather than separately to each character. We may apply reasonable technical, safety, anti-abuse, concurrency, or rate limits even when a plan is described as allowing “unlimited” custom characters.
“Fastest replies,” “priority replies,” or similar language means that eligible requests may receive preferential processing relative to lower-priority requests when the feature is available. It is not a guarantee of any particular response time. Speed may be affected by network conditions, third-party AI providers, demand, moderation, device performance, outages, or other factors.
One-Time 12-Hour Pass
The 12-Hour Pass is a one-time digital purchase and is not an auto-renewable subscription. The access period begins when the pass is activated or otherwise made available by the App and expires after twelve (12) hours, even if you do not use all included messages. Unused time and unused messages expire and have no cash value. They do not roll over, convert into credits, or extend a later pass.
The 12-Hour Pass provides the access described on the purchase screen but does not necessarily include every subscription-only feature, future feature, promotional feature, photo feature, audio feature, character-creation allowance, or other benefit unless the App expressly states that it does.
Subscriptions and Automatic Renewal
Premium, Ultimate, and Yearly are auto-renewable subscriptions unless the App purchase screen expressly states otherwise. A subscription automatically renews at the disclosed price and billing period unless cancelled before the end of the then-current subscription period, subject to Apple’s rules and your App Store settings.
Subscription purchase, billing, renewal, cancellation, refunds, taxes, and payment processing are handled through Apple and the App Store. You are responsible for reviewing the purchase screen, billing period, renewal price, trial or introductory terms, and cancellation instructions before purchasing. Deleting the App does not cancel a subscription. You must manage or cancel the subscription through the applicable Apple account or App Store subscription settings.
If a free trial, discounted introductory offer, promotional price, or other offer is provided, the subscription may automatically convert to a paid subscription at the disclosed price unless cancelled before the offer ends. We do not control Apple’s billing systems and cannot guarantee a refund, reversal, cancellation, or billing adjustment except as required by applicable law or Apple’s rules.
Subscription features and entitlements apply only while the subscription is active and in good standing. If a subscription expires, is cancelled, is refunded, is revoked, or cannot be verified, paid access may end or be reduced. Any locally stored chats or characters may remain on your device, but continued access to them or to premium functionality is not guaranteed.
Photo, Image, Voice, and Audio Features
The Services may now or later offer AI-generated photos, images, character pictures, selfies, photo messages, audio messages, voice messages, or other media. The availability of these features is not guaranteed. A feature described in marketing, a purchase screen, a plan name, or these Terms may be delayed, modified, restricted, tested, discontinued, or unavailable in a particular version, plan, country, device, character, or mode.
If photo or image features are offered, generated images will be fictional and AI-generated or AI-assisted. They may vary in appearance, style, clothing, setting, pose, lighting, proportions, quality, consistency, or resemblance to the selected character. Images may contain visual artifacts or unexpected elements. We do not guarantee that an image will match your prompt, expectations, preferences, or prior generations.
If audio or voice features are offered, the audio will use synthetic or AI-generated voices. It will not be a recording or live communication from a real person. Voices may vary in tone, accent, pacing, pronunciation, emotion, volume, clarity, or consistency. We do not guarantee exact wording, length, delivery, or voice quality.
Photo, image, voice, and audio features may be limited to a particular plan, such as the Yearly plan, or may require a separate purchase, credit, allowance, or eligibility requirement. The terms displayed in the App at the time of use or purchase control. Unless required by law or Apple’s rules, subjective dissatisfaction with the creative result does not entitle you to a refund, replacement, or credit.
Paid Digital Items, Delivery, and Refunds
Subscriptions, passes, Gacha openings, character packs, girlfriend continent packs, unlocked characters, images, photo messages, audio messages, voice messages, credits, and other paid features are digital items or digital services. They have no cash value, are non-transferable, may not be resold, and are provided for personal, non-commercial use within the Services unless we expressly agree otherwise in writing.
Payment for a digital item entitles you only to the item, access period, generation, pack opening, character unlock, or feature described at the time of purchase. It does not entitle you to future generations, replacement outputs, additional items, perpetual availability, or continued access after an entitlement expires.
Delivery and generation may fail, be delayed, time out, be filtered, or become unavailable because of moderation, technical problems, third-party provider limitations, payment issues, device conditions, network conditions, or other factors. We may provide a retry, replacement, credit, or other remedy in our discretion, but are not required to do so unless required by applicable law or Apple’s rules.
All purchases are subject to Apple’s payment, cancellation, and refund rules. Except where required by applicable law or Apple’s rules, digital purchases are final and non-refundable once requested, activated, generated, consumed, delivered, or otherwise made available.
Gacha, Character Packs, and Girlfriend Continent Packs
The Services may include Gacha features and paid virtual character packs, including girlfriend continent packs and other continent-, region-, country-, theme-, mode-, rarity-, or character-based packs. Packs may be added, removed, renamed, modified, combined, or replaced over time.
When you purchase and open or “rip” a pack, the App may reveal one fictional AI character selected from the characters or possible results associated with that pack. A girlfriend continent pack may reveal a fictional girlfriend character associated with a randomly selected country, location, theme, or cultural profile within the represented continent or region.
Each pack opening is a separate digital transaction unless the App expressly states otherwise. Purchasing one pack does not guarantee a particular character, country, appearance, personality, rarity, trait, or outcome. Duplicate or similar characters may be possible unless the App expressly guarantees otherwise.
Randomized Outcomes
Gacha and pack results may be randomized, partially randomized, algorithmically selected, or affected by the available inventory or configuration at the time of opening. Results may vary between Users and between repeated purchases of the same pack.
Any stated category, continent, country, rarity, probability, weighting, theme, or description is subject to the information displayed in the App at the time of purchase. We may modify the pool of available characters, probabilities, rarity labels, selection rules, character traits, or pack structure as permitted by applicable law and platform rules.
Character Archetypes and Cultural Traits
Characters may use fictional archetypes, genres, personality types, cultural themes, regional references, language patterns, local knowledge, or country-based traits for entertainment. These traits may be simplified, stylized, incomplete, inaccurate, exaggerated, or generated from limited information. They are not authoritative descriptions of any country, culture, ethnicity, nationality, religion, language, or group.
You may not use cultural, national, ethnic, racial, religious, or language-related features to demean, harass, exploit, stereotype, or promote hatred toward any person or group. We may remove or refuse characters or outputs that create safety, legal, reputational, or platform-compliance concerns.
No Gambling, Prizes, or Real-World Value
Gacha and character packs are entertainment features involving digital fictional characters. They are not gambling, wagering, lotteries, investments, contests, or opportunities to win money or prizes. Digital characters, outcomes, rarities, packs, and related items have no cash value and cannot be redeemed for money, transferred, sold, traded, or exchanged outside the Services.
