This Agreement is entered into by WhatsGoodApps LLC (“WhatsGoodApps,” “We,” “Us,” or “Our”), the developer of the Sports Betting Research app service (the “App,” “Service,” or “Services”), and the person agreeing to these terms (the “Customer,” “You,” or “Your”), and governs Your access to and use of the Services.
For purposes of this Agreement, “Assets” means any content, materials, sportsbook odds, betting lines, markets, game information, schedules, fair-market estimates, implied probabilities, expected-value calculations, percentage-edge calculations, positive expected value or “+EV” opportunities, sportsbook comparisons, suggested wager amounts, bankroll calculations, saved opportunities, algorithmic outputs, research information, text, graphics, images, data, software components, in-app content, paid features, and any other information or materials generated, displayed, provided, or made available through the Services, whether created by Us, generated algorithmically, or supplied by third parties.
This Agreement is effective when You are presented with this Agreement and proceed to use the Services (the “Effective Date”) or receive or use Assets. These terms may be updated and presented again to You from time to time. Continued use of the Services after updated terms become effective constitutes acceptance of the updated terms. If You do not agree to this Agreement, please stop using the Services.
Service Availability and Quality
We are constantly improving the Services. The Services are subject to modification and change, including changes to supported sports, leagues, sportsbooks, markets, data providers, calculation methodologies, refresh frequencies, free and paid features, and other functionality. No guarantees are made with respect to the Services’ quality, stability, uptime, availability, or reliability. We will not be liable for harm caused by reliance on the continued availability of any particular feature, data source, sportsbook, market, league, or other attribute of the Services.
Age Requirements and Eligibility
By accessing or using the Services, You confirm that You are at least 18 years old. Because the App relates to sports betting information, You are solely responsible for ensuring that Your use of the Services is lawful in Your jurisdiction and that You satisfy any higher minimum age requirement applicable to viewing or using sports betting-related information or participating in sports betting. In some jurisdictions, the applicable age may be 21 or older. The Services are void where prohibited.
Your Information and Local Storage
The App does not require a user account or login. Information that You enter into the App, including Your bankroll amount, and certain app data such as saved opportunities or preferences may be stored locally on Your device. We do not hold or manage the bankroll amount You enter, and entering a bankroll amount does not transfer, deposit, or place any money with Us. Please see Our Privacy Policy for additional information regarding data practices.
Prohibited Uses
We reserve the right to restrict, suspend, or terminate access to the Services where permitted by law.
You may not:
Use the Services for competitive research or to develop, train, benchmark, or improve a competing product or service;
Reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, methodologies, or non-public components of the Services or Assets, except to the extent such restriction is prohibited by applicable law;
Use automated tools to access, interact with, scrape, copy, monitor, harvest, or systematically extract Assets or data through the Services;
Violate these Terms of Service or other policies applicable to the Services;
Violate the privacy, publicity, intellectual property, or other rights of any third party;
Use the Services to stalk, harass, abuse, intimidate, threaten, defraud, or otherwise harm any person;
Interfere with or disrupt the Services or servers or networks connected to the Services;
Access or obtain materials or information through means not intentionally made available by Us;
Use the Services to provide financial advice, investment advice, gambling advice, sportsbook advice, or professional handicapping services to third parties without Our prior written permission;
Use the Services to violate, evade, or circumvent sportsbook rules, gaming laws, age restrictions, geolocation requirements, self-exclusion requirements, responsible gaming restrictions, or other legal or contractual restrictions;
Use the Services in any way that violates any applicable national, federal, state, local, or international law or regulation; or
Attempt to do any of the above.
We reserve the right to investigate complaints or reported violations of these Terms and to take actions We reasonably deem appropriate, including reporting suspected unlawful activity to law enforcement, regulators, or other appropriate third parties when permitted or required by law.
Sports Betting Research Features
Sports Betting Research is designed to help users research upcoming pre-game sports betting markets. Depending on data availability and the current version of the App, the Services may obtain sportsbook odds and related sports information from one or more third-party sources, compare odds among sportsbooks, analyze upcoming games and betting markets, calculate estimated fair-market prices or probabilities, identify opportunities that the App calculates as having positive expected value, display an estimated percentage edge, identify a sportsbook displaying a favorable available price, compare prices offered by other sportsbooks, display schedules of upcoming games, allow users to save opportunities, and calculate suggested wager amounts based on a bankroll amount entered by the user.
The App currently supports research for NFL, NBA, WNBA, MLB, and MLS markets. Supported sports, leagues, sportsbooks, betting markets, and features may be added, removed, suspended, or changed at any time, including as a result of data availability, provider changes, technical limitations, legal requirements, or business decisions.
