This privacy policy (the “Policy”) applies to WhatsGoodApps LLC (“WhatsGoodApps,” “We,” “Us,” or “Our”), developer of the Higgs Ai app (the “App,” “Service,” or “Services”).

Definitions: Throughout this Policy, “You” or “Your” means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. “Company” refers to WhatsGoodApps LLC. “Usage Data” refers to data collected automatically, either generated by use of the Service or from the Service infrastructure itself.

Applicability: This Policy applies to Personal Data that WhatsGoodApps collects, uses, and discloses in connection with Higgs Ai, including: (i) data collected through the Services; (ii) prompts, negative prompts, prompt enhancement requests, style selections, video settings, and other creative inputs You voluntarily submit; (iii) photos, images, people photos, selfies, background images, subject images, product images, brand materials, logos, packaging, artwork, characters, locations, scenery, and other content You voluntarily submit; (iv) AI-generated videos, animations, image-to-video results, text-to-video results, previews, thumbnails, exports, variations, regenerated outputs, project history, saved results, credit history, and other outputs generated by the App; (v) data collected through improving, testing, evaluating, and enhancing the App, including through anonymized and/or aggregated data as described in this Policy; (vi) data collected from customer support communications; and (vii) data collected from third-party sources where applicable. If audio, music, sound effect, voiceover, dialogue, or related features are offered, this Policy also applies to audio files, sound selections, voiceover text, audio prompts, generated audio, timing information, and related metadata submitted, selected, or generated through the App.

When You make purchases, We use third-party payment processors or app store providers to collect credit card or other financial information. WhatsGoodApps does not store the credit card or payment information You provide, only confirmation that payment was made and information necessary to validate purchases, subscriptions, entitlements, credit balances, credit packs, and usage allowances.

Changes: We may update this Privacy Policy from time to time to reflect changes in legal, regulatory, operational requirements, Our practices, and other factors. Please check this Privacy Policy periodically for updates. If any changes are unacceptable to You, You should cease using the Services. When required under applicable law, We will notify You of changes to this Privacy Policy.

2. Collecting and Using Your Personal Data

2.1 Types of Data Collected

2.1.1 Personal Data

While interacting with the Services, You may provide certain personally identifiable information that could be used to contact or identify You, including:

2.1.2 Prompts, Video Settings, and Creative Inputs

The Service may allow You to submit, edit, enhance, or save prompts, negative prompts, prompt drafts, prompt enhancement requests, AI-enhanced prompts, template selections, mood selections, visual style selections, lighting selections, camera movement selections, shot type selections, pacing selections, color selections, audience selections, aspect ratio selections, video length selections, quality selections, audio selections if offered, and other creative settings or instructions.

These prompts, settings, and creative inputs may be used to provide the requested Services, generate AI-powered videos or related outputs, improve the App experience, troubleshoot issues, provide customer support, enforce Our policies, and maintain Your project history where applicable.

2.1.3 Uploaded Images, People Photos, Backgrounds, Subjects, Products, and User Content

The Service may allow You to upload photos, select images from Your device, take photos using Your device camera, submit background images, subject images, product images, people photos, selfies, pet images, object images, brand materials, logos, packaging, artwork, characters, locations, scenery, and other related content to generate AI-powered videos, animations, previews, exports, and related outputs. Such materials, together with prompts, creative settings, and related information You submit through the App, are referred to in this Policy as “User Content.”

User Content may include images of You or other people, including faces, likenesses, bodies, clothing, surroundings, locations, objects, products, brands, backgrounds, and other visible information contained in the content You submit. You should avoid submitting highly sensitive, confidential, intimate, medical, financial, government identification, or third-party personal information unless necessary, legally permitted, and intended by You for processing through the App.

You are responsible for ensuring that You have the rights, permissions, licenses, and consents necessary to upload or submit User Content, including consent from any person appearing in a photo, image, or other submitted content where required by law.

Users may not upload images of minors or use the Service to create, animate, modify, generate, export, or share videos or other outputs depicting minors unless expressly permitted by the App and lawful under applicable law. The App is intended for adults, as described in the Children’s Privacy section below.

