Terms of Service

This Agreement is entered into by WhatsGoodApps LLC (“WhatsGoodApps,” “We,” “Us,” or “Our”), the developer of the GLP1 Food Tracker app service (the “App”, “Service” or “Services”), and the entity or person agreeing to these terms (the “Customer,” “You” or “Your”), and governs the Customer’s access to and use of the Services.
For purposes of this Agreement, “Assets” means any content, materials, meal logs, meal photos, food descriptions, food detections, nutrition estimates, protein tracking, calorie tracking, fiber tracking, hydration tracking, meal check-ins, daily check-ins, appetite entries, nausea entries, fullness entries, energy entries, symptom-related entries, goals, charts, reports, insights, summaries, recommendations, AI-generated outputs, history entries, graphics, images, data, software components, or other information generated, provided, or made available through the Services, whether created by Us, generated by automated systems, or supplied by third parties.
This Agreement is effective when the Customer is presented with this Agreement and proceeds to use the Services (the “Effective Date”) or to receive or distribute Assets. These terms may be updated and presented again to the Customer from time to time. Continued use of the Services constitutes acceptance of the updated terms. If You do not agree to this Agreement, please stop using the Services.
Service Availability and Quality
We are constantly improving the Services to make them better. The Services are subject to modification and change. No guarantees are made with respect to the Services’ quality, stability, uptime, reliability, availability, accuracy, or continued availability of any feature. Please do not create any dependencies on any attributes of the Services. We will not be liable to You or Your downstream customers for any harm caused by Your dependency on the Service.
Age Requirements
By accessing the Services, You confirm that You are at least 18 years old and meet the minimum age of digital consent in Your country. The Services are intended only for adults. You may not use the Services if You are under 18 years old.
If You are a parent or legal guardian and You believe that a minor has accessed or used the Services, please contact Us so that We may take appropriate action.
Your Information
By using the Services, You may provide Us with personal information such as Your email address, user name, billing information, meal photos, food descriptions, nutrition goals, protein goals, calorie or fiber tracking information, hydration logs, meal check-in responses, daily check-in responses, app history, and other information that You enter or submit. Please see Our Privacy Policy.
Free Features, Paid Features, Subscriptions and Billing
The App may offer certain features for free and certain features only with an active paid subscription. Hydration logging may be available without a subscription. Meal logging, including photo-based meal logging, manual meal logging, food detection, nutrition estimates, meal history, meal check-ins, and meal-related insights, may require an active subscription after any applicable free trial or free access period ends.
The App may offer monthly and yearly subscription options. The App may also offer a seven (7) day free trial for eligible users. Unless cancelled before the end of the free trial, the subscription will automatically renew and You will be charged according to the subscription plan You selected. Subscription availability, pricing, trial eligibility, free features, paid features, and included functionality may vary by platform, country, promotional offer, app version, or account status, and may change from time to time.
Subscriptions are billed through the platform through which You subscribed, such as the Apple App Store or Google Play. You are responsible for managing and cancelling Your subscription through the applicable platform account settings. Deleting the App does not automatically cancel Your subscription. Unless otherwise required by law or applicable platform rules, payments are non-refundable and there are no refunds or credits for partially used subscription periods.
If Your subscription expires, is cancelled, fails to renew, or is otherwise not in good standing, We may limit access to paid features. We may still allow You to access certain free features, such as hydration logging, and may allow You to view, edit, delete, or export certain previously entered information where supported by the App.
Prohibited Uses
We reserve the right to suspend or ban Your access to the Services at any time, and for any reason.