The App is intended for pre-game research only. It does not analyze, recommend, or provide live or in-game wagering opportunities and does not execute wagers.
+EV, Fair Value, and Edge Calculations
Terms such as “+EV,” “positive expected value,” “value,” “fair value,” “fair odds,” “fair-market probability,” “edge,” “percentage edge,” “best,” and similar terms used by the App refer to mathematical estimates or comparisons generated from available data and the App’s methodologies. They are not statements of objective certainty and do not guarantee that a wager actually has positive expected value, is mispriced, will win, or will generate a profit.
Different methodologies, assumptions, data providers, sportsbooks, weighting methods, market conditions, available prices, data refresh times, and calculation times may produce different results. An opportunity identified as +EV at one time or price may cease to qualify as +EV when the market, price, underlying data, or calculation changes.
Even if a wager has positive expected value according to a mathematical model, that wager can lose. A single wager, multiple wagers, or a prolonged series of wagers identified by the App as +EV can result in partial or substantial financial losses.
Sportsbook Odds and Market Data
Sportsbook odds, lines, markets, game information, and related data displayed through the App may be obtained from third-party data providers and may not be real-time. Such information may be delayed, incomplete, inaccurate, unavailable, suspended, modified, or discontinued without notice. Sportsbook odds can change at any time and may vary by operator, jurisdiction, market, account, promotion, wager limit, eligibility, and time of viewing.
You are solely responsible for verifying the actual sportsbook, market, line, price, event status, eligibility, wager limits, house rules, and other relevant terms directly with the applicable sportsbook before taking any action outside of the App. We do not guarantee that any displayed price, market, or opportunity will remain available, be accepted, be honored, or match what is displayed by a sportsbook when You attempt to place a wager.
Third-Party Data Providers
The Services may rely on, reference, calculate from, or display information obtained from one or more third-party data sources, sports data feeds, odds feeds, public sources, or other providers. We may add, replace, remove, or change data providers at any time without notice.
A change in data provider may result in changes to sportsbook coverage, supported markets, available odds, refresh frequency, historical information, calculations, identified opportunities, or other Assets. We are not responsible for errors, delays, omissions, outages, changes, or inaccuracies in third-party data or for actions You take based on that information.
Bankroll and Suggested Wager Amounts
The App may calculate a suggested wager amount based on the bankroll amount You enter and mathematical bankroll-management methodologies, which may include the Kelly Criterion or fractional variations of the Kelly Criterion. The methodology used by the App may be modified from time to time.
Suggested wager amounts are mathematical outputs provided for informational purposes only. They are not instructions, guarantees, financial planning, or individualized gambling advice. They may not account for Your income, debts, expenses, savings, financial obligations, risk tolerance, other wagers, sportsbook limits, personal circumstances, ability to sustain losses, or any other factor that may be relevant to Your financial well-being.
The usefulness of any suggested wager amount depends in part on the accuracy and suitability of the bankroll amount You enter and on the accuracy of the underlying calculations and market data. A suggested wager amount does not mean that a wager is safe, suitable, or advisable. You may lose some or all money You choose to wager.
We do not hold, custody, manage, transfer, deposit, withdraw, or otherwise control Your bankroll or wagering funds. The bankroll amount entered in the App is a user-provided reference value used for calculations only.
Free Access and Subscriptions
The App may provide limited access without a paid subscription. Free users may view up to one currently available sample +EV opportunity for each supported sport when such an opportunity is available. The sample opportunity for a sport may change automatically as games, markets, odds, and identified opportunities change. Free access does not provide permanent access to any particular opportunity, and We do not guarantee that a qualifying opportunity will be available for every sport at all times.
Paid subscribers may access all +EV opportunities made available through the App, subject to data availability, supported markets, these Terms, and any technical or legal limitations. The App currently offers Weekly and Yearly subscription options. Both subscription plans provide the same subscription features; the plans differ only in billing period and price.
Subscriptions are offered through the Apple App Store. Payment is charged to Your Apple ID or App Store account in accordance with Apple’s applicable terms. Unless canceled, a subscription automatically renews for the same subscription period at the then-applicable price, subject to Apple’s policies and any notice required by law. You can manage or cancel Your subscription through Your Apple account or App Store subscription settings. Deleting the App does not by itself cancel a subscription.
Unless expressly stated otherwise in the App at the time of purchase, no free trial is offered. Refunds, billing disputes, subscription management, and payment processing are subject to Apple’s applicable terms, policies, and procedures. We may change subscription prices or available plans subject to applicable law and Apple’s requirements.