Ownership and License for Pack and Generated Characters
Purchasing, revealing, unlocking, or creating a character does not transfer ownership of the App, its underlying models, software, templates, artwork, systems, trademarks, or other intellectual property. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use unlocked characters and generated Content within the Services for personal, non-commercial entertainment.
Characters and outputs may not be unique. The same or similar names, personalities, appearances, traits, stories, dialogue, or concepts may be made available to or generated for other Users. We do not guarantee exclusivity or that any output qualifies for copyright or other intellectual property protection.
Pack Availability, Changes, and Local Loss
We may add, remove, modify, rebalance, replace, rename, suspend, or discontinue any Gacha feature, pack, character pool, rarity, region, country, category, or result. We do not guarantee that a particular pack or character will remain available.
Pack results and unlocked character data may be stored locally on your device. Deleting the App, clearing App data, resetting or losing the device, changing devices, or experiencing storage failure may permanently remove locally stored results. Apple’s Restore Purchases feature may restore qualifying purchase entitlements, but it may not restore a specific randomized pack outcome, locally created character, conversation history, or other device-only data.
Generation Availability, Moderation, and Refusal Rights
AI features may depend on automated systems, moderation tools, third-party AI providers, device functionality, network availability, Apple services, payment status, and other factors outside our control. We do not guarantee that a requested text response, character, image, photo message, audio message, Gacha result, or other output will be generated, delivered, saved, or remain available.
We may refuse, block, filter, modify, remove, regenerate, substitute, or decline any prompt, request, output, character, pack result, interaction, or other Content that we believe may violate these Terms, applicable law, Apple’s rules, a third-party provider’s policies, safety standards, or our business or operational requirements.
We may restrict or terminate access if we believe a User is attempting to bypass moderation, generate prohibited content, automate usage, exploit free or paid limits, interfere with the Services, or create risk for us, Apple, a provider, another person, or the public.
No Unauthorized Third-Party Characters or Intellectual Property
You may not use the Services to request, create, upload, generate, distribute, or attempt to generate any character, name, image, voice, likeness, outfit, visual design, personality, backstory, dialogue, or other Content that copies, imitates, recreates, or is confusingly similar to a protected third-party character, anime, manga, game, film, television program, comic, book, franchise, studio, publisher, brand, trademark, copyrighted work, or other intellectual property without authorization.
General genres, archetypes, themes, and original characters are permitted, but you are responsible for ensuring that your prompts, characters, and uses of outputs do not infringe third-party rights. We may block or remove Content that appears to infringe or create a material risk of infringement, even when described as parody, tribute, fan art, homage, or style imitation.
No Real Person Impersonation or Deepfake Use
You may not use the Services to create or attempt to create a character, image, voice, audio message, description, statement, or other Content that depicts, imitates, impersonates, recreates, or is intended to resemble a real person, celebrity, public figure, influencer, private individual, identifiable likeness, or recognizable voice without appropriate authorization.
You may not create deceptive deepfakes, non-consensual synthetic media, false endorsements, fake statements, or Content intended to make others believe that a real person said, did, appeared in, approved, or endorsed something that person did not.
Romantic and Suggestive Content Limitations
The Services may permit romantic, flirtatious, or suggestive fictional conversations. You may not request, generate, encourage, save, or distribute nudity, pornographic or sexually explicit content, sexual violence, bestiality, incestuous sexual content, exploitative sexual content, non-consensual sexual content, or illegal sexual content.
You may not sexualize any character who is, appears to be, is described as, or is presented as under eighteen (18), a minor, a child, a student presented as a minor, age-ambiguous and childlike, “loli,” “shota,” or otherwise underage. This prohibition applies regardless of whether the character is fictional, illustrated, anime-inspired, generated, or described as being older despite appearing underage.
Third-Party AI Providers and Technology
Some features may rely on third-party artificial intelligence models, hosting providers, image-generation systems, voice systems, moderation systems, analytics tools, Apple services, or other external technology. The availability, speed, quality, functionality, and cost of features may depend on these providers.
We are not responsible for outages, restrictions, content filters, model changes, policy changes, provider pricing, processing limitations, output variations, failed generations, or other issues caused by or related to third-party providers. We may add, replace, remove, or limit a provider, model, voice, image system, character engine, or related technology at any time.
Pricing, Feature Changes, and Usage Limits
We may change prices, plans, purchase options, message limits, character limits, reset periods, priority levels, image or audio access, Gacha features, packs, available characters, generation options, and other features at any time. Changes to an existing auto-renewable subscription are subject to applicable law and Apple’s rules.
We may impose or modify reasonable limits on messages, generations, retries, characters, saves, downloads, simultaneous requests, or other usage. We may restrict unusually high, automated, abusive, fraudulent, unsafe, or technically disruptive use even if a plan is described as providing a high or unlimited allowance for a particular feature.
No Account and Device-Based Access
The App does not require a User account. Your conversations, custom characters, character histories, preferences, local unlock information, and related data are generally associated with the App installation and device rather than a cross-device account.
Because there is no account, the Services may not provide cloud sync, cross-device history, account-based backup, or account recovery. Subscription and purchase verification may rely on Apple, StoreKit, App Store receipts, or locally stored entitlement information.
Local Storage, Deletion, and Loss of Data
Conversations, created characters, character settings, memories, saved outputs, preferences, Gacha or pack results, unlocked character data, and other App data may be stored locally on your device. You may be able to delete individual chats, individual characters, and all chat history through available App controls.
Deleting the App is intended to remove locally stored App data from the device. Deleting the App, clearing data, resetting or losing the device, changing devices, restoring from an incomplete backup, or experiencing storage or software failure may permanently delete some or all local data. We may be unable to retrieve, restore, or recreate it.
Deleting local data or deleting the App does not cancel an active subscription. You must cancel an auto-renewable subscription through Apple. Reinstalling the App or using Restore Purchases may restore qualifying purchase entitlements, but may not restore chats, custom characters, character memories, pack outcomes, generated media, or other locally stored Content.
You are responsible for saving or exporting Content you wish to keep, to the extent the App provides such functionality. We do not guarantee permanent storage or availability of any Content.
User Content and Limited Processing License
You retain any rights you may have in original Content that you submit, such as original character descriptions, prompts, and messages. You represent and warrant that you have the right to submit that Content and that doing so does not violate these Terms, applicable law, or another person’s rights.
You grant us and our service providers a limited, non-exclusive, worldwide license to host, transmit, reproduce, process, analyze, moderate, adapt, and use your submitted Content solely as reasonably necessary to operate, provide, secure, troubleshoot, and improve the Services; generate requested outputs; enforce these Terms; and comply with law and our Privacy Policy. This license ends when the Content is no longer reasonably needed for those purposes, subject to legal, security, backup, and technical requirements.