You may not:
Use the Services for competitive research or to build a competing product or service;
Use the Services as a substitute for medical advice, diagnosis, treatment, nutrition counseling, dietitian services, medication guidance, or professional healthcare services;
Use the Services to determine whether to start, stop, increase, decrease, change, delay, or otherwise manage any medication, including any GLP-1 medication;
Use the Services to diagnose, treat, monitor, or manage any disease, medical condition, symptom, side effect, allergy, eating disorder, dehydration, nutritional deficiency, or emergency medical issue;
Rely on food detection, nutrition estimates, protein estimates, calorie estimates, fiber estimates, hydration tracking, check-ins, or insights as accurate, complete, or professional advice;
Use the Services to encourage, facilitate, or promote unsafe dieting, starvation, purging, misuse of medications, excessive restriction, obsessive tracking, or disordered eating;
Upload photos, images, or content that You do not have the right, permission, or lawful authority to submit, including content featuring other individuals without their consent;
Upload explicit, nude, pornographic, sexually exploitative, abusive, harassing, hateful, defamatory, unlawful, or otherwise objectionable content;
Submit false, misleading, unlawful, infringing, harmful, or inappropriate information or content;
Misrepresent the Services’ outputs as medical advice, nutrition advice, dietitian advice, scientific fact, definitive symptom analysis, guaranteed weight-loss guidance, or guaranteed health guidance;
Reverse engineer, decompile, or attempt to extract the underlying algorithms or models used in the Services;
Use automated tools, bots, or scripts to access, interact with, or extract data from the Services;
Share Your account or allow multiple users to access the Services through a single account;
Violate these Terms of Service or any other policies applicable to the Services;
Violate the privacy, publicity, intellectual property, or other rights of any third party;
Interfere with, disrupt, or attempt to gain unauthorized access to the Services, servers, or networks connected to the Services;
Access or obtain any materials or information through any means not intentionally made available by the Services;
Use the Services for fully automated decision-making that could adversely impact an individual’s legal rights, health, insurance status, employment status, or other important interests;
Use the Services in any way that violates any applicable national, federal, state, local, or international law or regulation; or
Attempt to do any of the foregoing.
We reserve the right to investigate complaints or reported violations of Our Terms of Service and to take any action We deem appropriate including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to user profiles, e-mail addresses, usage history, posted materials, IP addresses and traffic information.
General Wellness, Food Awareness & No Medical Advice Disclaimer
The App is intended for general wellness, food awareness, personal tracking, and informational purposes only. The App does not provide medical advice, diagnosis, treatment, medication guidance, nutrition counseling, dietitian services, healthcare services, or any other professional advice. The App is not a substitute for advice from a qualified physician, pharmacist, registered dietitian, nutritionist, therapist, or other qualified healthcare professional.
The App is not intended to diagnose, treat, cure, prevent, monitor, or manage any disease, condition, symptom, side effect, medication response, allergy, intolerance, dehydration, nutritional deficiency, or other health issue. You should consult a qualified healthcare professional regarding medication use, side effects, diet, nutrition, hydration, symptoms, weight loss, health goals, or health concerns.
The App is not a medical device and has not been reviewed, cleared, approved, or authorized by the U.S. Food and Drug Administration or any other medical regulatory authority.
No Medication Guidance
The App may refer to GLP-1 medications or be designed for users who are using or interested in GLP-1 medications. However, the App does not provide medication advice or guidance. The App does not tell You whether You should start, stop, increase, decrease, change, delay, combine, or otherwise manage any medication, including any GLP-1 medication. The App does not provide dosing instructions, injection instructions, medication schedules, prescribing guidance, or treatment recommendations.
You are solely responsible for following the advice, instructions, and warnings provided by Your physician, pharmacist, medication label, and other qualified healthcare professionals. Any questions about medication use, dosage, timing, side effects, contraindications, drug interactions, or whether a medication is appropriate for You should be directed to a qualified healthcare professional.
Meal Photos, Food Detection & Automated Analysis
The App may allow You to upload meal photos, take photos using Your device camera, log meals manually, enter food descriptions, and provide other related content (collectively, “User Content”). The App may use automated systems, artificial intelligence, machine learning, computer vision, algorithms, or other automated technologies to analyze User Content and generate Assets, including food detections, nutrition estimates, check-in prompts, history entries, charts, reports, and insights.