Saved Opportunities
The App may allow You to save or bookmark opportunities for later reference. Saving an opportunity does not lock, reserve, guarantee, or preserve any sportsbook odds, betting line, market, calculated edge, +EV status, suggested wager amount, or availability. A saved opportunity may later change, become unavailable, or cease to qualify as +EV. You should always review current information before taking any action.
Upcoming Game Schedules
The App may display schedules for upcoming games. Game dates, start times, participants, venues, and statuses may change because of postponements, cancellations, rescheduling, weather, league or organizer decisions, data provider changes, or errors and delays. You are responsible for independently verifying relevant event information before relying on it.
No Gambling, Wagering, or Sportsbook Services
The App does not accept, process, place, transmit, broker, or facilitate wagers of any kind. The App is not a sportsbook, casino, gambling operator, bookmaker, lottery operator, betting exchange, payment processor, or gambling platform. The App does not maintain a wagering account, hold wagering funds, accept wagering deposits, pay winnings, or execute wagers on Your behalf. No real-money gambling transactions are conducted through the App.
Any decision to place a wager outside of the App is made solely by You, at Your own risk, and subject to all applicable laws, sportsbook rules, age restrictions, geolocation requirements, responsible-gaming restrictions, and other applicable terms.
No Guarantee of Winning or Successful Outcomes
The App does not guarantee, promise, or imply that any +EV designation, percentage edge, fair-value calculation, sportsbook comparison, suggested wager amount, line, market, strategy, or other Asset will result in a winning wager, profit, successful outcome, or favorable betting result. No use of the terms “+EV,” “value,” “edge,” “best,” “fair value,” “fair odds,” or similar terminology means or implies that a wager will win, generate a profit, outperform another wager, or actually have positive expected value.
Sports outcomes and betting-market outcomes are uncertain and affected by many factors outside the App’s control. Use of the App does not improve, influence, or affect the actual outcome of a sporting event or the actual odds offered, accepted, or honored by any sportsbook.
Entertainment and Informational Purposes Only
The App and all sports betting research, +EV calculations, fair-value estimates, sportsbook comparisons, percentage-edge calculations, schedule information, bankroll calculations, suggested wager amounts, and other Assets are provided for entertainment and informational purposes only. They do not constitute financial, investment, gambling, legal, tax, professional sports betting, handicapping, sportsbook, or other professional advice.
You should not treat the App or any Asset as the sole basis for deciding whether to place a wager, how much to wager, which sportsbook to use, or whether to participate in sports betting. Sports betting involves substantial risk, and You should participate only where legal and only with money You can afford to lose.
Pre-Game Only Limitation
The App is intended to provide research regarding upcoming pre-game events and betting markets only. The App does not evaluate or provide live or in-game opportunities and does not monitor real-time developments during games. If a game starts, is delayed, postponed, canceled, suspended, or otherwise changes status, the App may not immediately reflect that change. You are solely responsible for verifying event status, market availability, odds, rules, and all relevant information before taking any action outside of the App.
No Affiliation with Sportsbooks, Leagues, Teams, or Data Providers
The App is not affiliated with, endorsed by, sponsored by, or officially connected to any sportsbook, casino, gambling operator, sports league, team, player, broadcast network, odds provider, data provider, regulatory body, or event organizer unless We expressly state otherwise. Any names, logos, trademarks, team names, league names, sportsbook names, or other third-party identifiers that may appear in connection with sports information are the property of their respective owners and are used for identification, reference, or informational purposes where applicable.
Display of a sportsbook name, price, line, market, or other information does not constitute sponsorship, endorsement, affiliation, or a representation by that sportsbook that the displayed information is current, available, or accurate. Information provided through the App is not official and should not be considered proof of any wager, ticket, result, payout, or sportsbook offer.
No Affiliation with Other Services
The App is not connected to any website, sportsbook, social media account, tout service, betting group, investment scheme, guaranteed-picks service, or other product or service offering guaranteed winnings, betting profits, or gambling returns unless expressly identified by Us in writing. Communications claiming guaranteed winnings, guaranteed profits, locks, risk-free picks, or certain outcomes are not associated with the App unless expressly identified by Us.
Accuracy and Performance Disclaimer
Sportsbook odds, lines, markets, schedules, fair-market calculations, implied probabilities, +EV determinations, percentage-edge calculations, sportsbook comparisons, suggested wager amounts, bankroll calculations, saved opportunities, and other Assets are based on available information, algorithms, and user inputs at the relevant time.
We make no representations or warranties regarding the accuracy, reliability, completeness, timeliness, availability, legality, profitability, usefulness, or suitability of any Assets. The App may produce or display results that are incorrect, outdated, unavailable, misleading, ineffective, or unsuitable for Your purposes. Because betting markets can change rapidly, calculations and opportunities may become outdated or stale immediately after they are generated or displayed.