2.1.4 AI Videos, Animations, and Generated Results

The Service may generate outputs based on Your prompts, uploaded images, selected settings, and other User Content, including AI-generated videos, animations, image-to-video results, text-to-video results, previews, thumbnails, variations, regenerated outputs, saved exports, project history, and other generated results. These generated results may be stored to provide Your history, allow You to view prior creations, troubleshoot issues, validate credit usage, enforce policies, and enhance the Service.

Generated results may include synthetic or AI-created visual elements. Generated videos may not represent authentic, unmodified footage, real events, real endorsements, real testimonials, real public appearances, factual news footage, documentary footage, or real-world occurrences unless that is accurate and legally permitted. You are responsible for how You describe, publish, share, or otherwise use generated outputs.

2.1.5 Synthetic Video Elements and Visual Enhancements

The Service may create, modify, animate, enhance, add, remove, or alter visual elements, backgrounds, lighting, motion, scenery, objects, people-like elements, atmosphere, reflections, camera movement, or other details as part of the video-generation process. These elements may be synthetic, AI-generated, stylized, fictional, or modified and may not be accurate, complete, realistic, or free from artifacts.

The final result may vary depending on prompt quality, image quality, video settings, selected style, selected model or quality level, device capabilities, content complexity, lighting, framing, background, subject placement, and other factors.

2.1.6 Audio, Music, Voice, and Sound Features

If the Service offers audio, music, sound effect, voiceover, dialogue, or related features, We may collect and process audio files, sound selections, voiceover text, audio prompts, generated audio, timing information, transcription information where applicable, and related metadata as necessary to provide those features.

The App is not intended to identify speakers, authenticate identity, verify identity, match voices against databases, perform surveillance, or create voiceprints for identification purposes. You should not submit another person’s voice, music, sound recording, or other audio content unless You have all rights, permissions, licenses, and consents necessary to do so.

2.1.7 Credits, Purchases, Subscriptions, and Entitlements

The Service may offer paid features, subscriptions, monthly credit allowances, annual plans, purchased credit packs, bonus credits, promotional credits, one-time purchases, premium features, or other digital features. We may collect and process information relating to Your credits, credit balance, credit usage, purchased credit packs, subscription credits, bonus credits, generation history, failed generation status, refunds or credit restorations, subscription status, purchase confirmation information, and paid feature entitlements.

We use this information to validate purchases and subscriptions, track usage, display Your credit balance, determine whether You have access to paid features, process credit consumption, troubleshoot failed generations, restore purchases where available, and provide customer support.

2.1.8 App Permissions

The Service may request access to certain device features, such as camera access, photo library access, media library access, notifications, local storage, or other permissions, only as needed to provide App functionality. If audio features are offered, the App may request microphone or media-library permissions where necessary. You may be able to manage App permissions through Your device settings.

2.2 Use of Your Personal Data

We may use Personal Data for the following purposes:

To provide, maintain, operate, and improve Our Service.
To manage Your account, if accounts are offered or required.
To perform contracts with You, including purchases, subscriptions, credit packs, monthly credit allowances, one-time purchases, premium features, or other transactions through the Service.
To contact You by email, telephone, SMS, push notification, or other equivalent communication regarding updates, security, functionality, purchases, subscriptions, credits, entitlements, or requested services.
To provide news, offers, or general information about goods or services similar to those You have purchased or enquired about, unless You have opted out.
To manage Your requests and respond to customer support inquiries.
For business transfers, including mergers, sales, acquisitions, restructurings, financing, or similar transactions.
To process prompts, prompt enhancement requests, uploaded images, selected settings, User Content, and other inputs to generate AI-powered videos, animations, previews, thumbnails, exports, variations, regenerated outputs, and project history.
To provide prompt enhancement, template recommendations, style suggestions, video-setting suggestions, content generation, and related App functionality.
To maintain Your history of previous creations, where applicable.
To track credits, credit balances, credit usage, subscription credits, purchased credit packs, bonus credits, generation limits, subscription entitlements, and paid feature access.
To validate purchases, subscriptions, one-time purchases, credit packs, entitlements, and access to paid features.
To detect, prevent, or respond to abuse, fraud, prohibited content, safety risks, intellectual property concerns, policy violations, unlawful activity, or misuse of the Services.
To use automated and/or manual review tools to help enforce Our Terms of Service, comply with legal obligations, satisfy third-party provider requirements, and protect the safety and integrity of the Services.
To improve, test, evaluate, and enhance Our artificial intelligence, machine learning, algorithms, image-processing systems, video-generation systems, prompt-processing systems, audio-processing systems if offered, moderation systems, and Services using anonymized and/or aggregated data, where such data is not intended to identify You personally.
To identify usage trends, evaluate promotions, improve the Service, and improve Your experience.
To protect the security, integrity, and lawful operation of the Services.
2.3 AI, Automated Processing, Prompt Enhancement, and Anonymized Data