You acknowledge that food detection and automated analysis may contain errors and may not identify every food, ingredient, sauce, dressing, preparation method, portion size, cooking method, allergen, nutrient, calorie source, fiber source, protein source, or other relevant factor. AI-generated outputs may be inconsistent, incomplete, unexpected, biased, unsuitable, or inaccurate.
The accuracy and usefulness of the App’s analysis may depend on the quality, lighting, angle, framing, resolution, focus, completeness, and clarity of Your uploaded or captured images; the visibility of foods; whether foods are mixed, layered, hidden, blended, packaged, sauced, or partially eaten; whether ingredients are visible; and whether You provide accurate notes or corrections. WhatsGoodApps is not responsible for inaccurate, incomplete, inconsistent, biased, or less useful analysis resulting from photo limitations, hidden ingredients, portion size uncertainty, user error, incomplete information, or failure to review and edit the App’s outputs.
Nutrition Estimates Are Approximate
Any protein, calorie, fiber, hydration, portion, meal size, food category, or other nutrition-related estimate provided by the App is approximate and may be inaccurate. Such estimates are generated for general awareness and convenience only and are not intended to replace food labels, laboratory analysis, registered dietitian guidance, medical nutrition therapy, professional meal planning, or other professional advice.
You are responsible for reviewing, confirming, editing, correcting, or disregarding any food detections, nutrition estimates, goals, logs, reports, charts, or insights. You should not rely on the App for precise nutrition tracking, medical diets, allergy management, diabetes management, kidney disease management, pregnancy nutrition, eating disorder treatment, medication management, or any other health-related decision.
Meal Check-Ins, Daily Check-Ins, Symptoms & Personal Insights
The App may allow You to track how You feel after meals and from day to day, including appetite, fullness, nausea, bloating, heartburn, cravings, energy, hydration, and other wellness-related observations. Check-ins are self-reported and are intended for personal awareness only. The App does not determine, diagnose, or confirm the cause of any symptom, feeling, reaction, side effect, discomfort, or health concern.
Insights generated by the App are based on the information You provide and/or the App’s automated analysis. Such insights may be incomplete, inaccurate, coincidental, misleading, or not applicable to Your health, body, medication, diet, lifestyle, or circumstances. Symptoms may be caused by many factors, including medication, illness, allergies, intolerances, hydration, food choices, food timing, portion size, stress, sleep, exercise, medical conditions, or other causes outside the App’s knowledge or control.
Severe Symptoms and Emergencies
If You experience severe, persistent, worsening, or concerning symptoms, including severe nausea, vomiting, dehydration, abdominal pain, allergic reactions, difficulty breathing, chest pain, fainting, confusion, severe weakness, or any other concerning symptom, contact a qualified healthcare professional. If You believe You may be experiencing a medical emergency, call emergency services immediately. Do not delay seeking medical attention because of anything shown, omitted, or suggested by the App.
Hydration Tracking Disclaimer
The App may allow You to log hydration or water intake. Hydration tracking is for general awareness only. The App does not determine whether You are adequately hydrated, dehydrated, overhydrated, or at risk of any medical condition. Hydration needs vary based on health status, medication use, diet, climate, activity, body size, pregnancy, breastfeeding, medical conditions, and other factors. Consult a qualified healthcare professional regarding hydration needs or any concerns about dehydration, vomiting, diarrhea, dizziness, kidney disease, heart disease, or other medical conditions.
User Goals and Tracking Preferences
The App may allow You to select goals or tracking preferences such as weight loss, better digestion, reduced nausea, general food awareness, protein tracking, calorie tracking, fiber tracking, hydration tracking, or other goals. Goals and tracking preferences are user-selected convenience features and do not constitute professional recommendations. The App does not determine what goals are safe, appropriate, necessary, or effective for You.
You are solely responsible for choosing, reviewing, changing, or discontinuing any goal or tracking preference and for consulting qualified professionals before making health, nutrition, diet, weight-loss, exercise, hydration, or medication-related changes.