No Reliance; User Responsibility
You are solely responsible for Your own decisions, including whether to place any wager outside of the App, how much to wager, whether to use any sportsbook, whether to participate in sports betting, and whether such activity is lawful and appropriate for You. You are solely responsible for verifying all information, including event status, odds, lines, markets, rules, restrictions, wager limits, and applicable law, before taking any action.
The App is a research tool only. Nothing in the App eliminates the need for Your independent judgment, and You assume the risks of decisions You make based in whole or in part on the Services or Assets.
Limitation of Liability
To the fullest extent permitted by law, WhatsGoodApps LLC and its affiliates, officers, directors, employees, agents, licensors, and service providers shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation loss of profits, wagers placed, bets lost, winnings not received, odds changes, missed opportunities, sportsbook account issues, or other financial losses arising from or relating to:
Your use of or reliance on any +EV opportunity, fair-value estimate, percentage edge, sportsbook comparison, displayed odds, suggested wager amount, bankroll calculation, schedule information, saved opportunity, or other Asset;
Any incorrect +EV designation, inaccurate edge percentage, erroneous fair-value calculation, stale or incorrect sportsbook odds, delayed data, difference between displayed and actual sportsbook prices, inaccurate suggested wager amount, or other error, delay, omission, or unavailability;
Any change, suspension, outage, or discontinuation involving a sportsbook, betting market, league, event, data provider, Apple service, or other third-party service;
Any decision You make based on the App or any Asset; or
Your participation in sports betting, wagering, fantasy sports, games of chance, or any related activity outside of the App.
You assume all risks associated with using the App for sports betting-related research or entertainment purposes.
THE SERVICES AND ASSETS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OR CONDITIONS OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR AVAILABILITY. YOU ARE SOLELY RESPONSIBLE FOR DETERMINING THE APPROPRIATENESS OF USING THE SERVICES AND ASSUME THE RISKS ASSOCIATED WITH THEIR USE.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU EXPRESSLY UNDERSTAND AND AGREE THAT NEITHER WHATSGOODAPPS NOR ITS OFFICERS, EMPLOYEES, DIRECTORS, SHAREHOLDERS, LICENSORS, SERVICE PROVIDERS, AFFILIATES, OR AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WHATSGOODAPPS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, RESULTING FROM: (A) THE USE OF OR INABILITY TO USE THE SERVICES OR ANY RELATED INFORMATION; (B) UNAUTHORIZED ACCESS TO THE SERVICES; (C) CONDUCT OF ANY THIRD PARTY; OR (D) ANY OTHER MATTER RELATING TO THE SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WHATSGOODAPPS’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE GREATER OF (I) ONE HUNDRED DOLLARS ($100) OR (II) THE PRICE YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU ARE MERELY DISSATISFIED WITH ANY PORTION OF THE SERVICES OR WITH THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE SERVICES AND, IF APPLICABLE, CANCEL YOUR SUBSCRIPTION.
Indemnification
To the fullest extent permitted by applicable law, You will indemnify, defend, and hold harmless WhatsGoodApps and its affiliates, shareholders, officers, directors, employees, agents, and representatives from and against claims, damages, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to: (a) information You input into the App; (b) Your access to, use of, or misuse of the Services or Assets; (c) Your violation of these Terms; (d) any wager, sportsbook activity, fantasy sports activity, or other activity You choose to engage in outside of the App; (e) Your reliance on any +EV calculation, displayed sportsbook odds, sportsbook comparison, percentage edge, fair-value calculation, bankroll calculation, or suggested wager amount; or (f) Your violation of any applicable law, sportsbook rule, gaming regulation, age restriction, geolocation restriction, or responsible-gaming requirement.
Responsible Play
We encourage responsible participation in sports betting and games of chance where legal. Sports betting can be addictive and can result in financial loss. Never wager more than You can afford to lose. If You believe You may have a gambling problem, seek assistance from appropriate resources, including national or local responsible gambling helplines or organizations such as the National Council on Problem Gambling.
By using the App’s sports betting research, +EV, odds-comparison, and bankroll-management features, You acknowledge that You have read, understood, and agree to the disclaimers and limitations in these Terms.
Dispute Resolution and Governing Law
ALL LEGAL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT, INCLUDING ANY DISPUTE REGARDING THE INTERPRETATION OR PERFORMANCE OF THIS AGREEMENT (A “DISPUTE”), WILL BE GOVERNED BY THE LAWS OF THE STATE OF NEW YORK, USA, EXCLUDING NEW YORK’S CONFLICTS-OF-LAWS RULES.