The Service may use automated systems, artificial intelligence, machine learning, computer vision, image processing, video generation, video rendering, prompt processing, audio processing if offered, algorithms, safety tools, moderation tools, or other automated technologies to analyze User Content, process prompts, enhance prompts, apply creative settings, generate videos and related outputs, and operate the Services.

We may use anonymized and/or aggregated data, including usage patterns, style selections, generated output characteristics, technical performance data, error data, credit usage patterns, prompt categories, moderation signals, and related App activity, to improve, test, evaluate, and enhance Our algorithms, models, image-processing systems, video-generation systems, prompt-processing systems, safety systems, and Services. Such anonymized or aggregated data is intended not to identify You personally.

We do not intentionally use identifiable Personal Data to train artificial intelligence or machine learning models without appropriate safeguards or as otherwise described in this Policy. If the App or a third-party AI provider processes prompts, uploaded images, generated videos, audio if offered, or related outputs to provide the requested Service, such processing is performed to operate the App functionality You request and as described in this Policy.

2.4 No Facial Recognition, Identity Verification, Voice Identification, or Biometric Identification

Higgs Ai may process visible features in uploaded images or generated videos, including faces, bodies, subject position, lighting, composition, motion, and background elements, solely to provide requested video-generation, animation, editing, safety, and related App functionality. Higgs Ai is not intended to identify You or any other person, verify identity, authenticate account access, match faces against databases, perform surveillance, track individuals, or perform biometric identification.

The App’s processing of images, videos, and visible features is not intended to create, collect, or use biometric identifiers or biometric information for identification, authentication, surveillance, tracking, security, or law enforcement purposes.

If audio, music, voiceover, dialogue, or related features are offered, the App is not intended to identify speakers, verify identity, authenticate account access, match voices against databases, perform voice surveillance, or create voiceprints for identification purposes.

2.5 Sharing of Your Personal Data

We may share Your Personal Data in the following situations:

With service providers, third-party vendors, consultants, and business partners: We may share Your Personal Data with these parties to provide services on Our behalf, including cloud hosting, storage, content delivery, analytics, customer support, payment processing, subscription management, AI, machine learning, image processing, video generation, video rendering, audio processing if offered, automated analysis, moderation, monitoring, and analyzing use of the Services.
With AI, video-generation, image-processing, audio-processing, and moderation providers: We may share prompts, negative prompts, enhanced prompts, uploaded photos, images, people photos, background images, subject images, product images, User Content, video settings, generated videos, previews, thumbnails, audio inputs if offered, generated outputs, technical metadata, or related information with third-party AI, video-generation, image-processing, audio-processing, moderation, cloud, storage, hosting, or infrastructure providers as reasonably necessary to generate requested videos, animations, previews, exports, audio if offered, and related App functionality.
With analytics, attribution, advertising, crash reporting, and subscription management providers: We may use third-party tools or software development kits to help Us understand App usage, measure performance, attribute installs, process subscription status, validate purchases, diagnose crashes, monitor credit usage, and improve the Services. These providers may process device identifiers, usage events, purchase-related confirmation data, diagnostic information, and related technical information in accordance with their own privacy practices and Our instructions where applicable.
For business transfers: We may share or transfer Personal Data in connection with, or during negotiations of, any merger, sale of Company assets, financing, acquisition, or similar transaction.
With Your consent: We may disclose Your Personal Data for any other purpose with Your consent.
With law enforcement: We may disclose Personal Data if required by law or in response to valid requests by public authorities. To the extent We receive a law enforcement request for Your Personal Data, We will promptly notify You and provide a copy of the request unless legally prohibited.
For legal, safety, and security purposes: We may share information to comply with legal obligations, protect rights or property, prevent or investigate wrongdoing, protect personal safety, enforce Our Terms of Service, prevent abuse or fraud, respond to intellectual property or safety concerns, or protect against legal liability.
2.6 User Responsibility for Submitted Information and Shared Outputs