Because the App is private and does not offer public User publishing, you do not grant other Users a license to your private chats or locally created characters through the App.
Prohibited Content
You may not submit, request, generate, save, share, or otherwise use the Services in connection with Content that:
is illegal or promotes, facilitates, or instructs others to commit illegal activity;
involves child sexual abuse material, sexualized minors, grooming, exploitation of minors, or any sexual content involving a person or character under eighteen (18);
involves non-consensual intimate content, sexual violence, bestiality, human trafficking, or exploitation;
depicts or encourages suicide, self-harm, or serious violence in a manner prohibited by law or applicable platform rules;
contains threats, harassment, bullying, stalking, doxing, blackmail, extortion, or disclosure of private information;
promotes hatred, discrimination, dehumanization, terrorism, or violent extremism;
infringes or misappropriates intellectual property, privacy, publicity, contractual, or other rights;
impersonates a real person or creates deceptive synthetic media, deepfakes, false endorsements, or misleading representations;
contains malware, harmful code, credential theft, unauthorized access instructions, or attempts to compromise systems or data;
circumvents or provides instructions for bypassing moderation, safety controls, payment controls, message limits, free-use limits, or security features;
is fraudulent, deceptive, spammy, abusive, or intended to manipulate, exploit, or harm another person; or
otherwise violates these Terms, applicable law, Apple’s rules, or applicable third-party provider policies.
Acceptable Use
You agree not to:
copy, reverse engineer, decompile, disassemble, scrape, extract, or attempt to discover source code, models, prompts, system instructions, datasets, or non-public components of the Services, except to the limited extent such restriction is prohibited by law;
use bots, scripts, automated agents, emulators, farms, or other automated means to generate messages, exploit purchases, obtain free use, open packs, collect data, or access the Services;
interfere with, overload, disrupt, damage, or gain unauthorized access to the Services, servers, networks, Apple purchase systems, moderation systems, or another person’s device or data;
resell, sublicense, rent, lease, distribute, or commercially exploit access to the Services or a purchase entitlement;
use the Services or outputs to train, benchmark, develop, or improve a competing artificial intelligence model or service without our written permission;
misrepresent your affiliation with us or suggest that we endorse Content, products, services, or statements that we have not endorsed; or
use the Services in any manner that creates legal, security, safety, reputational, operational, or platform-compliance risk.
Feedback
If you provide ideas, suggestions, reviews, or other feedback about the Services, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use, reproduce, modify, distribute, and otherwise exploit that feedback for any lawful purpose without compensation or obligation to you. Do not provide feedback that you consider confidential or proprietary.
Access Restriction and Termination
Although the App does not require a User account, we may restrict, suspend, disable, or terminate access to the Services, particular features, generation systems, purchases, or device-based entitlements if we believe you violated these Terms, attempted to circumvent limits or moderation, engaged in fraud or abuse, created potential liability, or posed a security or safety risk.
To the fullest extent permitted by law, no refund is required when access is restricted or terminated because of a violation of these Terms. Termination does not affect provisions that by their nature should survive, including intellectual property, payment obligations, disclaimers, limitations of liability, indemnity, dispute resolution, and governing law.
Responsible Use
You are responsible for using the Services in a balanced and appropriate manner. Excessive or prolonged use may affect sleep, productivity, relationships, finances, or well-being. You are responsible for maintaining healthy boundaries with simulated characters and for taking breaks when appropriate.
License to Use the App
Subject to these Terms, we grant you a limited, personal, non-commercial, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the App on Apple-branded devices that you own or control, as permitted by Apple’s usage rules.
The Services, including software, interfaces, designs, trademarks, logos, characters supplied by us, pack systems, graphics, text, and other materials, are owned by or licensed to us and are protected by intellectual property laws. Except for the limited license expressly granted in these Terms, no right, title, or interest is transferred to you.
Commercial Use
The Services and AI-generated Content are licensed for personal, non-commercial entertainment use unless we expressly grant written permission otherwise. You may not sell, resell, license, sublicense, distribute commercially, use in advertising, create merchandise from, mint as an NFT, include in a commercial game or app, use as training data, or otherwise commercially exploit generated characters, images, voices, messages, dialogue, backstories, or other outputs.
If the App permits you to export, download, copy, or share generated Content, you are solely responsible for that use and for complying with law, third-party rights, and platform rules. We do not guarantee that any generated output is non-infringing, unique, eligible for copyright protection, or suitable for commercial use.
Privacy Policy
Our Privacy Policy is incorporated into these Terms by reference. It describes how information may be collected, transmitted, processed, stored, and used in connection with the Services. By using the Services, you agree to the practices described in the Privacy Policy.
Apple App Store Terms
The App is initially made available through the Apple App Store. Your use of the App is also subject to applicable Apple Media Services Terms and Conditions, App Store usage rules, and other Apple terms. These Terms are between you and WhatsGoodApps, LLC, not Apple. Apple is not responsible for the App or its content, maintenance, support, warranties, claims, or legal compliance except to the extent required by Apple’s applicable terms.
Apple and its subsidiaries are intended third-party beneficiaries of the provisions of these Terms that relate to the Apple-distributed App and may enforce those provisions against you to the extent permitted by applicable law. Nothing in these Terms limits rights you may have under Apple’s standard terms or applicable consumer law.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, QUALITY, SECURITY, AND QUIET ENJOYMENT.
We do not warrant that the Services will be uninterrupted, timely, secure, error-free, compatible with every device, or free from harmful components; that messages, characters, pack results, images, audio, or other outputs will be accurate, satisfactory, available, or preserved; or that defects will be corrected. We are not responsible for interruptions, failed generations, lost Content, provider changes, network problems, App Store issues, device failures, or unauthorized access outside our reasonable control.
No Warranty Regarding Emotional Outcomes
We do not warrant that the Services will provide companionship, emotional satisfaction, romantic fulfillment, entertainment value, social improvement, mental health benefits, or any particular emotional or psychological outcome. Any apparent affection, intimacy, attention, encouragement, attraction, or emotional response is simulated.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHATSGOODAPPS, LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, EMOTIONAL DISTRESS, SUBSTITUTE SERVICES, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the lesser of (a) the amount you paid through the App during the six (6) months immediately before the event giving rise to the claim or (b) fifty U.S. dollars (US $50). Some jurisdictions do not allow certain exclusions or limitations, so some of the foregoing may not apply to you.
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless WhatsGoodApps, LLC and its affiliates, officers, directors, employees, agents, licensors, suppliers, and service providers from claims, liabilities, damages, judgments, losses, costs, expenses, and reasonable attorneys’ fees arising out of or relating to your Content, your use or misuse of the Services, your violation of these Terms, your violation of law, or your infringement of another person’s rights.
We may assume exclusive control of the defense of a matter subject to indemnification, in which case you agree to cooperate with our defense.