The parties will try in good faith to settle any Dispute within 30 days after the Dispute arises. If the Dispute is not resolved within 30 days, it shall be resolved by arbitration administered by the American Arbitration Association in accordance with its Expedited Commercial Rules in force as of the date of this Agreement (“Rules”). The parties will mutually select one arbitrator. The arbitration will be conducted in English in New York County, New York, USA.
Either party may apply to any competent court for injunctive relief necessary to protect its rights pending resolution of the arbitration. The arbitrator may order equitable or injunctive relief consistent with the remedies and limitations in this Agreement.
The arbitral award will be final and binding on the parties, and its execution may be presented in any competent court, including any court with jurisdiction over either party or any of its property. Each party will bear its own lawyers’ and experts’ fees and expenses, regardless of the arbitrator’s final decision regarding the Dispute, except to the extent otherwise required by applicable law or the Rules.
Force Majeure
Neither party will be liable for failure or delay in performance to the extent caused by circumstances beyond its reasonable control, including acts of God, natural disasters, terrorism, riots, pandemics, war, labor disputes, internet or telecommunications failures, outages or failures of third-party data providers, or governmental actions.
Waiver and Severability
If You do not comply with a portion of these Terms and We do not take action right away, this does not mean We are giving up any of Our rights under these Terms. If any part of these Terms is determined to be invalid or unenforceable by a court of competent jurisdiction or arbitrator, the remainder of the Terms shall remain in effect and shall be enforced to the maximum extent permitted by law.

Use the Services to violate, evade, or circumvent sportsbook rules, gaming laws, age restrictions, geolocation requirements, self-exclusion requirements, responsible gaming restrictions, or other legal or contractual restrictions;
Use the Services in any way that violates any applicable national, federal, state, local, or international law or regulation; or
Attempt to do any of the above.
We reserve the right to investigate complaints or reported violations of these Terms and to take actions We reasonably deem appropriate, including reporting suspected unlawful activity to law enforcement, regulators, or other appropriate third parties when permitted or required by law.
Sports Betting Research Features
Sports Betting Research is designed to help users research upcoming pre-game sports betting markets. Depending on data availability and the current version of the App, the Services may obtain sportsbook odds and related sports information from one or more third-party sources, compare odds among sportsbooks, analyze upcoming games and betting markets, calculate estimated fair-market prices or probabilities, identify opportunities that the App calculates as having positive expected value, display an estimated percentage edge, identify a sportsbook displaying a favorable available price, compare prices offered by other sportsbooks, display schedules of upcoming games, allow users to save opportunities, and calculate suggested wager amounts based on a bankroll amount entered by the user.
The App currently supports research for NFL, NBA, WNBA, MLB, and MLS markets. Supported sports, leagues, sportsbooks, betting markets, and features may be added, removed, suspended, or changed at any time, including as a result of data availability, provider changes, technical limitations, legal requirements, or business decisions.
The App is intended for pre-game research only. It does not analyze, recommend, or provide live or in-game wagering opportunities and does not execute wagers.
+EV, Fair Value, and Edge Calculations
Terms such as “+EV,” “positive expected value,” “value,” “fair value,” “fair odds,” “fair-market probability,” “edge,” “percentage edge,” “best,” and similar terms used by the App refer to mathematical estimates or comparisons generated from available data and the App’s methodologies. They are not statements of objective certainty and do not guarantee that a wager actually has positive expected value, is mispriced, will win, or will generate a profit.
Different methodologies, assumptions, data providers, sportsbooks, weighting methods, market conditions, available prices, data refresh times, and calculation times may produce different results. An opportunity identified as +EV at one time or price may cease to qualify as +EV when the market, price, underlying data, or calculation changes.
Even if a wager has positive expected value according to a mathematical model, that wager can lose. A single wager, multiple wagers, or a prolonged series of wagers identified by the App as +EV can result in partial or substantial financial losses.
Sportsbook Odds and Market Data
Sportsbook odds, lines, markets, game information, and related data displayed through the App may be obtained from third-party data providers and may not be real-time. Such information may be delayed, incomplete, inaccurate, unavailable, suspended, modified, or discontinued without notice. Sportsbook odds can change at any time and may vary by operator, jurisdiction, market, account, promotion, wager limit, eligibility, and time of viewing.
You are solely responsible for verifying the actual sportsbook, market, line, price, event status, eligibility, wager limits, house rules, and other relevant terms directly with the applicable sportsbook before taking any action outside of the App. We do not guarantee that any displayed price, market, or opportunity will remain available, be accepted, be honored, or match what is displayed by a sportsbook when You attempt to place a wager.