No Guarantee of Results
The App may provide personal tracking, food detections, nutrition estimates, check-ins, summaries, reports, charts, reminders, or insights. You understand and agree that such content is generated for general wellness and informational purposes and does not guarantee any specific result, including weight loss, reduced nausea, improved digestion, improved energy, improved hydration, improved protein intake, improved fiber intake, improved appetite control, reduced cravings, improved medication results, improved health, or any other outcome.
Results may vary significantly based on individual health, medication use, diet, portion size, hydration, activity level, sleep, stress, metabolism, medical conditions, healthcare guidance, user consistency, data accuracy, and other circumstances outside of Our control.
Food, Weight & Wellness Sensitivity; Eating Disorders
The App involves food, nutrition, hydration, calories, protein, fiber, appetite, weight-related goals, and body-related wellness tracking. The App is intended to support general awareness and is not intended to encourage unsafe dieting, starvation, purging, misuse of medications, excessive restriction, obsessive tracking, disordered eating, or unhealthy behavior. You should not use the App in a way that harms Your physical or mental health.
If You have a history of an eating disorder, disordered eating, food-related anxiety, body image distress, compulsive tracking, or any condition that may be negatively affected by food, calorie, weight, or nutrition tracking, You should consult a qualified healthcare professional before using the App. If using the App causes distress, obsessive behavior, unsafe restriction, purging, medication misuse, or other harmful behavior, You should discontinue use and seek support from a qualified professional or trusted person.
User-Generated Content, Meal Photos and User Entries
The App may allow You to upload meal photos, take photos using Your device camera, submit food descriptions, log hydration, enter goals, complete check-ins, add notes, and provide other related content or information. You represent and warrant that You own or have all necessary rights, permissions, and consents to upload, submit, process, and analyze any User Content through the App, including consent from any person appearing in such User Content.
You grant WhatsGoodApps a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, process, analyze, transmit, display, and create outputs from Your User Content solely as reasonably necessary to provide, maintain, operate, and improve the Services, including generating food detections, nutrition estimates, protein, calorie, fiber, and hydration tracking, meal check-ins, daily check-ins, reports, charts, history entries, insights, and other Assets.
You retain ownership of Your User Content. However, You are solely responsible for Your User Content and for ensuring that Your upload, submission, use, and sharing of User Content and related Assets complies with all applicable laws and does not violate the rights of any third party.
Acceptable Use – Meal Photos and User Content
You agree not to upload User Content that is unlawful, harmful, abusive, misleading, explicit, exploitative, infringing, invasive of privacy or publicity rights, includes individuals without required consent, or otherwise violates these Terms. WhatsGoodApps reserves the right, but has no obligation, to remove or restrict access to any User Content at its discretion.
Third-Party Services and Automated Providers
The App may use third-party service providers, platforms, hosting services, analytics services, payment processors, app stores, automated analysis providers, artificial intelligence providers, or other vendors to provide, operate, maintain, improve, or support the Services. You acknowledge that Your use of the Services may involve interaction with or processing by Third-Party Services, subject to applicable laws and Our Privacy Policy.
WhatsGoodApps is not responsible for the availability, accuracy, reliability, security, policies, practices, or content of Third-Party Services, except to the extent required by applicable law.
User Responsibility for Food, Health and Safety Decisions
You are solely responsible for how You interpret, use, rely on, share, or implement any food detection, nutrition estimate, hydration log, meal check-in, daily check-in, report, chart, goal, insight, reminder, recommendation, or other Asset provided by the App. WhatsGoodApps is not responsible for any food choice, beverage choice, portion choice, nutrition decision, medication question, medical decision, health decision, symptom interpretation, allergy issue, intolerance issue, dissatisfaction, cost, physical effect, health outcome, or other loss arising from Your use of or reliance on any such content.
You are responsible for considering allergies, intolerances, medical diets, healthcare instructions, food safety, medication instructions, dietary restrictions, religious or personal food restrictions, and professional guidance before making any food, hydration, nutrition, weight-loss, medication, or health-related decision.