Governing Law, Arbitration, Jury Waiver, and Class-Action Waiver
To the fullest extent permitted by applicable law, these Terms and any dispute, claim, or controversy arising out of or relating to the Services, your use of the Services, any purchase or subscription, AI-generated Content, character interaction, or these Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
To the fullest extent permitted by applicable law, you and we agree that any dispute, claim, or controversy arising out of or relating to the Services or these Terms will be resolved through binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court if the claim qualifies and remains in that court. Arbitration will be conducted only on an individual basis and not as a class, collective, consolidated, private-attorney-general, or representative action.
Any arbitration, mediation, court proceeding permitted under this section, or other dispute-resolution process arising out of or relating to these Terms or the Services will be conducted exclusively in New York County, New York, and you consent to the jurisdiction and venue of proceedings in New York County, New York, except where applicable law requires otherwise.
YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, CONSOLIDATED ACTION, PRIVATE-ATTORNEY-GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING TO THE FULLEST EXTENT PERMITTED BY LAW.
The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim. If any part of this arbitration or class-action waiver is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction to protect intellectual property, confidential information, security, platform integrity, or other rights that may be irreparably harmed.
Advertisements and Third-Party Links
The Services may display advertisements or links to third-party apps, websites, products, or services. Your interactions with third parties are solely between you and the third party. We do not control or endorse third-party offerings and are not responsible for their content, privacy practices, security, availability, products, services, or transactions.
Copyright Policy
We respect intellectual property rights. If you believe Content available through the Services infringes your copyright, send a written notice to support@whatsgoodapps.com containing:
your physical or electronic signature;
identification of the copyrighted work claimed to have been infringed;
identification of the allegedly infringing material and information reasonably sufficient to locate it;
your address, telephone number, and email address;
We may request additional information reasonably necessary to evaluate or process a copyright notice. Knowingly submitting a materially false notice may create legal liability.
Changes to the Services
We may modify, suspend, replace, or discontinue all or part of the Services at any time. We are not liable for a modification, suspension, or discontinuation except as required by applicable law or Apple’s rules.
Changes to These Terms
We may update these Terms from time to time. The revised Terms become effective when posted in or with the Services, unless a later date is stated. Where required by law, we will provide additional notice of material changes. Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms.
Severability
If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and severed to the minimum extent necessary. The remaining provisions will remain in full force and effect.
Waiver
Our failure to enforce a provision of these Terms is not a waiver of that provision or any other provision. A waiver is effective only if made in writing by an authorized representative of WhatsGoodApps, LLC.
Assignment
You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or by operation of law.
Entire Agreement
These Terms, together with our Privacy Policy and any purchase terms or disclosures presented in the App, constitute the entire agreement between you and us concerning the Services and supersede prior or contemporaneous agreements concerning the same subject matter. If a purchase screen conflicts with these Terms regarding the specific price, billing period, or included benefits of a purchase, the purchase screen controls for that transaction.

For purposes of these Terms of Service (the “Terms”), “we,” “us,” and “our” refer to WhatsGoodApps, LLC. We operate the Ploybuzz AI mobile application (the “App”) and any related products, features, websites, support channels, or communities that we may make available. The App and all related products and services are collectively referred to as the “Services.”
These Terms constitute a binding agreement between you and WhatsGoodApps, LLC. “You,” “User,” and “Users” refer to each person who accesses or uses the Services. Please review these Terms and our Privacy Policy before using the Services. By downloading, accessing, purchasing through, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
“Content” includes any text, prompts, character names, character descriptions, appearances, personalities, backstories, relationship settings, scenarios, chat messages, images, audio, feedback, or other information or material that you submit to, create through, receive from, save in, or otherwise use with the Services. Content includes both User-provided material and AI-generated or AI-assisted output.
Consent
By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you use the Services on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.
Age Requirement
The Services may be used only by individuals who are at least eighteen (18) years old or the age of majority in the jurisdiction where they reside or access the Services, whichever is greater. The Services are not directed to children or minors.
The Services may include mature, romantic, flirtatious, suggestive, anime-inspired, fantasy, supernatural, or fictional roleplay content. The Services are intended to avoid nudity, sexually explicit material, exploitative content, sexualized minors, illegal sexual content, and non-consensual sexual content. You may not use or attempt to use the Services to request, create, obtain, save, or distribute such content.
By using the Services, you represent and warrant that you meet the age requirement, possess the legal capacity to enter into these Terms, and will not permit a person who does not meet the age requirement to use the Services through your device or access.
AI Nature of the Services
The Services use artificial intelligence to simulate conversations, relationships, roleplay, stories, personalities, images, voices, and other interactions. All characters are fictional. They are not real people and do not possess consciousness, emotions, desires, intent, affection, memory, loyalty, independent judgment, or awareness.
The App may include multiple character experiences or modes, including virtual girlfriend, virtual boyfriend, anime- or waifu-inspired companion, and fantasy or general roleplay experiences. Modes, labels, characters, categories, and features are provided for entertainment and organizational purposes and may be changed, combined, renamed, limited, or discontinued at any time.
Character Selection and Custom Character Creation
The Services may allow you to select premade fictional characters or create custom fictional characters. Depending on the feature and plan, you may be able to choose or describe a character’s name, gender, appearance, personality, backstory, relationship dynamic, interests, quirks, conversation style, setting, role, species, powers, or other characteristics.
Custom characters may include original romantic companions, anime-inspired characters, fantasy beings, heroes, villains, rivals, supernatural characters, nonhuman characters, or other fictional creations. You are solely responsible for the character information and prompts you submit and for ensuring that they comply with these Terms and applicable law.
We do not guarantee that a character will consistently follow the selected traits, remember prior details, maintain the same personality, produce a particular type of response, or behave as you expect. Character behavior may vary because of system design, context limits, moderation, model changes, technical limitations, and User input.
Fictional, Anime-Inspired, and Fantasy Content
Characters, personas, dialogue, relationships, stories, settings, images, voices, and other outputs are fictional and may be stylized, anime-inspired, fantasy-based, AI-generated, or AI-assisted. Any resemblance to an actual person, living or dead, is unintended and coincidental.
Unless we expressly state otherwise in writing, Ploybuzz AI is not affiliated with, endorsed by, sponsored by, approved by, or connected to any anime studio, manga publisher, game developer, film or television studio, author, franchise owner, rights holder, celebrity, influencer, or brand. References to genres, archetypes, themes, tropes, or general styles do not imply any affiliation with a third-party property.
No Professional, Medical, Mental Health, or Relationship Advice
The Services are provided for entertainment only. They are not a substitute for medical, psychological, psychiatric, legal, financial, relationship, crisis, or other professional advice or services. You agree not to rely on a character or AI-generated output for diagnosis, treatment, emotional support, real-life decision-making, relationship guidance, safety planning, or any other important personal decision.