You are responsible for the information, prompts, creative inputs, uploaded images, people photos, background images, subject images, product images, audio if offered, and other User Content You submit through the Service. You should only submit content that You have the legal right and permission to provide. You should avoid submitting private information about another person without appropriate permission. You should not submit information or User Content that is unlawful, harmful, abusive, defamatory, invasive of privacy or publicity rights, infringing, exploitative, misleading, deceptive, or otherwise inappropriate.

You are also responsible for how You save, export, publish, post, distribute, advertise with, commercialize, or otherwise share AI-generated videos and related outputs. You should not use generated outputs in a deceptive, misleading, unlawful, infringing, harmful, unauthorized, defamatory, or exploitative manner, including by implying that synthetic or AI-generated content is authentic footage, an unmodified recording, a real event, a real endorsement, a real testimonial, factual news footage, documentary footage, or evidence of a real-world occurrence unless that is accurate and legally permitted.

2.7 Metadata, AI Content Indicators, and Technical Information

Generated videos, images, exports, or files may include technical metadata, app-generated metadata, creation information, output identifiers, project identifiers, generation status information, file information, or other non-visible information used to support file functionality, safety, abuse prevention, troubleshooting, rights management, analytics, AI-content identification, or Service operation.

The App may not display a visible watermark unless expressly shown or disclosed in the App. However, the absence of a visible watermark does not mean a file lacks technical metadata or other non-visible information. Some metadata may be added, removed, changed, or lost depending on device behavior, exports, sharing platforms, file conversions, compression, or third-party services.

2.8 Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Personal Data to comply with legal obligations, resolve disputes, and enforce Our legal agreements and policies.

User Content, prompts, prompt enhancement requests, uploaded photos, images, people photos, background images, subject images, product images, audio if offered, generated videos, animations, previews, thumbnails, exports, project history, credit usage, subscription status, purchase validation information, and related App activity may be retained for as long as reasonably necessary to provide the Services, maintain Your history, validate purchases and entitlements, troubleshoot issues, improve the Services, comply with legal obligations, resolve disputes, and enforce Our agreements and policies.

Uploaded images, generated videos, previews, thumbnails, exports, and creation history may be stored persistently for use within the App and history feature, but may be deleted or become unavailable if You delete the App, change devices, clear App data, lose device data, delete Your account if account functionality is offered, or if storage is otherwise removed or unavailable. Deletion may be subject to technical limitations, device behavior, backups, legal obligations, provider retention periods, and anonymized or aggregated data uses described in this Policy. We do not guarantee permanent storage, backup, availability, or recoverability of any uploaded images, prompts, generated videos, previews, thumbnails, exports, project history, credits, credit history, or other content.

Anonymized and/or aggregated data may be retained and used for analytics, research, model evaluation, algorithm improvement, image-processing improvement, video-generation improvement, prompt-processing improvement, audio-processing improvement if offered, safety improvement, and Service improvement, where such data is not intended to identify You personally.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when used to strengthen security or improve functionality, or where We are legally required to retain it longer.

2.9 Transfer of Your Personal Data

Your information, including Personal Data, is processed at the Company’s operating offices and in other places where the parties involved in processing are located. This means information may be transferred to and maintained on computers located outside Your state, province, country, or other jurisdiction where data protection laws may differ from those in Your jurisdiction. Your consent to this Privacy Policy followed by submission of such information represents Your agreement to that transfer.

The Company will take steps reasonably necessary to ensure Your data is treated securely and in accordance with this Privacy Policy, and no transfer of Personal Data will take place to an organization or country unless adequate controls are in place.

2.10 Security of Your Personal Data

The security of Your Personal Data is important to Us, but no method of transmission over the Internet or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Personal Data, We cannot guarantee absolute security.