Data Storage, History & Loss of Content
User Content, meal photos, food descriptions, food detections, nutrition estimates, protein, calorie, fiber, and hydration logs, meal check-ins, daily check-ins, goals, reports, charts, insights, history entries, or other Assets may be stored persistently for convenience within the App and to provide App functionality. However, WhatsGoodApps does not guarantee permanent storage, backup, availability, synchronization, or recoverability of any such content or outputs.
If the App is deleted, Your device is changed, access is lost, data is deleted, phone data is lost or corrupted, account access is lost, or the App’s local or associated storage is cleared, Your User Content, meal photos, food detections, nutrition estimates, hydration logs, check-ins, goals, reports, charts, insights, history, and other Assets may be permanently lost. You are responsible for maintaining any copies of content or outputs that You wish to keep.
No Monitoring Obligation
WhatsGoodApps does not monitor all User Content and has no obligation to review, verify, validate, or confirm the accuracy, legality, safety, consent, ownership, appropriateness, nutritional accuracy, medical relevance, health relevance, or usefulness of any uploaded image, submitted information, generated analysis, estimate, check-in, insight, report, chart, or other output.
Non-Reliance Clause
You agree that You are not relying on the App as Your primary source of medical advice, nutrition advice, medication guidance, dietitian guidance, health guidance, emergency guidance, allergy guidance, eating disorder support, weight-loss advice, or other professional advice, and that any decision to use, share, interpret, or implement the App’s outputs is made solely by You.
Limitation of Liability
To the fullest extent permitted by law, WhatsGoodApps LLC and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages (including but not limited to loss of profits or any other financial losses) arising from:
Your use of or reliance on any meal photo analysis, food detection, nutrition estimate, protein estimate, calorie estimate, fiber estimate, hydration log, meal check-in, daily check-in, report, chart, insight, recommendation, or other Asset generated by the App.
Any inaccuracy, incompleteness, bias, inconsistency, or error in analysis resulting from automated processing, including AI-based interpretation of User Content.
Any incorrect, incomplete, biased, inconsistent, or misleading feedback caused by poor image quality, improper camera angle, lighting issues, hidden ingredients, mixed foods, portion size uncertainty, incomplete notes, user error, or failure to review and edit outputs.
Any medical, nutritional, dietary, hydration, allergy, intolerance, medication, side-effect, weight-loss, eating disorder, food safety, or health-related decision or action taken by You or any third party.
Any failure to achieve weight loss, reduced nausea, improved digestion, improved hydration, improved energy, improved appetite control, improved protein intake, improved fiber intake, improved medication results, or any other outcome.
Any symptom, discomfort, side effect, allergic reaction, intolerance, dehydration, health event, medical condition, delayed care, or emergency issue, whether or not You used the App to track food, hydration, symptoms, goals, or check-ins.
Any unsafe dieting, starvation, purging, medication misuse, excessive restriction, obsessive tracking, disordered eating, distress, or other harmful behavior arising from Your use, misuse, interpretation, or sharing of the Services or Assets.
Any misinterpretation, misuse, sharing, or publication of meal logs, check-ins, estimates, reports, charts, insights, or other Assets by the User or any third party.
Any loss, deletion, corruption, or unavailability of uploaded images, meal logs, hydration logs, check-ins, goals, reports, charts, insights, history, notes, or other Assets, including due to deletion of the App or loss of device data.
Your use of or interaction with any Third-Party Services.
Both the Services and the Assets are provided to Customer on an “AS IS” BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or implied, including, without limitation, any warranties or conditions of TITLE, NON-INFRINGEMENT, MERCHANTABILITY, or FITNESS FOR A PARTICULAR PURPOSE. You are solely responsible for determining the appropriateness of using the Service and assume any risks associated with use of the Services.