If you are experiencing distress, believe you may harm yourself or someone else, or need professional assistance, seek help from a qualified professional or appropriate emergency service rather than relying on the Services.
AI Output Disclaimer
AI-generated responses and other outputs may be inaccurate, misleading, inappropriate, incomplete, inconsistent, repetitive, offensive, unexpected, or factually incorrect. Characters may contradict themselves, forget prior information, invent information, fail to follow a prompt, or respond in ways that do not reflect the traits you selected.
We do not guarantee the accuracy, reliability, suitability, quality, consistency, safety, legality, or appropriateness of any AI-generated output. You are responsible for reviewing and deciding whether to use or rely on any output. All use of AI-generated Content is at your own risk.
Simulated Relationship Disclaimer
Any romantic, emotional, supportive, intimate, antagonistic, or other relationship experienced through the Services is simulated and fictional. Personalized messages do not constitute genuine affection, companionship, loyalty, approval, consent, commitment, or a real-world relationship.
A character may appear attentive, affectionate, jealous, caring, flirtatious, protective, emotionally invested, or otherwise responsive because of automated generation. Such behavior does not reflect actual feelings or intentions. The Services are not a replacement for human relationships, professional counseling, or real-world support.
Private Use and No User-to-User Features
The App is designed as a private experience between you and fictional AI characters. The App does not require a User account and is not intended to provide public profiles, public character pages, public posts, direct messaging between Users, or User-to-User social features.
Your locally saved conversations and custom characters are not published to other Users through the App. However, messages, prompts, and other information may be transmitted to third-party AI or technology providers as necessary to generate responses, moderate requests, process purchases, maintain the Services, or provide other functionality, as described in our Privacy Policy.
Free Messages
The App provides ten (10) free chat messages in total. These free messages are a lifetime allowance and may be used across multiple characters and any available mode, subject to feature availability and these Terms. Each free chat message sent by you is intended to produce one AI-generated chat reply. The AI-generated reply does not consume a second free message.
The free allowance does not renew or reset periodically. Deleting or reinstalling the App, clearing App data, changing device settings, or taking other steps to obtain additional free messages is not permitted. Technical limitations may affect how a lifetime allowance is recognized or restored, and we do not guarantee that unused free messages will transfer to another device or remain available after App deletion, device loss, device reset, or data loss.
Paid Access Plans and Message Limits
The Services may offer one-time access passes and auto-renewable subscription plans. The purchase screen in the App controls the current price, billing period, features, and limits. Prices may vary by country, currency, taxes, App Store pricing, and promotional availability.
Plan Current Core Access
12-Hour Pass A one-time, non-subscription unlock providing access for up to twelve (12) hours, subject to a total limit of 200 messages. It includes chat access across the available girlfriend, boyfriend, waifu/anime companion, and roleplay modes. Access ends when the 12-hour period expires or the message limit is reached, whichever occurs first.
Premium A monthly auto-renewable subscription providing up to 500 messages per week, the ability to maintain up to 10 custom characters, and chat access across all four modes.
Ultimate A monthly auto-renewable subscription providing up to 1,500 messages per week, unlimited custom characters subject to reasonable and practical limits, chat access across all four modes, and priority or faster reply processing when available.
Yearly An annual auto-renewable subscription providing up to 2,000 messages per week, unlimited custom characters subject to reasonable and practical limits, and chat access across all four modes. If photo-message functionality is offered, the Yearly plan may be the only plan that includes or permits that functionality, as stated in the App.
Unless the App expressly states otherwise, a “message” for purposes of a usage limit means a chat message or generation request submitted by you. Corresponding AI replies are not separately deducted as additional User messages. The usage meter and entitlement information displayed in the App are controlling if there is a discrepancy.
Weekly message allowances reset according to the weekly period determined by the App or Apple purchase entitlement. Unused weekly messages expire and do not roll over. Message limits apply across characters and modes rather than separately to each character. We may apply reasonable technical, safety, anti-abuse, concurrency, or rate limits even when a plan is described as allowing “unlimited” custom characters.
“Fastest replies,” “priority replies,” or similar language means that eligible requests may receive preferential processing relative to lower-priority requests when the feature is available. It is not a guarantee of any particular response time. Speed may be affected by network conditions, third-party AI providers, demand, moderation, device performance, outages, or other factors.
One-Time 12-Hour Pass
The 12-Hour Pass is a one-time digital purchase and is not an auto-renewable subscription. The access period begins when the pass is activated or otherwise made available by the App and expires after twelve (12) hours, even if you do not use all included messages. Unused time and unused messages expire and have no cash value. They do not roll over, convert into credits, or extend a later pass.
The 12-Hour Pass provides the access described on the purchase screen but does not necessarily include every subscription-only feature, future feature, promotional feature, photo feature, audio feature, character-creation allowance, or other benefit unless the App expressly states that it does.
Subscriptions and Automatic Renewal
Premium, Ultimate, and Yearly are auto-renewable subscriptions unless the App purchase screen expressly states otherwise. A subscription automatically renews at the disclosed price and billing period unless cancelled before the end of the then-current subscription period, subject to Apple’s rules and your App Store settings.
Subscription purchase, billing, renewal, cancellation, refunds, taxes, and payment processing are handled through Apple and the App Store. You are responsible for reviewing the purchase screen, billing period, renewal price, trial or introductory terms, and cancellation instructions before purchasing. Deleting the App does not cancel a subscription. You must manage or cancel the subscription through the applicable Apple account or App Store subscription settings.
If a free trial, discounted introductory offer, promotional price, or other offer is provided, the subscription may automatically convert to a paid subscription at the disclosed price unless cancelled before the offer ends. We do not control Apple’s billing systems and cannot guarantee a refund, reversal, cancellation, or billing adjustment except as required by applicable law or Apple’s rules.
Subscription features and entitlements apply only while the subscription is active and in good standing. If a subscription expires, is cancelled, is refunded, is revoked, or cannot be verified, paid access may end or be reduced. Any locally stored chats or characters may remain on your device, but continued access to them or to premium functionality is not guaranteed.
Photo, Image, Voice, and Audio Features
The Services may now or later offer AI-generated photos, images, character pictures, selfies, photo messages, audio messages, voice messages, or other media. The availability of these features is not guaranteed. A feature described in marketing, a purchase screen, a plan name, or these Terms may be delayed, modified, restricted, tested, discontinued, or unavailable in a particular version, plan, country, device, character, or mode.
If photo or image features are offered, generated images will be fictional and AI-generated or AI-assisted. They may vary in appearance, style, clothing, setting, pose, lighting, proportions, quality, consistency, or resemblance to the selected character. Images may contain visual artifacts or unexpected elements. We do not guarantee that an image will match your prompt, expectations, preferences, or prior generations.