Third-Party Data Providers
The Services may rely on, reference, calculate from, or display information obtained from one or more third-party data sources, sports data feeds, odds feeds, public sources, or other providers. We may add, replace, remove, or change data providers at any time without notice.
A change in data provider may result in changes to sportsbook coverage, supported markets, available odds, refresh frequency, historical information, calculations, identified opportunities, or other Assets. We are not responsible for errors, delays, omissions, outages, changes, or inaccuracies in third-party data or for actions You take based on that information.
Bankroll and Suggested Wager Amounts
The App may calculate a suggested wager amount based on the bankroll amount You enter and mathematical bankroll-management methodologies, which may include the Kelly Criterion or fractional variations of the Kelly Criterion. The methodology used by the App may be modified from time to time.
Suggested wager amounts are mathematical outputs provided for informational purposes only. They are not instructions, guarantees, financial planning, or individualized gambling advice. They may not account for Your income, debts, expenses, savings, financial obligations, risk tolerance, other wagers, sportsbook limits, personal circumstances, ability to sustain losses, or any other factor that may be relevant to Your financial well-being.
The usefulness of any suggested wager amount depends in part on the accuracy and suitability of the bankroll amount You enter and on the accuracy of the underlying calculations and market data. A suggested wager amount does not mean that a wager is safe, suitable, or advisable. You may lose some or all money You choose to wager.
We do not hold, custody, manage, transfer, deposit, withdraw, or otherwise control Your bankroll or wagering funds. The bankroll amount entered in the App is a user-provided reference value used for calculations only.
Free Access and Subscriptions
The App may provide limited access without a paid subscription. Free users may view up to one currently available sample +EV opportunity for each supported sport when such an opportunity is available. The sample opportunity for a sport may change automatically as games, markets, odds, and identified opportunities change. Free access does not provide permanent access to any particular opportunity, and We do not guarantee that a qualifying opportunity will be available for every sport at all times.
Paid subscribers may access all +EV opportunities made available through the App, subject to data availability, supported markets, these Terms, and any technical or legal limitations. The App currently offers Weekly and Yearly subscription options. Both subscription plans provide the same subscription features; the plans differ only in billing period and price.
Subscriptions are offered through the Apple App Store. Payment is charged to Your Apple ID or App Store account in accordance with Apple’s applicable terms. Unless canceled, a subscription automatically renews for the same subscription period at the then-applicable price, subject to Apple’s policies and any notice required by law. You can manage or cancel Your subscription through Your Apple account or App Store subscription settings. Deleting the App does not by itself cancel a subscription.
Unless expressly stated otherwise in the App at the time of purchase, no free trial is offered. Refunds, billing disputes, subscription management, and payment processing are subject to Apple’s applicable terms, policies, and procedures. We may change subscription prices or available plans subject to applicable law and Apple’s requirements.
Saved Opportunities
The App may allow You to save or bookmark opportunities for later reference. Saving an opportunity does not lock, reserve, guarantee, or preserve any sportsbook odds, betting line, market, calculated edge, +EV status, suggested wager amount, or availability. A saved opportunity may later change, become unavailable, or cease to qualify as +EV. You should always review current information before taking any action.
Upcoming Game Schedules
The App may display schedules for upcoming games. Game dates, start times, participants, venues, and statuses may change because of postponements, cancellations, rescheduling, weather, league or organizer decisions, data provider changes, or errors and delays. You are responsible for independently verifying relevant event information before relying on it.
No Gambling, Wagering, or Sportsbook Services
The App does not accept, process, place, transmit, broker, or facilitate wagers of any kind. The App is not a sportsbook, casino, gambling operator, bookmaker, lottery operator, betting exchange, payment processor, or gambling platform. The App does not maintain a wagering account, hold wagering funds, accept wagering deposits, pay winnings, or execute wagers on Your behalf. No real-money gambling transactions are conducted through the App.
Any decision to place a wager outside of the App is made solely by You, at Your own risk, and subject to all applicable laws, sportsbook rules, age restrictions, geolocation requirements, responsible-gaming restrictions, and other applicable terms.
No Guarantee of Winning or Successful Outcomes
The App does not guarantee, promise, or imply that any +EV designation, percentage edge, fair-value calculation, sportsbook comparison, suggested wager amount, line, market, strategy, or other Asset will result in a winning wager, profit, successful outcome, or favorable betting result. No use of the terms “+EV,” “value,” “edge,” “best,” “fair value,” “fair odds,” or similar terminology means or implies that a wager will win, generate a profit, outperform another wager, or actually have positive expected value.