3. Children’s Privacy

Our Service does not address anyone under the age of 18. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with personal information through the Service, please contact Us. If We become aware that We have collected personal information from anyone under 13 without verification of parental consent, We will take steps to remove that information from Our servers.

If We need to rely on consent as a legal basis for processing Your information, and Your country requires consent from a parent, We may require Your parent’s consent before We collect and use that information.

4. Links to Other Apps or Websites

Our Service may contain links to other apps or websites that are not operated by Us. If You click a third-party link, You will be directed to that third party’s app or website. We strongly advise You to review the privacy policy of every app and website You visit.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party apps, websites, or services.

We may update this Privacy Policy from time to time. We will notify You of changes by posting the new Privacy Policy on this page.

We will strive to let You know via email and/or a prominent notice on Our Service before the change becomes effective and update the Last updated date at the top of this Privacy Policy.

6. Supplemental Terms and Conditions for Certain Regions

6.1 Europe

If You are located in the European Economic Area (the EEA), Switzerland, or the United Kingdom (the UK), Our legal basis for collecting and using Personal Data will depend on the Personal Data concerned and the context in which We collect it. We normally collect Personal Data where We have Your consent, where We need the information to perform a contract with You, or where processing is in Our legitimate interests and not overridden by Your rights. In some cases, We may have a legal obligation to collect Personal Data.

Prompts, uploaded images, people photos, background images, subject images, product images, audio if offered, generated videos, and generated visual outputs may contain personal data or sensitive personal data depending on the content, the jurisdiction, and applicable law. Where required, We rely on Your consent or another lawful basis to process such data for the App functionality You request.

When We share Personal Data of individuals in the EEA, Switzerland, or UK with third parties, We use legal mechanisms to safeguard the transfer, including European Commission-approved standard contractual clauses and additional safeguards where appropriate.

You may have rights to request access, correction, updates, deletion, restriction, objection, or portability of Your Personal Data. If We process Personal Data with Your consent, You may withdraw consent at any time. You also have the right to complain to a data protection authority. 6.2 California

This section applies to California residents and individuals whose information has been collected in California. WhatsGoodApps has included this notice to comply with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act, and related regulations (collectively, CCPA).

6.2.1 Categories of Personal Information

Depending on how You use the Service, We may collect categories of personal information such as identifiers, internet or other electronic network activity information, commercial information, inferences or generated outputs, User Content such as prompts, uploaded photos, images, people photos, submitted visual content, background images, subject images, product images, audio if offered, generated videos, generated animations, generated visual outputs, usage history, subscription information, purchase validation information, credit balances, credit usage, credit packs, and project history. Some information, including account credentials, payment-related confirmation data, permission-based device access, photos, images, people photos, uploaded content, audio if offered, or generated outputs, may be considered sensitive personal information depending on applicable law and context.

We use such information to provide the Service, process prompts and User Content, generate requested AI videos and related outputs, maintain history, validate purchases and subscriptions, track credits and entitlements, improve and secure the Service, respond to requests, enforce policies, prevent abuse, and comply with legal obligations.

6.2.2 Your Rights and Choices

California residents may have rights to know/access, delete, correct, and receive information about collection, use, disclosure, sharing, or sale of personal information, subject to applicable exceptions.

WhatsGoodApps does not sell Your personal information, as defined under the CCPA. If in the future We sell or share Your personal information in a manner that requires an opt-out right, We will provide notice and a method to exercise that right.

We use sensitive personal information, if collected, for purposes reasonably necessary to provide the Service, generate requested AI videos, maintain App functionality, validate purchases and entitlements, protect security, prevent abuse, comply with law, and otherwise as permitted by applicable law.

6.2.3 Exercising Your Rights

To exercise access, data portability, deletion, correction, or applicable opt-out rights, You may submit a verifiable consumer request by email to support@whatsgoodapps.com.

A verifiable consumer request must provide sufficient information that allows Us to reasonably verify Your identity or authority to make the request and describe Your request with enough detail for Us to understand, evaluate, and respond. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority.

We endeavor to respond to verifiable consumer requests within the time required by applicable law. If We require more time, We will inform You in writing of the extension period and reason. We do not charge a fee to process or respond to a verifiable consumer request unless permitted by applicable law.