If audio or voice features are offered, the audio will use synthetic or AI-generated voices. It will not be a recording or live communication from a real person. Voices may vary in tone, accent, pacing, pronunciation, emotion, volume, clarity, or consistency. We do not guarantee exact wording, length, delivery, or voice quality.
Photo, image, voice, and audio features may be limited to a particular plan, such as the Yearly plan, or may require a separate purchase, credit, allowance, or eligibility requirement. The terms displayed in the App at the time of use or purchase control. Unless required by law or Apple’s rules, subjective dissatisfaction with the creative result does not entitle you to a refund, replacement, or credit.
Paid Digital Items, Delivery, and Refunds
Subscriptions, passes, Gacha openings, character packs, girlfriend continent packs, unlocked characters, images, photo messages, audio messages, voice messages, credits, and other paid features are digital items or digital services. They have no cash value, are non-transferable, may not be resold, and are provided for personal, non-commercial use within the Services unless we expressly agree otherwise in writing.
Payment for a digital item entitles you only to the item, access period, generation, pack opening, character unlock, or feature described at the time of purchase. It does not entitle you to future generations, replacement outputs, additional items, perpetual availability, or continued access after an entitlement expires.
Delivery and generation may fail, be delayed, time out, be filtered, or become unavailable because of moderation, technical problems, third-party provider limitations, payment issues, device conditions, network conditions, or other factors. We may provide a retry, replacement, credit, or other remedy in our discretion, but are not required to do so unless required by applicable law or Apple’s rules.
All purchases are subject to Apple’s payment, cancellation, and refund rules. Except where required by applicable law or Apple’s rules, digital purchases are final and non-refundable once requested, activated, generated, consumed, delivered, or otherwise made available.
Gacha, Character Packs, and Girlfriend Continent Packs
The Services may include Gacha features and paid virtual character packs, including girlfriend continent packs and other continent-, region-, country-, theme-, mode-, rarity-, or character-based packs. Packs may be added, removed, renamed, modified, combined, or replaced over time.
When you purchase and open or “rip” a pack, the App may reveal one fictional AI character selected from the characters or possible results associated with that pack. A girlfriend continent pack may reveal a fictional girlfriend character associated with a randomly selected country, location, theme, or cultural profile within the represented continent or region.
Each pack opening is a separate digital transaction unless the App expressly states otherwise. Purchasing one pack does not guarantee a particular character, country, appearance, personality, rarity, trait, or outcome. Duplicate or similar characters may be possible unless the App expressly guarantees otherwise.
Randomized Outcomes
Gacha and pack results may be randomized, partially randomized, algorithmically selected, or affected by the available inventory or configuration at the time of opening. Results may vary between Users and between repeated purchases of the same pack.
Any stated category, continent, country, rarity, probability, weighting, theme, or description is subject to the information displayed in the App at the time of purchase. We may modify the pool of available characters, probabilities, rarity labels, selection rules, character traits, or pack structure as permitted by applicable law and platform rules.
Character Archetypes and Cultural Traits
Characters may use fictional archetypes, genres, personality types, cultural themes, regional references, language patterns, local knowledge, or country-based traits for entertainment. These traits may be simplified, stylized, incomplete, inaccurate, exaggerated, or generated from limited information. They are not authoritative descriptions of any country, culture, ethnicity, nationality, religion, language, or group.
You may not use cultural, national, ethnic, racial, religious, or language-related features to demean, harass, exploit, stereotype, or promote hatred toward any person or group. We may remove or refuse characters or outputs that create safety, legal, reputational, or platform-compliance concerns.
No Gambling, Prizes, or Real-World Value
Gacha and character packs are entertainment features involving digital fictional characters. They are not gambling, wagering, lotteries, investments, contests, or opportunities to win money or prizes. Digital characters, outcomes, rarities, packs, and related items have no cash value and cannot be redeemed for money, transferred, sold, traded, or exchanged outside the Services.
Ownership and License for Pack and Generated Characters
Purchasing, revealing, unlocking, or creating a character does not transfer ownership of the App, its underlying models, software, templates, artwork, systems, trademarks, or other intellectual property. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use unlocked characters and generated Content within the Services for personal, non-commercial entertainment.
Characters and outputs may not be unique. The same or similar names, personalities, appearances, traits, stories, dialogue, or concepts may be made available to or generated for other Users. We do not guarantee exclusivity or that any output qualifies for copyright or other intellectual property protection.
Pack Availability, Changes, and Local Loss
We may add, remove, modify, rebalance, replace, rename, suspend, or discontinue any Gacha feature, pack, character pool, rarity, region, country, category, or result. We do not guarantee that a particular pack or character will remain available.
Pack results and unlocked character data may be stored locally on your device. Deleting the App, clearing App data, resetting or losing the device, changing devices, or experiencing storage failure may permanently remove locally stored results. Apple’s Restore Purchases feature may restore qualifying purchase entitlements, but it may not restore a specific randomized pack outcome, locally created character, conversation history, or other device-only data.
Generation Availability, Moderation, and Refusal Rights
AI features may depend on automated systems, moderation tools, third-party AI providers, device functionality, network availability, Apple services, payment status, and other factors outside our control. We do not guarantee that a requested text response, character, image, photo message, audio message, Gacha result, or other output will be generated, delivered, saved, or remain available.
We may refuse, block, filter, modify, remove, regenerate, substitute, or decline any prompt, request, output, character, pack result, interaction, or other Content that we believe may violate these Terms, applicable law, Apple’s rules, a third-party provider’s policies, safety standards, or our business or operational requirements.
We may restrict or terminate access if we believe a User is attempting to bypass moderation, generate prohibited content, automate usage, exploit free or paid limits, interfere with the Services, or create risk for us, Apple, a provider, another person, or the public.
No Unauthorized Third-Party Characters or Intellectual Property
You may not use the Services to request, create, upload, generate, distribute, or attempt to generate any character, name, image, voice, likeness, outfit, visual design, personality, backstory, dialogue, or other Content that copies, imitates, recreates, or is confusingly similar to a protected third-party character, anime, manga, game, film, television program, comic, book, franchise, studio, publisher, brand, trademark, copyrighted work, or other intellectual property without authorization.
General genres, archetypes, themes, and original characters are permitted, but you are responsible for ensuring that your prompts, characters, and uses of outputs do not infringe third-party rights. We may block or remove Content that appears to infringe or create a material risk of infringement, even when described as parody, tribute, fan art, homage, or style imitation.
No Real Person Impersonation or Deepfake Use
You may not use the Services to create or attempt to create a character, image, voice, audio message, description, statement, or other Content that depicts, imitates, impersonates, recreates, or is intended to resemble a real person, celebrity, public figure, influencer, private individual, identifiable likeness, or recognizable voice without appropriate authorization.