The Service is not intended to provide financial, legal, medical, nutrition, dietitian, medication, psychological, mental health, emergency, weight-loss, eating disorder, or other professional advice.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT NEITHER WHATSGOODAPPS NOR ITS OFFICERS, EMPLOYEES, DIRECTORS, SHAREHOLDERS, LICENSORS, SERVICE PROVIDERS, AFFILIATES AND AGENTS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY DAMAGES, OR DAMAGES FOR LOSS OF PROFITS INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WHATSGOODAPPS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, RESULTING FROM: (A) THE USE OR THE INABILITY TO USE THE SERVICES OR ANY RELATED INFORMATION; (B) UNAUTHORIZED ACCESS TO THE SERVICES; (C) CONDUCT OF ANY THIRD PARTY (INCLUDING OTHER USERS) OF THE SERVICES; OR (D) ANY OTHER MATTER RELATING TO THE SERVICES. IN NO EVENT WILL WHATSGOODAPPS’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES OR CAUSES OF ACTION EXCEED THE GREATER OF (I) ONE HUNDRED DOLLARS ($100) OR (II) THE PRICE YOU PAID FOR THE SERVICE IN THE LAST TWELVE (12) MONTHS. IF YOU ARE MERELY DISSATISFIED WITH ANY PORTION OF THE SERVICES OR WITH THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE SERVICES.
Indemnification
You will indemnify, defend and hold harmless WhatsGoodApps and its affiliates, shareholders, officers, directors, employees, agents and representatives from and against any and all claims, including all damages, judgments, costs and expenses (including, reasonable attorneys’ fees) (“Claims”), arising out of and relating to (a) any Claims concerning information input by You, including User Content, meal photos, food descriptions, hydration logs, goals, check-ins, and other submitted content, (b) Your upload or submission of User Content without necessary rights, permissions, or consents, (c) Your use of the Services, including Your access to, use of, sharing of, reliance on, or misuse of the Services or Assets, (d) any food, nutrition, hydration, medication, symptom, weight-loss, eating disorder, health, or safety decision made by You based on or in connection with the Services or Assets, or (e) Your violation of these Terms of Service (including use of the Services in violation of these Terms of Service).
Dispute Resolution and Governing Law
ALL LEGAL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT (INCLUDING ANY DISPUTE REGARDING THE INTERPRETATION OR PERFORMANCE OF THE AGREEMENT) (“Dispute”) WILL BE GOVERNED BY THE LAWS OF THE STATE OF NEW YORK, USA, EXCLUDING NEW YORK’S CONFLICTS OF LAWS RULES.
The parties will try in good faith to settle any Dispute within 30 days after the Dispute arises. If the Dispute is not resolved within 30 days, it shall be resolved by arbitration by the American Arbitration Association in accordance with its Expedited Commercial Rules in force as of the date of this Agreement (“Rules”). The parties will mutually select one arbitrator. The arbitration will be conducted in English in New York County, New York, USA.
Either party may apply to any competent court for injunctive relief necessary to protect its rights pending resolution of the arbitration. The arbitrator may order equitable or injunctive relief consistent with the remedies and limitations in the Agreement.
The arbitral award will be final and binding on the parties, and its execution may be presented in any competent court, including any court with jurisdiction over either party or any of its property. Each party will bear its own lawyers’ and experts’ fees and expenses, regardless of the arbitrator’s final decision regarding the Dispute.
Force Majeure
Neither party will be liable for failure or delay in performance to the extent caused by circumstances beyond its reasonable control, including acts of God, natural disasters, terrorism, riots, pandemics, war, labor conditions, governmental actions, internet failures, hosting failures, app store outages, third-party provider failures, or other events beyond Our reasonable control.
Waiver and Severability
If You do not comply with a portion of these Terms and We do not take action right away, this does not mean We are giving up any of Our rights under these Terms. If any part of these Terms is determined to be invalid or unenforceable by a court of competent jurisdiction or arbitrator, the remainder of the Terms shall be enforced to the maximum extent permitted by law.