Sports outcomes and betting-market outcomes are uncertain and affected by many factors outside the App’s control. Use of the App does not improve, influence, or affect the actual outcome of a sporting event or the actual odds offered, accepted, or honored by any sportsbook.
Entertainment and Informational Purposes Only
The App and all sports betting research, +EV calculations, fair-value estimates, sportsbook comparisons, percentage-edge calculations, schedule information, bankroll calculations, suggested wager amounts, and other Assets are provided for entertainment and informational purposes only. They do not constitute financial, investment, gambling, legal, tax, professional sports betting, handicapping, sportsbook, or other professional advice.
You should not treat the App or any Asset as the sole basis for deciding whether to place a wager, how much to wager, which sportsbook to use, or whether to participate in sports betting. Sports betting involves substantial risk, and You should participate only where legal and only with money You can afford to lose.
Pre-Game Only Limitation
The App is intended to provide research regarding upcoming pre-game events and betting markets only. The App does not evaluate or provide live or in-game opportunities and does not monitor real-time developments during games. If a game starts, is delayed, postponed, canceled, suspended, or otherwise changes status, the App may not immediately reflect that change. You are solely responsible for verifying event status, market availability, odds, rules, and all relevant information before taking any action outside of the App.
No Affiliation with Sportsbooks, Leagues, Teams, or Data Providers
The App is not affiliated with, endorsed by, sponsored by, or officially connected to any sportsbook, casino, gambling operator, sports league, team, player, broadcast network, odds provider, data provider, regulatory body, or event organizer unless We expressly state otherwise. Any names, logos, trademarks, team names, league names, sportsbook names, or other third-party identifiers that may appear in connection with sports information are the property of their respective owners and are used for identification, reference, or informational purposes where applicable.
Display of a sportsbook name, price, line, market, or other information does not constitute sponsorship, endorsement, affiliation, or a representation by that sportsbook that the displayed information is current, available, or accurate. Information provided through the App is not official and should not be considered proof of any wager, ticket, result, payout, or sportsbook offer.
No Affiliation with Other Services
The App is not connected to any website, sportsbook, social media account, tout service, betting group, investment scheme, guaranteed-picks service, or other product or service offering guaranteed winnings, betting profits, or gambling returns unless expressly identified by Us in writing. Communications claiming guaranteed winnings, guaranteed profits, locks, risk-free picks, or certain outcomes are not associated with the App unless expressly identified by Us.
Accuracy and Performance Disclaimer
Sportsbook odds, lines, markets, schedules, fair-market calculations, implied probabilities, +EV determinations, percentage-edge calculations, sportsbook comparisons, suggested wager amounts, bankroll calculations, saved opportunities, and other Assets are based on available information, algorithms, and user inputs at the relevant time.
We make no representations or warranties regarding the accuracy, reliability, completeness, timeliness, availability, legality, profitability, usefulness, or suitability of any Assets. The App may produce or display results that are incorrect, outdated, unavailable, misleading, ineffective, or unsuitable for Your purposes. Because betting markets can change rapidly, calculations and opportunities may become outdated or stale immediately after they are generated or displayed.
No Reliance; User Responsibility
You are solely responsible for Your own decisions, including whether to place any wager outside of the App, how much to wager, whether to use any sportsbook, whether to participate in sports betting, and whether such activity is lawful and appropriate for You. You are solely responsible for verifying all information, including event status, odds, lines, markets, rules, restrictions, wager limits, and applicable law, before taking any action.
The App is a research tool only. Nothing in the App eliminates the need for Your independent judgment, and You assume the risks of decisions You make based in whole or in part on the Services or Assets.
Limitation of Liability
To the fullest extent permitted by law, WhatsGoodApps LLC and its affiliates, officers, directors, employees, agents, licensors, and service providers shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation loss of profits, wagers placed, bets lost, winnings not received, odds changes, missed opportunities, sportsbook account issues, or other financial losses arising from or relating to:
Your use of or reliance on any +EV opportunity, fair-value estimate, percentage edge, sportsbook comparison, displayed odds, suggested wager amount, bankroll calculation, schedule information, saved opportunity, or other Asset;
Any incorrect +EV designation, inaccurate edge percentage, erroneous fair-value calculation, stale or incorrect sportsbook odds, delayed data, difference between displayed and actual sportsbook prices, inaccurate suggested wager amount, or other error, delay, omission, or unavailability;
Any change, suspension, outage, or discontinuation involving a sportsbook, betting market, league, event, data provider, Apple service, or other third-party service;
Any decision You make based on the App or any Asset; or
Your participation in sports betting, wagering, fantasy sports, games of chance, or any related activity outside of the App.