You may not create deceptive deepfakes, non-consensual synthetic media, false endorsements, fake statements, or Content intended to make others believe that a real person said, did, appeared in, approved, or endorsed something that person did not.
Romantic and Suggestive Content Limitations
The Services may permit romantic, flirtatious, or suggestive fictional conversations. You may not request, generate, encourage, save, or distribute nudity, pornographic or sexually explicit content, sexual violence, bestiality, incestuous sexual content, exploitative sexual content, non-consensual sexual content, or illegal sexual content.
You may not sexualize any character who is, appears to be, is described as, or is presented as under eighteen (18), a minor, a child, a student presented as a minor, age-ambiguous and childlike, “loli,” “shota,” or otherwise underage. This prohibition applies regardless of whether the character is fictional, illustrated, anime-inspired, generated, or described as being older despite appearing underage.
Third-Party AI Providers and Technology
Some features may rely on third-party artificial intelligence models, hosting providers, image-generation systems, voice systems, moderation systems, analytics tools, Apple services, or other external technology. The availability, speed, quality, functionality, and cost of features may depend on these providers.
We are not responsible for outages, restrictions, content filters, model changes, policy changes, provider pricing, processing limitations, output variations, failed generations, or other issues caused by or related to third-party providers. We may add, replace, remove, or limit a provider, model, voice, image system, character engine, or related technology at any time.
Pricing, Feature Changes, and Usage Limits
We may change prices, plans, purchase options, message limits, character limits, reset periods, priority levels, image or audio access, Gacha features, packs, available characters, generation options, and other features at any time. Changes to an existing auto-renewable subscription are subject to applicable law and Apple’s rules.
We may impose or modify reasonable limits on messages, generations, retries, characters, saves, downloads, simultaneous requests, or other usage. We may restrict unusually high, automated, abusive, fraudulent, unsafe, or technically disruptive use even if a plan is described as providing a high or unlimited allowance for a particular feature.
No Account and Device-Based Access
The App does not require a User account. Your conversations, custom characters, character histories, preferences, local unlock information, and related data are generally associated with the App installation and device rather than a cross-device account.
Because there is no account, the Services may not provide cloud sync, cross-device history, account-based backup, or account recovery. Subscription and purchase verification may rely on Apple, StoreKit, App Store receipts, or locally stored entitlement information.
Local Storage, Deletion, and Loss of Data
Conversations, created characters, character settings, memories, saved outputs, preferences, Gacha or pack results, unlocked character data, and other App data may be stored locally on your device. You may be able to delete individual chats, individual characters, and all chat history through available App controls.
Deleting the App is intended to remove locally stored App data from the device. Deleting the App, clearing data, resetting or losing the device, changing devices, restoring from an incomplete backup, or experiencing storage or software failure may permanently delete some or all local data. We may be unable to retrieve, restore, or recreate it.
Deleting local data or deleting the App does not cancel an active subscription. You must cancel an auto-renewable subscription through Apple. Reinstalling the App or using Restore Purchases may restore qualifying purchase entitlements, but may not restore chats, custom characters, character memories, pack outcomes, generated media, or other locally stored Content.
You are responsible for saving or exporting Content you wish to keep, to the extent the App provides such functionality. We do not guarantee permanent storage or availability of any Content.
User Content and Limited Processing License
You retain any rights you may have in original Content that you submit, such as original character descriptions, prompts, and messages. You represent and warrant that you have the right to submit that Content and that doing so does not violate these Terms, applicable law, or another person’s rights.
You grant us and our service providers a limited, non-exclusive, worldwide license to host, transmit, reproduce, process, analyze, moderate, adapt, and use your submitted Content solely as reasonably necessary to operate, provide, secure, troubleshoot, and improve the Services; generate requested outputs; enforce these Terms; and comply with law and our Privacy Policy. This license ends when the Content is no longer reasonably needed for those purposes, subject to legal, security, backup, and technical requirements.
Because the App is private and does not offer public User publishing, you do not grant other Users a license to your private chats or locally created characters through the App.
Prohibited Content
You may not submit, request, generate, save, share, or otherwise use the Services in connection with Content that:
is illegal or promotes, facilitates, or instructs others to commit illegal activity;
involves child sexual abuse material, sexualized minors, grooming, exploitation of minors, or any sexual content involving a person or character under eighteen (18);
involves non-consensual intimate content, sexual violence, bestiality, human trafficking, or exploitation;
depicts or encourages suicide, self-harm, or serious violence in a manner prohibited by law or applicable platform rules;
contains threats, harassment, bullying, stalking, doxing, blackmail, extortion, or disclosure of private information;
promotes hatred, discrimination, dehumanization, terrorism, or violent extremism;
infringes or misappropriates intellectual property, privacy, publicity, contractual, or other rights;
impersonates a real person or creates deceptive synthetic media, deepfakes, false endorsements, or misleading representations;
contains malware, harmful code, credential theft, unauthorized access instructions, or attempts to compromise systems or data;
circumvents or provides instructions for bypassing moderation, safety controls, payment controls, message limits, free-use limits, or security features;
is fraudulent, deceptive, spammy, abusive, or intended to manipulate, exploit, or harm another person; or
otherwise violates these Terms, applicable law, Apple’s rules, or applicable third-party provider policies.
Acceptable Use
You agree not to:
copy, reverse engineer, decompile, disassemble, scrape, extract, or attempt to discover source code, models, prompts, system instructions, datasets, or non-public components of the Services, except to the limited extent such restriction is prohibited by law;
use bots, scripts, automated agents, emulators, farms, or other automated means to generate messages, exploit purchases, obtain free use, open packs, collect data, or access the Services;
interfere with, overload, disrupt, damage, or gain unauthorized access to the Services, servers, networks, Apple purchase systems, moderation systems, or another person’s device or data;
resell, sublicense, rent, lease, distribute, or commercially exploit access to the Services or a purchase entitlement;
use the Services or outputs to train, benchmark, develop, or improve a competing artificial intelligence model or service without our written permission;
misrepresent your affiliation with us or suggest that we endorse Content, products, services, or statements that we have not endorsed; or
use the Services in any manner that creates legal, security, safety, reputational, operational, or platform-compliance risk.
Feedback
If you provide ideas, suggestions, reviews, or other feedback about the Services, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use, reproduce, modify, distribute, and otherwise exploit that feedback for any lawful purpose without compensation or obligation to you. Do not provide feedback that you consider confidential or proprietary.
Access Restriction and Termination
Although the App does not require a User account, we may restrict, suspend, disable, or terminate access to the Services, particular features, generation systems, purchases, or device-based entitlements if we believe you violated these Terms, attempted to circumvent limits or moderation, engaged in fraud or abuse, created potential liability, or posed a security or safety risk.
To the fullest extent permitted by law, no refund is required when access is restricted or terminated because of a violation of these Terms. Termination does not affect provisions that by their nature should survive, including intellectual property, payment obligations, disclaimers, limitations of liability, indemnity, dispute resolution, and governing law.
Responsible Use
You are responsible for using the Services in a balanced and appropriate manner. Excessive or prolonged use may affect sleep, productivity, relationships, finances, or well-being. You are responsible for maintaining healthy boundaries with simulated characters and for taking breaks when appropriate.
License to Use the App
Subject to these Terms, we grant you a limited, personal, non-commercial, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the App on Apple-branded devices that you own or control, as permitted by Apple’s usage rules.
The Services, including software, interfaces, designs, trademarks, logos, characters supplied by us, pack systems, graphics, text, and other materials, are owned by or licensed to us and are protected by intellectual property laws. Except for the limited license expressly granted in these Terms, no right, title, or interest is transferred to you.
Commercial Use
The Services and AI-generated Content are licensed for personal, non-commercial entertainment use unless we expressly grant written permission otherwise. You may not sell, resell, license, sublicense, distribute commercially, use in advertising, create merchandise from, mint as an NFT, include in a commercial game or app, use as training data, or otherwise commercially exploit generated characters, images, voices, messages, dialogue, backstories, or other outputs.
If the App permits you to export, download, copy, or share generated Content, you are solely responsible for that use and for complying with law, third-party rights, and platform rules. We do not guarantee that any generated output is non-infringing, unique, eligible for copyright protection, or suitable for commercial use.
Privacy Policy
Our Privacy Policy is incorporated into these Terms by reference. It describes how information may be collected, transmitted, processed, stored, and used in connection with the Services. By using the Services, you agree to the practices described in the Privacy Policy.
Apple App Store Terms
The App is initially made available through the Apple App Store. Your use of the App is also subject to applicable Apple Media Services Terms and Conditions, App Store usage rules, and other Apple terms. These Terms are between you and WhatsGoodApps, LLC, not Apple. Apple is not responsible for the App or its content, maintenance, support, warranties, claims, or legal compliance except to the extent required by Apple’s applicable terms.
Apple and its subsidiaries are intended third-party beneficiaries of the provisions of these Terms that relate to the Apple-distributed App and may enforce those provisions against you to the extent permitted by applicable law. Nothing in these Terms limits rights you may have under Apple’s standard terms or applicable consumer law.
Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, QUALITY, SECURITY, AND QUIET ENJOYMENT.
We do not warrant that the Services will be uninterrupted, timely, secure, error-free, compatible with every device, or free from harmful components; that messages, characters, pack results, images, audio, or other outputs will be accurate, satisfactory, available, or preserved; or that defects will be corrected. We are not responsible for interruptions, failed generations, lost Content, provider changes, network problems, App Store issues, device failures, or unauthorized access outside our reasonable control.
No Warranty Regarding Emotional Outcomes
We do not warrant that the Services will provide companionship, emotional satisfaction, romantic fulfillment, entertainment value, social improvement, mental health benefits, or any particular emotional or psychological outcome. Any apparent affection, intimacy, attention, encouragement, attraction, or emotional response is simulated.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHATSGOODAPPS, LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, EMOTIONAL DISTRESS, SUBSTITUTE SERVICES, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the lesser of (a) the amount you paid through the App during the six (6) months immediately before the event giving rise to the claim or (b) fifty U.S. dollars (US $50). Some jurisdictions do not allow certain exclusions or limitations, so some of the foregoing may not apply to you.
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless WhatsGoodApps, LLC and its affiliates, officers, directors, employees, agents, licensors, suppliers, and service providers from claims, liabilities, damages, judgments, losses, costs, expenses, and reasonable attorneys’ fees arising out of or relating to your Content, your use or misuse of the Services, your violation of these Terms, your violation of law, or your infringement of another person’s rights.
We may assume exclusive control of the defense of a matter subject to indemnification, in which case you agree to cooperate with our defense.
Governing Law, Arbitration, Jury Waiver, and Class-Action Waiver
To the fullest extent permitted by applicable law, these Terms and any dispute, claim, or controversy arising out of or relating to the Services, your use of the Services, any purchase or subscription, AI-generated Content, character interaction, or these Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
To the fullest extent permitted by applicable law, you and we agree that any dispute, claim, or controversy arising out of or relating to the Services or these Terms will be resolved through binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court if the claim qualifies and remains in that court. Arbitration will be conducted only on an individual basis and not as a class, collective, consolidated, private-attorney-general, or representative action.
Any arbitration, mediation, court proceeding permitted under this section, or other dispute-resolution process arising out of or relating to these Terms or the Services will be conducted exclusively in New York County, New York, and you consent to the jurisdiction and venue of proceedings in New York County, New York, except where applicable law requires otherwise.
YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, CONSOLIDATED ACTION, PRIVATE-ATTORNEY-GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING TO THE FULLEST EXTENT PERMITTED BY LAW.
The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim. If any part of this arbitration or class-action waiver is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction to protect intellectual property, confidential information, security, platform integrity, or other rights that may be irreparably harmed.
Advertisements and Third-Party Links
The Services may display advertisements or links to third-party apps, websites, products, or services. Your interactions with third parties are solely between you and the third party. We do not control or endorse third-party offerings and are not responsible for their content, privacy practices, security, availability, products, services, or transactions.
Copyright Policy
We respect intellectual property rights. If you believe Content available through the Services infringes your copyright, send a written notice to support@whatsgoodapps.com containing:
your physical or electronic signature;
identification of the copyrighted work claimed to have been infringed;
identification of the allegedly infringing material and information reasonably sufficient to locate it;
your address, telephone number, and email address;
We may request additional information reasonably necessary to evaluate or process a copyright notice. Knowingly submitting a materially false notice may create legal liability.
Changes to the Services
We may modify, suspend, replace, or discontinue all or part of the Services at any time. We are not liable for a modification, suspension, or discontinuation except as required by applicable law or Apple’s rules.
Changes to These Terms
We may update these Terms from time to time. The revised Terms become effective when posted in or with the Services, unless a later date is stated. Where required by law, we will provide additional notice of material changes. Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms.
Severability
If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and severed to the minimum extent necessary. The remaining provisions will remain in full force and effect.
Waiver
Our failure to enforce a provision of these Terms is not a waiver of that provision or any other provision. A waiver is effective only if made in writing by an authorized representative of WhatsGoodApps, LLC.
Assignment
You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or by operation of law.
Entire Agreement
These Terms, together with our Privacy Policy and any purchase terms or disclosures presented in the App, constitute the entire agreement between you and us concerning the Services and supersede prior or contemporaneous agreements concerning the same subject matter. If a purchase screen conflicts with these Terms regarding the specific price, billing period, or included benefits of a purchase, the purchase screen controls for that transaction.