You assume all risks associated with using the App for sports betting-related research or entertainment purposes.
THE SERVICES AND ASSETS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OR CONDITIONS OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR AVAILABILITY. YOU ARE SOLELY RESPONSIBLE FOR DETERMINING THE APPROPRIATENESS OF USING THE SERVICES AND ASSUME THE RISKS ASSOCIATED WITH THEIR USE.
The Services are not intended to provide financial advice, investment advice, gambling advice, sportsbook advice, legal advice, tax advice, or professional handicapping services.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU EXPRESSLY UNDERSTAND AND AGREE THAT NEITHER WHATSGOODAPPS NOR ITS OFFICERS, EMPLOYEES, DIRECTORS, SHAREHOLDERS, LICENSORS, SERVICE PROVIDERS, AFFILIATES, OR AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WHATSGOODAPPS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, RESULTING FROM: (A) THE USE OF OR INABILITY TO USE THE SERVICES OR ANY RELATED INFORMATION; (B) UNAUTHORIZED ACCESS TO THE SERVICES; (C) CONDUCT OF ANY THIRD PARTY; OR (D) ANY OTHER MATTER RELATING TO THE SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WHATSGOODAPPS’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE GREATER OF (I) ONE HUNDRED DOLLARS ($100) OR (II) THE PRICE YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU ARE MERELY DISSATISFIED WITH ANY PORTION OF THE SERVICES OR WITH THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE SERVICES AND, IF APPLICABLE, CANCEL YOUR SUBSCRIPTION.
Indemnification
To the fullest extent permitted by applicable law, You will indemnify, defend, and hold harmless WhatsGoodApps and its affiliates, shareholders, officers, directors, employees, agents, and representatives from and against claims, damages, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to: (a) information You input into the App; (b) Your access to, use of, or misuse of the Services or Assets; (c) Your violation of these Terms; (d) any wager, sportsbook activity, fantasy sports activity, or other activity You choose to engage in outside of the App; (e) Your reliance on any +EV calculation, displayed sportsbook odds, sportsbook comparison, percentage edge, fair-value calculation, bankroll calculation, or suggested wager amount; or (f) Your violation of any applicable law, sportsbook rule, gaming regulation, age restriction, geolocation restriction, or responsible-gaming requirement.
Responsible Play
We encourage responsible participation in sports betting and games of chance where legal. Sports betting can be addictive and can result in financial loss. Never wager more than You can afford to lose. If You believe You may have a gambling problem, seek assistance from appropriate resources, including national or local responsible gambling helplines or organizations such as the National Council on Problem Gambling.
By using the App’s sports betting research, +EV, odds-comparison, and bankroll-management features, You acknowledge that You have read, understood, and agree to the disclaimers and limitations in these Terms.
Dispute Resolution and Governing Law
ALL LEGAL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT, INCLUDING ANY DISPUTE REGARDING THE INTERPRETATION OR PERFORMANCE OF THIS AGREEMENT (A “DISPUTE”), WILL BE GOVERNED BY THE LAWS OF THE STATE OF NEW YORK, USA, EXCLUDING NEW YORK’S CONFLICTS-OF-LAWS RULES.
The parties will try in good faith to settle any Dispute within 30 days after the Dispute arises. If the Dispute is not resolved within 30 days, it shall be resolved by arbitration administered by the American Arbitration Association in accordance with its Expedited Commercial Rules in force as of the date of this Agreement (“Rules”). The parties will mutually select one arbitrator. The arbitration will be conducted in English in New York County, New York, USA.
Either party may apply to any competent court for injunctive relief necessary to protect its rights pending resolution of the arbitration. The arbitrator may order equitable or injunctive relief consistent with the remedies and limitations in this Agreement.
The arbitral award will be final and binding on the parties, and its execution may be presented in any competent court, including any court with jurisdiction over either party or any of its property. Each party will bear its own lawyers’ and experts’ fees and expenses, regardless of the arbitrator’s final decision regarding the Dispute, except to the extent otherwise required by applicable law or the Rules.
Force Majeure
Neither party will be liable for failure or delay in performance to the extent caused by circumstances beyond its reasonable control, including acts of God, natural disasters, terrorism, riots, pandemics, war, labor disputes, internet or telecommunications failures, outages or failures of third-party data providers, or governmental actions.
Waiver and Severability
If You do not comply with a portion of these Terms and We do not take action right away, this does not mean We are giving up any of Our rights under these Terms. If any part of these Terms is determined to be invalid or unenforceable by a court of competent jurisdiction or arbitrator, the remainder of the Terms shall remain in effect and shall be enforced to the maximum extent permitted by law.
